Summary
Israeli
violations of international law and international humanitarian law in the oPt
continued during the reporting period (22 – 28 November 2012):
Shooting:
During the reporting period, Israeli
Forces killed a Palestinian civilian in the Gaza Strip, while 5 others,
including 2 civilians; one of whom is a woman, died of wounds they had sustained
in the latest Israeli offensive on the Gaza Strip. Moreover, Civil Defense crews found the corpses
of 2 civilians, including a child, in the rubbles of their house that was
destroyed by Israeli forces. The Israeli
Forces also wounded 42 Palestinian civilians, including 7 children. In the West Bank, 2 Palestinians civilians
were wounded in peaceful protests against the annexation wall and settlement
activities.
In the Gaza Strip, on 23 November
2012, the Israeli Forces killed a Palestinian civilian and wounded 18 others,
including 3 children. The abovementioned
civilian was killed when the Israeli soldiers at the border fence to the east
of Khan Yunis opened fire at dozens of Palestinians who raised flags and
attempted to cross the border fence. It
is worth noting that the Palestinians headed to the border area in light of the
case-fire agreement that was put into effect at approximately 21:00 on
Wednesday, 21 November 2012 and was reached by Israel and the Palestinian
resistance groups under the auspices of Egypt.
During the reporting period, 5
Palestinians died of wounds they had sustained in the latest Israeli offensive
on the Gaza Strip. On 23 November 2012, medical sources at Shifa Hospital in
Gaza City pronounced 2 Palestinians dead:
1- Ahmed Isma’il Abu Msameh, 30, a
member of an armed group, who was wounded in an Israeli airstrike launched on
Deir al-Balah in the central Gaza Strip on 16 November 2012; and
2- Jouda Suleiman Shamallakh, 27, a
member of an armed group, who was wounded in an Israeli airstrike launched on
Gaza City on 18 November 2012.
On 26 November 2012, medical sources
declared that Ahmed Ali al-Mashharawi, 18, died of wounds he had sustained during
the latest Israeli offensive on Gaza. Al-Mashharawi, who is a civilian, was
wounded on 14 November 2012, when an Israeli warplane launched a missile on a
house belonging to Ali Nemer Abdul Rahman al-Mashharawi, 54, in al-Zaytoun
neighborhood in the east of Gaza City. As a result, the house was completely
destroyed, Omar al-Mashharawi, 11 months, and Heba al-Mashharawi (al-Turk), 19,
were killed, and 2 other children, including Ahmed, were wounded.
On the same day, medical sources declared
that Sabah Mohammed Harb al-Skafi, 41, from al-Shuja’iya neighborhood in Gaza
City, died of wounds she had sustained when Israeli warplane bombarded a house
belonging to the al-Haddad family in al-Sha’af area. Al-Skafi was passing by
the house when the attack happened, so she sustained serious injury. She was transferred to an Egyptian hospital for
medical treatment, but she passed away.
On 28 November 2012, medical sources
in an Egyptian Hospital declared that Mahmoud Sami Sha’th, 21, from Rafah in
the southern Gaza Strip, died of wounds he had sustained on 18 November 2012. Sha’th, a member of an armed group, was
wounded when an Israeli warplane targeted him in a car with another member of the
group and the taxi driver, who were both killed.
On 22 November 2012, the Civil
Defense in Gaza City found the corpse of Mohammed al-Dalu, 29, and his sister
Yara, 17, in the rubbles of their family’s house that was destroyed by Israeli
warplanes. It should be noted that the said house was bombarded by the Israeli
warplanes on 18 November 2012. As a
result, 8 members of the family were killed, including 4 children and 4 women.
All of them, including a mother and her 4 children, were found in the rubbles
of the house. As a result of the attack,
many surrounding houses were damaged and 2 members of al-Mzannar family were
killed. Thus, the number of the al-Dalu
family members who were killed in the attack increased to 10, including 5
children.
On 22 November 2012, 6 Palestinians
were wounded when the Israeli Forces at the border fence, east of al-Faraheen
area in the southern Gaza Strip opened fire at dozens of Palestinians who
headed to the fence. On the same day, another
2 Palestinians were wounded when the Israeli Forces opened fire at dozens of
Palestinians who headed to the border area in the east of al-Shouka village,
east of Rafah. Their wounds were
described as moderate.
On 25 November 2012, a Palestinian
child was wounded when the Israeli Forces at the border fence, east of Khan
Yunis , opened fire at a group of children who approached the fence in the east
of Abassan, east of Khan Yunis.
