Israeli Occupation Forces (IOF) Continue Systematic
Attacks against Palestinian Civilians and Property in the Occupied Palestinian
Territory (OPT)

 

· 5
Palestinian militants were killed by IOF in the Gaza Strip.

 

· 6
Palestinian civilians, including an old woman, were wounded by Israeli gunfire.

 

· Israeli
warplanes bombarded civilian and paramilitary sites in the Gaza Strip.

 

 A
workshop in Gaza City and a number of buildings in the Gaza International
Airport were destroyed.  

 

· IOF
continued to use force against peaceful protests.

 

 6
civilians, including a child and two journalists, were wounded by IOF.

 

· IOF
continued to fire at Palestinian farmers and workers in border areas in the Gaza
Strip and at fishing boats along the Gaza Strip beaches.

has continued to impose a total siege on the OPT and has isolated the Gaza
Strip from the outside world.

 

 Israeli
troops stationed at military checkpoints in the West Bank arrested 5
Palestinian civilian, including two children.

 

· Israel
has continued settlement activities in the West Bank, and Israeli settlers have
continued to attack Palestinian civilians and property.

Palestinian civilians were injured as Israeli settlers threw stones at their

 A
Palestinian woman miscarried as Israeli settlers attacked her in Silwan village
near Jerusalem.

 

Summary

 

Israeli violations of international law and
humanitarian law continued in the OPT during the reporting period (27 May – 02
June 2010):

 

Shooting: During the reporting period, IOF killed 5
Palestinian militants in the Gaza Strip and wounded 10 civilians, including an
old woman, a child and two journalists, in the West Bank and the Gaza
Strip. 

 

In the Gaza Strip, IOF killed 5
militants in two separate attacks near the border between the Gaza Strip and
Israel on 01 June 2010.

 

On 27 May 2010, two Palestinian civilians
were wounded when IOF fired artillery shells at the east of Gaza City. On 01
June 2010, an old woman was wounded when IOF fired an artillery shell at the
southern Gaza Strip town of Rafah. On 02
June 2010, a Palestinian worker was wounded when IOF fired at workers who were
collecting bricks and iron bars from the debris of destroyed buildings in the
northern Gaza Strip.

 

During the reporting period, IOF
bombarded and destroyed a workshop in Gaza City and some buildings in Gaza
International Airport.

 

In the West Bank, 6 civilians, including
a child and two journalists (one of whom is American), were wounded when IOF
used forced to disperse peaceful demonstration organized in protest to the
construction of the annexation wall and settlement activities.  

 

Incursions: During the reporting period, IOF conducted at least
9 military incursions into Palestinian communities in the West Bank.  IOF arrested 12 Palestinian civilians, including
4 children.  They also harassed two
Palestinian families in Hebron and Jerusalem.   

 

In the Gaza Strip, IOF conducted one
incursion into the east of Khan Yunis, during which they leveled areas of
Palestinian land which they had already razed.  

 

Restrictions on Movement: IOF have continued to impose a tightened siege on
the OPT and imposed severe restrictions on the movement of Palestinian
civilians in the Gaza Strip and the West Bank, including occupied East
Jerusalem.

 

Gaza Strip

 

IOF have continued to close all border crossings to
the Gaza Strip for more than two years. The Israeli siege of Gaza, which has
steadily tightened since June 2007, has had a disastrous impact on the
humanitarian and economic situation in the Gaza Strip.  

 

· On
Friday, 01 January 2010, IOF decided to close the Nahal Oz crossing permanently
and to allow the entry of fuels through Karm Abu Salem (Kerem Shalom) crossing,
southeast of Rafah, citing security reasons. 

 

· 1.5
million people are being denied their basic rights, including freedom of
movement, and their rights to appropriate living conditions, work, health and
education.

 

· The
primary concern of the population of the Gaza Strip is to obtain their basic
needs of food, medicines, water and electricity supplies.

· Israel
has continuously prevented the entry of raw construction materials into the
Gaza Strip for over two and a half years.