On 26 November 2012, the Israeli
Forces positioned at the border fence in the east of Khan Yunis fired at a
group of children, who approached the border fence in the east of Abassan
village. As a result, a child sustained minor injury. In addition, on the same
day, another 2 Palestinians were wounded when the Israeli Forces positioned at
the border fence in the east of Jabalya, in the northern Gaza Strip, opened
fire at a group of civilians and famers, who were present near the border fence
to challenge the Israeli decision to impose a buffer zone along the border
between the Gaza Strip and Israel.
On 27 November 2012, a Palestinian
civilian was wounded when the Israeli Forces stationed at the border fence in
the east of Abu Safiya gate, east of Jabalya, fired bullets and tear gas
canisters at a number of civilians and farmers near the border fence. On the
same day, another Palestinian civilian was wounded when the Israeli Forces
positioned at the border fence to the east of al-Shouka village, east of Rafah,
opened fire at dozens of Palestinians near the border area.
On 28 November 2012, a Palestinian
civilian was wounded when the Israeli Forces stationed at the border fence to
the east of al-Shouka village, east of Rafah, opened fire at dozens of
Palestinians in the area. On the same day, another Palestinian civilian was
wounded when the Israeli Forces at the border fence in the east of Beit Hanoun
opened fire at a group of Palestinian civilians and farmers near the area. Also
on the same day, 8 civilians, including 3 children, were wounded when the
Israeli Forces fired at dozens of Palestinians who headed to the border fence
in the east of al-Bureij and al-Maghazi refugee camps in the central Gaza
Strip.
In the context of other shooting incidents,
the Israeli Forces stationed along the border fence in the east of Beit Hanoun
and Jabalya in the northern Gaza Strip, opened fire at Palestinian civilians
and farmers, who headed to the border area to challenge the Israeli decision to
impose a 300-meter buffer zone along the borders. It should be noted that
hundreds of Palestinian farmers were denied access to their lands in the
mentioned area. These farmers decided to go to the border area in light of the
announcement of the cease-fire agreement between Israeli and the Palestinian
resistance groups.
In the context of targeting
fishermen in the Gaza Strip, on 28 November 2012, the Israeli gunboats
stationed off al-Waha resort in the northern Gaza Strip opened fire at the
Palestinian fishing boats for about 10 minutes. As a result, fishermen were
terrified and fled for fear of being arrested or wounded. Neither casualties
nor damage were reported.
In the West Bank, the Israeli Forces
continued to use excessive force against peaceful protests organized by
Palestinian civilians and Israeli and international human rights defenders. As
a result, 2 Palestinians were wounded.
In addition, dozens of Palestinians suffered from tear gas inhalation
and sustained bruises. The Israeli Forces arrested Shamekh Jaghoub, 30, a
cameraman of Palestine TV. They
confiscated the memory card of the camera and beat him before releasing him
later.
Incursions:
During
the reporting period, the IOF conducted at least 81 military incursions into
Palestinian communities in the West Bank.
During these incursions, the IOF arrested at least 99 Palestinians,
including 9 children.
This
week witnessed a marked escalation in incursions, as the Israeli Forces arrested
6 PLC members from the Change and Reform Bloc affiliated to Hamas movement, in
addition to arresting a number of political leaders of Hamas and the Islamic
Jihad movements.
In
the Gaza Strip, on 26 November 2012, the Israeli Forces positioned at the
border fence north of Um al-Nasser village (the Bedouin village) in the
northern Gaza Strip arrested 3 Palestinian civilians from Ezbet Beit Hanoun in
the northern Gaza Strip. The 3 Palestinians approached the border fence and
attempted to cut parts of it. Their
relatives said that the International Committee of the Red Cross (ICRC)
confirmed to them that their sons were arrested by the Israeli Forces, but
their place had not been identified.
Restrictions
on Movement:
Israel
continued to impose a tightened closure of the oPt, imposing severe
restrictions on the movement of Palestinian civilians in the Gaza Strip and the
West Bank, including occupied East Jerusalem.
The illegal Israeli-imposed closure
of the Gaza Strip, which has steadily tightened since June 2007, has had a
disastrous impact on the humanitarian and economic situation in the Gaza Strip. The illegal closure has caused not only a
humanitarian crisis, but a crisis of human rights and human dignity for the
population of the Gaza Strip.
Recently-declared measures to ease the closure are vague, purely
cosmetic and fail to deal with the root causes of the crisis; the root causes
can only be addressed by an immediate and complete lifting of the closure,
including lifting the travel ban into and out of the Gaza Strip and the ban on
exports. Palestinians in Gaza may no
longer suffer from the same shortage of goods but, as long as the closure is
allowed to continue, they will remain economically dependent, unable to care
for themselves, and socially, culturally and academically isolated from the
rest of the world.
The IOF have continued to impose
severe restrictions on the movement of Palestinian civilians throughout the
West Bank, including occupied East Jerusalem.
Thousands of Palestinian civilians from the West Bank and the Gaza Strip
continue to be denied access to Jerusalem.
Settlement
Activities:
Israel
has continued its settlement activities in the oPt, in violation of
international humanitarian law, and Israeli settlers have continued to attack
Palestinian civilians and property.
On
28 November 2012, the Israeli Forces supported by 2 military bulldozers moved
into Abu ‘Asida area in the west of Beit Oula village, west of Hebron. The
Israeli soldiers denied the Palestinian civilians access to the area. Besides,
the Israeli bulldozers started demolishing agricultural lands belonging to
Suleiman Rabee’, 40. They also cut off about 1,000 olive seedlings belonging to
the family of al-Atrash. The Israeli bulldozers then leveled a 20-dunum area of
reclaimed land belonging to Mohammed Abdul Fattah Jaber al-Saraheen, 50, from
the same village.
On
the same day, the Israeli Forces accompanied by military vehicles and a
bulldozer moved into Kherbet Um Neer in Sousia area, south of Hebron. The bulldozer started demolishing a tent
resided by Isa Mohammed Ahmed al-Jbour, 41, and his family, under the pretext
that the area is a military training area.
On 24
November 2012, a number of Israeli settlers from “Adora” settlement,
west of Hebron, threw stones at Palestinian civilian vehicles while driving on
bypass road #(35) linking the western villages with Hebron. No casualties were reported though.
On
the same day, dozens of settlers from “Carmiel” settlement, south of
Hebron, cut off more than 300 olive trees that were planted less than 3 years
ago. These trees belong to the Awawda family.
Israeli
Violations Documented during the Reporting Period (22 – 28 November 2012)
Incursions
Thursday,
22 November 2012
At
approximately 23:00 on Wednesday, 21 November 2012, the Israeli Forces moved
into Beit Leqia village, southwest of Ramallah. They raided many houses amidst
firing rubber-coated metal bullets, tear gas canisters and sound bombs,
searched them and damaged their contents. The Israeli Forces used big hammers to break
the front metal doors. During which,
they attacked some Palestinian civilians. Before their withdrawal at approximately 01:40
on Thursday, 22 November 2012, the Israeli Forces arrested 5 Palestinians,
including a father and his 2 sons who were harshly beaten by clubs and gun butts
and then transported to Tel HaShomer Hospital in Israel as they lost
consciousness due to a hemorrhage in the head. On Saturday, 24 November 2012, they were
transferred to Ofer detention center, southwest of Ramallah. The arrested
persons are:
1- Rabah Shokri
Mostafa Assi, 52, was released 2 hours after his arrest;
2- His 2 sons
Jihad, 29, and Fo’ad, 26;
3- Isam Ali
Assi, 27; and
4- Ahmed Falah
Mosa, 25.
The last 2
persons were transported to al-Masqoubiya detention center in Jerusalem.
At
approximately 01:00, the Israeli Forces moved into Nablus and Balata refugee
camp east of the city. They raided and searched several houses and arrested 4
Palestinians:
1- Dr. Mostafa Ali Ahmed Ali Ahmed al-Shennar, 50, was arrested
from his house in al-Ma’ajeen neighborhood, northwest of Nablus. He is a
lecturer in the Faculty of Arts in al-Najah National University;
2- Sheikh Wa’el Abdul Karim Hashash, 43;
3- Imad Abdul Rahman
al-Jorf, 46; and
4- Ahmed Ghazi Abu Thera’, 22.
At
approximately 01:30, the Israeli Forces moved into Awarta village, southeast of
Nablus. They raided and searched a number of houses and arrested 2 Palestinian
civilians:
1. Shadi
Riyadh Awwad, 24; and
2. Aysser
Sa’d Awwad, 22.
At the same
time, the Israeli Forces moved into Jama’in village, southwest of Nablus. They raided and searched a number of houses
and arrested 5 Palestinian civilians, including 2 children: Mostafa Ziyad
Hindya, 16, Bassam Soheil Awad, 18, Hamza Mahfouz Salim Awad, 16, Majd Mohammed
Ali Hajj Ali, 18, and Mohammed Abdullah Yusef Ghazi, 18.
At the same
time, the Israeli Forces, moved into Beit Awwa village, west of Doura in the
southwest of Hebron. They raided and searched a number of houses and arrested
Imad Mohammed ‘Ayed al-Sweiti, 18, and Mohammed Ahmed Abdul Fattah al-Sweiti,
18.