 

· Israel
has not allowed fuel supplies into the Gaza Strip, excluding marginal amounts
of cooking gas and industrial fuel for Gaza Power Plant, since 10 December
2008.

 

· The
Rafah International Crossing Point has been opened for a limited number of days
for a small number of patients who received medical treatment abroad and needed
to return home to the Gaza Strip.

 

· Israel
has continued to close Beit Hanoun (Erez) crossing for Palestinian civilians
wishing to travel to the West Bank and Israeli for medical treatment, trade, or
social visits.

 

· Israel
has imposed additional restrictions on access of international diplomats, journalists
and humanitarian workers to the Gaza Strip. They have prevented representatives
of several international humanitarian organizations from entering the Gaza
Strip.

 

· Living
conditions of the Palestinian civilian population have seriously deteriorated as
levels of poverty and unemployment have sharply mounted.

 

· At
least 800 Palestinians prisoners from Gaza held in Israeli jails have been
deprived of family visitation for more than two years. 

 

· IOF
have continued to attack Palestinian fishermen along the Gaza Strip coast.

 

West Bank

 

IOF have continued to impose severe restrictions on
the movement of Palestinian civilians throughout the West Bank, including
occupied East Jerusalem. Thousands of Palestinian civilians from the West Bank
and the Gaza Strip continue to be denied access to Jerusalem.

 

· IOF
have established checkpoints in and around Jerusalem, severely restricting
Palestinian access to the city. Civilians are frequently prevented from praying
at the al-Aqsa Mosque in Jerusalem.

 

· There
are approximately permanent 630 roadblocks, manned and unmanned checkpoints
across the West Bank. In addition, there are approximately 60-80
“flying” or temporary checkpoints erected across the West Bank by IOF
every week.

 

· When
complete, the illegal Annexation Wall will stretch for 724 kilometers around
the West Bank, further isolating the entire population. 350 kilometers of the
Wall has already been constructed. Approximately 99% of the Wall has been
constructed inside the West Bank itself, further confiscating Palestinian land.

 

· At
least 65% of the main roads that leads to 18 Palestinian communities in the
West Bank are closed or fully controlled by IOF (47 out of 72 roads).

 

· There
are around 500 kilometers of restricted roads across the West Bank. In addition,
approximately one third of the West Bank, including occupied East Jerusalem, is
inaccessible to Palestinians without a permit issued by the IOF. These permits
are extremely difficult to obtain.

· IOF
continue to harass and assault demonstrators who hold peaceful protests against
the construction of the Annexation Wall.

 

· IOF
continues to harass Palestinian civilians in Jerusalem and throughout the West
Bank, including regularly stopping and search Palestinian civilians in the
street.

 

· During
the reporting period, Israeli troop stationed at military checkpoints in the
West Bank arrested 8 Palestinian civilians, including a child and a woman.

 

Settlement Activities: IOF have continued settlement activities and Israeli
settlers living in the OPT in violation of international humanitarian law have
continued to attack Palestinian civilians and property.

 

On 28 May 2010, Israeli settlers from “Beit
Jonathan” settlement outpost in Silwan village, to the south of the old city
of Jerusalem, harassed a number of Palestinian woman. Immediately, clashes erupted between
Palestinian civilians and Israeli settlers. IOF intervened and attacked ‘Essam Da’na, 48, and Riaham Ussama al-Rjabi,
20, who is pregnant and miscarried as a result. A number of women present also suffered from tear gas inhalation.

 

On the same day, one Israeli settler from a group of settlers
at the intersection of “Karni Shmoron” settlement near
Qalqilya-Nablus road, east of Qalqilya, threw a large stone from a close
distance at a Palestinian civilian vehicle that was traveling to Qalqilya. The stone broke the back window of the
vehicle, and 4 civilians were injured.

 

On 29 May 2010, guards of “Beit Jonathan”
settlement outpost in Silwan village, to the south of the old city of Jerusalem,
attacked a group of Palestinian children who were playing. Palestinian civilians gathered to protect
their children. Immediately, IOF arrived
at the area and violently beat Noura al-Rajabi and Mohammed and Ahmed Gazzawi.

 

 

 

Israeli Violations Documented
during the Reporting Period (27 May – 02 June 2010)

 

1. Incursions into Palestinian Areas and Attacks on Palestinian Civilians
and Property in the West Bank and the Gaza Strip

 

Thursday, 27 May 2010

 

· At
approximately 00:30, IOF moved into Yatta village, south of Hebron. They raided and searched a number of houses
and arrested Salem Taleb Meghnem, 17.

 

· At
approximately 01:00, IOF moved into Beit Jala town, west of Bethlehem. They raided and searched a house belonging to
the family of Ramzi ‘Ali Bouja, 30, and arrested him.

 

· At
approximately 05:00, IOF moved into al-Ramadin village, southwest of Hebron,
near the annexation wall. They raided a
house belonging to Mousa Hassan ‘Amru, firing tear gas canisters into and near
the house. At least 8 members of the
family suffered from tear gas inhalation and were evacuated to a medical center
in the nearby al-Zahiriya village:

 

1. Tayseer Mousa ‘Amru, 45;

2. Jihad Tayseer ‘Amru, 18;

3. Isma’il Mousa ‘Amru, 24;

4. Fu’ad Tayseer ‘Amru, 23;

5. Ghada Mousa ‘Amru, 25;

6. Hala Isma’il ‘Amru, 30;

7. Murad Tayseer ‘Amru, 25; and

8. Ra’ed Yasser ‘Amru, 14.

 

· At
approximately 18:00, Israeli aircrafts and tanks fired a number of shells at the
area to the south of al-Mentar (Karni) crossing, east of al-Shoja’iya
neighborhood in the east of Gaza City, in response to mortar fire from the
area. As a result, two Palestinian
civilians were lightly wounded:

 

1. Baraka Mohammed al-Mughrabi, 55; and

2. Mousa Badawi, 28.

 

Friday, 28 May 2010

 

· At
approximately 00:00, IOF moved into ‘Obwin village, northwest of Ramallah. They raided and searched a house belonging to
the family of ‘Ali Mohammed ‘Omran, 19, and arrested him.

 

· At
approximately 01:00, IOF moved into Nabi Saleh village, northwest of
Ramallah. They raided and searched a
house belonging to the family of Murad ‘Abdul Hafiz al-Tamimi, 32, and arrested
his child, 12-year-old Waleed. The child
was released at approximately 16:30. 

 

 

 

 

Saturday, 29 May 2010

 

· At
approximately 01:20, Israeli fighter jets dropped 5 missiles at Gaza
International Airport, southeast of Rafah. The missiles damaged the runway as well as what remains of previously
destroyed buildings there. No casualties
were reported.

 

· At
approximately 02:00, an Israeli fighter jet dropped a bomb at a
200-square-meter workshop of smith works belonging to the al-Masri family in
al-Zaytoun neighborhood in the east of Gaza City. The workshop was totally destroyed, but no
casualties were reported. 

 

Sunday, 30 May 2010

 

· At
approximately 04:20, Israeli fighter jets dropped 5 missiles at Gaza
International Airport, southeast of Rafah. The missiles damaged the runway as well as what remains of previously
destroyed buildings there. No casualties
were reported.

 

Monday, 31 May 2010

 

· At
approximately 03:00, IOF moved into Silwad village, north of Ramallah. They raided and searched a house belonging to
the family of Mohammed Rateb Hamed, 21, and arrested him.

 

· At
approximately 11:30, Israeli troops stationed on observation towers near Beit
Hanoun (Erez) crossing in the northern Gaza Strip fired at Palestinian workers
who were collecting bricks and iron bars from the debris of destroyed buildings
in the industrial zone to the south of the crossing. No casualties were reported.

 

Tuesday, 01 June 2010

 

· At
approximately 07:10, an exchange of fire erupted between IOF and two
Palestinian militants near the border between the Gaza Strip and Israel to the
east of ‘Abassan village, east of Khan Yunis. Soon after, Israeli tanks fired 7 shells and warplanes fired 2 missiles
at agricultural lands in the area. Later, IOF claimed that they had foiled an attempt by 2 Palestinian
militants to infiltrate through the border into “Ashkul” community
and that those militants were killed. At
approximately 16:00, IOF moved nearly 400 meters into the area and leveled
areas of Palestinian agricultural land. At approximately 00:10 on Wednesday, 02 June 2010, IOF delivered the
bodies of the 2 militants to an ambulance of Palestine Red Crescent Society,
following coordination with the ICRC. The militants were identified as:

 

1. ‘Abdul Rahman ‘Omar ‘Abdul Hamid
al-Astal, 18; and

2. Mohammed Ameen Shahwan, 18.

 

· At
approximately 10:00, Israeli troops stationed at the border between the Gaza
Strip and Israel, to the east of the southern Gaza Strip town of Rafah, opened
fire at al-Shouka neighborhood, in the southeast of the town. As a result, Salma Jom’a Shallouf, 71, was
wounded by a gunshot to the thighs when she was at home, nearly 3,000 meters
away from the border.

 

· At
approximately 11:00, Israeli troops stationed on observation towers near Beit
Hanoun (Erez) crossing in the northern Gaza Strip fired at Palestinian workers
who were collecting bricks and iron bars from the debris of destroyed buildings
in the industrial zone to the south of the crossing. No casualties were reported.

 

· At
approximately 15:45, Israeli troops stationed at the border between the Gaza
Strip and Israel, to the north of the northern Gaza Strip town of Beit Lahia,
fired an artillery shell at Palestinian resistance activists who launched home-made
rockets at Israeli towns. Three activists were killed instantly:

 

1. ‘Arafat Msallam ‘Abdul Karim Abu ‘Eid,
22, from al-Qarara village near Khan Yunis;

2. ‘Alaa’ Mohammed Deeeb al-Ghannam, 21,
from Rafah; and

3. Hayel Hassan al-Qadhi, 23, from Rafah.

 

Wednesday, 02 June 2010

 

· At
approximately 08:10, Israeli troops stationed on observation towers near Beit
Hanoun (Erez) crossing in the northern Gaza Strip fired at Palestinian workers
who were collecting bricks and iron bars from the debris of destroyed buildings
in the industrial zone to the south of the crossing. No casualties were reported.  

 

· At
approximately 16:30, Israeli troops stationed on observation towers near Beit
Hanoun (Erez) crossing in the northern Gaza Strip fired at Palestinian workers
who were collecting bricks and iron bars from the debris of destroyed buildings
in the industrial zone to the south of the crossing. As a result, Mohammed Zaki Abu Hamada, 34,
from Jabalya refugee camp, was wounded by a gunshot to the right hand.

 

· At
approximately 17:00, IOF moved into al-Ma’sara village, south of
Bethlehem. They chased and arrested
Saddam ‘Alaa’ al-Din, 17, when he was near the annexation wall.

 

· At
approximately 20:45, Israeli gunboats stationed off the beach of the northern
Gaza Strip town of Beit Lahia opened fire at Palestinian fishing boats. Palestinian fishermen were forced to sail
back to the beach and no casualties were reported.

 

 

2. Use of Excessive Force against Peaceful Demonstrations Protesting
Settlement Activities and the Construction of the Annexation Wall

 

During the reporting period, IOF used excessive force
against peaceful demonstrations organized by Palestinian civilians and
international and Israeli human rights defenders in protest to the construction
of the Annexation Wall and settlement activities. At least 6 civilians were injured, including
a child and two journalists, one of whom is American.  Dozens of others also suffered from tear gas
inhalation.  

 

· Following
the Friday Prayer on 28 May 2010, dozens of Palestinian civilians and
international and Israeli human rights defenders organized a peaceful
demonstration in protest to the construction of the Annexation Wall in Bal’ein
village, west of Ramallah. The
demonstrators moved towards the Annexation Wall and attempted to cross it
towards annexed lands.  Immediately, Israeli
troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at
the demonstrators, and they chased the demonstrators into fields. Fire broke out in a tract of agricultural
land belonging to Khalil Mohammed Abu Rahma, and Mustafa Shawkat al-Khatib, 18,
was hit by a tear gas canister to the back.  Dozens of demonstrators also suffered from
tear gas inhalation. Israeli troops also
arrested 4 Israelis: Mica  Rachman, 60; Michael
Savir, 26; Naomi, 25; and Moshe Leuilianski, 73. 

 

· Also
following the Friday Prayer on 28 May 2010, dozens of Palestinian civilians and
international and human rights defenders organized a peaceful demonstration in
Ne’lin village, west of Ramallah, in protest to the construction of the
Annexation Wall. They clashed with IOF
troops positioned near the Wall. IOF
troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at
demonstrators. Dozens of demonstrators
suffered from tear gas inhalation, and others sustained bruises. 

 

· Following
the Friday Prayer on 28 May 2010 as well, dozens of Palestinian civilians and
international and Israeli human rights defenders organized a peaceful
demonstration in Nabil Saleh village, northwest of Ramallah, in protest to land
confiscation in Wad al-Raya area between Nabi Saleh and Deir Nizam
villages. When the demonstrators
attempted to reach areas of land seized by Israeli settlers near
“Halmish” settlement, Israeli troop fired rubber-coated metal bullets,
sound bombs and tear gas canisters at them. As a result, two Palestinian civilians, including a child, were injured:

 

1. Ayyam ‘Ali al-Barghouthi, 16, hit by a
tear gas canister to the head; and

2. Jihad Mohammed al-Tamimi, 23, hit by a
tear gas canister to the back.

 

A number of demonstrators also suffered
from tear gas inhalation and others sustained bruises.

 

· At
approximately 13:00 on Saturday, 29 May 2010, dozens of Palestinian civilians
gathered in the center of Iraq Bourin village, south of Nablus, and organized a
peaceful demonstration towards areas of Palestinian agricultural land in the
east of the village, which IOF threaten to confiscate near “Barkha”
settlement. Israeli troops intercepted
them and fired rubber-coated metal bullets and tear gas canisters at them. As a
result, Ayman Ameen al-Noubani, 24, a photographer and reporter of Palestine
News Agency (Wafa), who was covering the demonstration, was hit by a tear gas
canister to the left leg, and ‘Imad Qadous, 19, was hit by a tear gas canister
to the foot. 

 

· At
approximately 15:00 on Monday, 31 May 2010, dozens of Palestinian civilians and
international human rights defenders organized a peaceful demonstration near
Qalandya crossing, north of Jerusalem, in protest to the Israeli attack on the
Gaza-aid flotilla. They raised the
Palestinian and Turkish flags and threw stones at Israeli troops stationed at
the crossing. Immediately, Israeli
troops fired rubber-coated metal bullets, tear gas canisters and sound bombs at
the demonstrators. As a result, Emily Henochowicz,
25, an American journalist, was hit by a tear gas canister to the left
eye. Dozens of demonstrators also
suffered from tear gas inhalation.

 

3. Continued Siege on the OPT

 

IOF have continued to impose a tightened siege on the
OPT and imposed severe restrictions on the movement of Palestinian civilians in
the Gaza Strip and the West Bank, including Occupied East Jerusalem.

Al-Mentar
(Karni) Crossing:
Israel partially
opened the crossing on Wednesday, 26 May 2010, and allowed the entry of 897
tons of wheat and 1,716 tons of fodders. They also allowed the entry of 552 tons of construction aggregate for
UNRWA and 4 tons for al-Quds Hospital. 

 

Beit
Hanoun (Erez) Crossing:
Israel has
continued to close Beit Hanoun (Erez) crossing for the movement of Palestinian
civilians. They have allowed only diplomats, a number of international
journalists, employees of select international agencies, and a few patients who
suffer from serious diseases to pass through the crossing. They have continued
to prevent Palestinian civilians from visiting their relatives who are detained
in Israeli jails. As mentioned above,
IOF have permitted a limited number of patients to pass through the crossing,
but under severe restrictions that include prolonged checking.

West Bank

 

IOF have
imposed a tightened siege on the West Bank. During the reporting period, IOF
imposed additional restrictions on the movement of Palestinian civilians.

 

· Jerusalem: IOF have continued to impose severe restrictions on
the movement of Palestinian civilians to and from the city of Jerusalem.
Thousands of Palestinian civilians from the West Bank and the Gaza Strip have
been denied access to the city. IOF have established many checkpoints around
and inside the city. Restrictions of the movement of Palestinian civilians
often escalate on Fridays to prevent them from praying at the al-Aqsa Mosque.  On Friday morning, 28 May 2010, IOF closed the
main road leading to Beit Eksa village, northwest of Jerusalem, with two iron
gates, and prevented villagers from traveling to Jerusalem.  The gates would cut villages located to the
northwest of Jerusalem off the city. They would also isolate 1,800 Palestinians living in Beit Eksa
village.      

 

· Ramallah: IOF have
continued to impose severe restrictions on the movement of the Palestinian
civilians in Ramallah. IOF troops
positioned at Jaba’-Qalandya checkpoint, southeast of Ramallah, have imposed
additional restrictions on movement and conducted prolonged checking on
Palestinian civilians. During the
reporting period, IOF erected a number of temporary checkpoints and stopped and
searched Palestinian civilian vehicles.          

 

· Nablus: IOF have
continued to impose severe restrictions on the movement of Palestinian
civilians. On Sunday morning, 30 May
2010, Israeli troops stationed at Za’tara checkpoint, south of Nablus, imposed
additional restrictions on the movement of Palestinian civilians. At 12:00 on Tuesday, 01 June 2010, Israeli
troops re-established their presence at the 17 checkpoint at the northwestern
entrance of Nablus. They stopped and
searched Palestinian civilian vehicles.  

 

· Hebron: IOF have
continued to impose severe restrictions on the movement of Palestinian
civilians. On Sunday morning, 30 May
2010, Israeli troops stationed at the entrances of al-Shuhada Street and Tal
al-Rumaida neighborhood in the center of Hebron prevented a delegation of
international peace and human rights activists and members of the Israeli Break
the Silence from visiting the neighborhood to observe the suffering of
Palestinian civilians there due to Israeli measures and attacks by Israeli
settlers.  On Monday evening, 31 May
2010, IOF established 2 checkpoints at Deir Samen and al-Ramadin intersections,
southwest of Hebron. They stopped and
searched Palestinian civilian vehicles.  On
Wednesday morning, 02 June 2010, IOF established additional of checkpoints around
Hebron. They stopped and searched
Palestinian civilian vehicles.    

 

Arrests
at Military Checkpoints

 

· On
Thursday evening, 27 May 2010, Israeli troops stationed at the Container
checkpoint, southeast of Jerusalem, arrested Mohammed Mahmoud Nemer, 21, from
al-Arroub refugee camp north of Hebron.

 

· At
approximately 16:00 on Friday, 28 May 2010, Israeli troops patrolling near the
Annexation Wall to the southeast of Faqqou’a village, northeast of Jenin,
arrested Mohammed Hassan Jaloudi, 16, and Mohammed Hussein Abu Hanani, 16, when
they were walking near the wall.

 

· At
approximately 16:30 on Saturday, 29 May 2010, Israeli troops established a
checkpoint near Silwad village, north of Ramallah. They stopped and searched Palestinian
civilian vehicles and arrested Muhannad Fares Hamed, 21.

 

· At
approximately 18:00 also on Saturday, Israeli troops established a checkpoint
near ‘Attara village, north of Ramallah. They stopped and searched Palestinian civilian vehicles and arrested
Sami Ahmed Sahwil, 19.  

 

4. Settlement Activities and Attacks by Settlers against Palestinian
Civilians and Property

 

IOF have continued
settlement activities in the OPT in violation of international humanitarian
law, and Israeli settlers have continued to attack Palestinian civilians and
property.

 

· On
Friday, 28 May 2010, a number of Israeli settlers from “Beit
Jonathan” settlement outpost in Silwan village, to the south of the old city
of Jerusalem, harassed a group of Palestinian woman. Immediately, clashes erupted between
Palestinian civilians and Israeli settlers. IOF intervened and attacked ‘Essam Da’na, 48, and Riaham Ussama
al-Rjabi, 20, who is pregnant and miscarried as a result. A number of women present also suffered from
tear gas inhalation.

 

· At
approximately 22:00 on Friday, 28 May 2010, one Israeli settler among a group
of others at the intersection of “Karni Shmoron” settlement near
Qalqilya-Nablus road, east of Qalqilya, threw a large stone from a close
distance at a Palestinian civilian vehicle that was traveling to Qalqilya. The stone broke the back window of the
vehicle and 4 civilians were injured:

 

1. Mohammed Mahmoud ‘Emayer, 58;

2. ‘Izzat Mohammed ‘Emayer, 54;

3. Amina Rashed ‘Emayer, 57; and

4. Siddiqa Rashed ‘Emayer, 53.

 

· On
Saturday, 29 May 2010, a
number of guards of “Beit Jonathan” settlement outpost in Silwan
village, to the south of the old town of Jerusalem, attacked a group of
Palestinian children who were playing. Palestinian civilians gathered to protect their children. Immediately, IOF arrived at the area and
violently beat Noura al-Rajabi and Mohammed and Ahmed Gazzawi.

Recommendations
to the International Community

 

1. PCHR
calls upon the High Contracting Parties to the Fourth Geneva Convention to
fulfill their legal and moral obligations under Article 1 of the Convention to
ensure Israel’s respect for the Convention in the Occupied Palestinian
Territory. PCHR believes that the
conspiracy of silence practiced by the international community has encouraged
Israel to act as if it is above the law and encourages Israel continue to
violate international human rights and humanitarian law.

 

2. PCHR
calls upon the High Contracting Parties to the Fourth Geneva Convention to
convene a conference to take effective steps to ensure Israel’s respect of the
Convention in the OPT and to provide immediate protection for Palestinian
civilians.

 

3. PCHR
calls upon the High Contracting Parties to the Fourth Geneva Convention to
comply with its legal obligations detailed in Article 146 of the Convention to
search for and prosecute those responsible for grave breaches, namely war
crimes.

 

4. PCHR
calls for the immediate implementation of the Advisory Opinion issued by the
International Court of Justice, which considers the construction of the
Annexation Wall inside the West Bank illegal.

 

5. PCHR
recommends international civil society organizations, including human rights
organizations, bar associations and NGOs to participate in the process of
exposing those accused of grave breaches of international law and to urge their
governments to bring these people to justice.

 

6. PCHR
calls upon the European Union to activate Article 2 of the Euro-Israel
Association Agreement, which provides that Israel must respect human rights as
a precondition for economic cooperation between the EU states and Israel. PCHR further calls upon the EU states to
prohibit import of goods produced in illegal Israeli settlements in the OPT.

 

7. PCHR
calls on the international community to recognize the Gaza disengagement plan,
which was implemented in September 2005, for what it is—not an end to
occupation but a compounding of the occupation and the humanitarian crisis in
the Gaza Strip. 

 

8. In
recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls
upon the ICRC to increase its staff and activities in the OPT, including the
facilitation of family visitations to Palestinian prisoners in Israeli jails.

 

9. PCHR
appreciates the efforts of international civil society, including human rights
organizations, bar associations, unions and NGOs, and urges them to continue
their role in pressuring their governments to secure Israel’s respect for human
rights in the OPT and to end its attacks on Palestinian civilians.

 

10. PCHR calls upon the international
community to pressure Israel to lift the severe restrictions imposed by the Israeli
government and its occupation forces on access for international organizations
to the OPT.

 

11. PCHR reiterates that any political
settlement not based on international human rights law and humanitarian law
cannot lead to a peaceful and just solution of the Palestinian question. Rather, such an arrangement can only lead to
further suffering and instability in the region. Any peace agreement or process must be based
on respect for international law, including international human rights and
humanitarian law.