At the same time,
the Israeli Forces moved into a number of neighborhoods in the center of Hebron. They raided and searched a number of houses
and arrested 9 Palestinians, including a child:

At the same
time, the Israeli Forces moved into al-Dahiriya village, south of Hebron. They
raided and searched a number of houses and arrested ‘Ahed Mohammed Jaber Abu
Sharekh, 20, and Mohammed Bassam Khalil Abu Sharekh, 20, and transported them
to an unknown destination.
At the same
time, the Israeli Forces moved into al-Tabaqa village, southwest of Hebron. They
raided and searched a number of houses and arrested Adel Salama al-Hreibat, 35,
and transported them to an unknown destination.
At approximately
02:00, the Israeli Forces moved into Kofur Malek, northeast of Ramallah. They
raided and searched a number of houses and arrested Yafi’ Moneer Hamayel, 17,
and transported him to an unknown destination. In addition, they submitted notices to 2 other
Palestinians, including a child, to refer to the Israeli Intelligence Service
“Shabak” at Ofer detention center, southwest of Ramallah. The notices were sent to Abdul Hamid Ra’ed B’eirat,
17, and Mohammed Sharif Ghneimat, 18.
At the same
time, the Israeli Forces moved into Qebya village, west of Ramallah. They
raided and searched a house belonging to Abdul Hafez Ghaythan, 47, and arrested
him.
At
approximately 02:30, the Israeli Forces moved into ‘Arraba village, southwest
of Jenin. They patrolled in the streets for a while and stationed near an UNRWA
school in the eastern neighborhood in the village. The Israeli Forces raided and searched a
house belonging to the family of Mohammed Abdul Latif Mohammed Shibani, 39, who
is affiliated to the Islamic Jihad, and arrested him. They also raided a house belonging to the
family of Tareq Hussein Awad Dar Hussein Qa’dan, 44, a leader in the Islamic
Jihad movement, and arrested him. The aforementioned person is an ex-prisoner who
had served more than 10 years sporadically in the Israeli prisons. The last
time he was released was on 08 July 2012 after he served 15 months in the
Israeli prisons. It should be noted that the Israeli Forces raided the family’s
house on 13 November 2012 and arrested his sister Mona, 40, who was released
from the Israeli prisons in Shalit’s swap deal.
The Israeli
Forces then re-established their presence in the western neighborhood of the
village, raided a house belonging to Ja’fer Ibrahim Mohammed Ezz Eddin, 40, a
leader in the Islamic Jihad movement, and arrested him. It should be noted that he served many years
in the Israeli prisons. The last time he was arrested from his house was on 21
March 2012, when he was placed under administrative detention for 4 months. He
also participated in the hunger strike that started in the Israeli prisons on
17 April 2012.
At the same
time, the Israeli Forces moved into Qabatya village, southeast of Jenin. They
raided a house belonging to Thamer Abdul Ghani Fayeq Saba’neh, 35, a writer and
researcher in the prisoners’ affairs, and arrested him. They then raided and
searched another house belonging to ‘Awni Adnan Mohammed Kmeil, 27, and
arrested him. A third house was raided by the Israeli Forces. The house belongs
to Faysal Mahmoud Khalil Saba’neh, 55, who was arrested as well.
At
approximately 10:20, the Israeli Forces moved into ‘Anin village, northwest of
Jenin. They raided and searched a house belonging to Yusef Sha’ban Yassin, 26,
and arrested him.
At
approximately 15:30, dozens of Palestinian civilians headed to the border fence
in the east of al-Faraheen area in Abassan, east of Khan Yunis. They raised
flags there and threw stones on the Israeli soldiers at the fence. Some persons
attempted to cross the fence, but the Israeli Forces fired at them live bullets
and rubber-coated metal bullets. As a result, 9 Palestinians were wounded and
then transported to European Gaza Hospital in Khan Yunis for medication. Their
wounds ranged between minor and moderate, as they were wounded in the lower

At the same
time, dozens of Palestinian civilians headed to the border area in the east of
al-Shouka village in the east of Rafah. They chanted slogans supporting the
Palestinian resistance. The Israeli Forces opened fire. As a result, 2
Palestinian civilians were wounded and then transported to Abu Yusef al-Najjar
Hospital in Rafah. Their wounds were described as moderate.
In the evening,
the Civil Defense staff in Gaza City found the bodies of Mohammed Jamal Mahmoud
al-Dalu, 29 and his sister Yara, 17, in the rubbles of their house that was
shelled over their heads. It is worth noting that the said house was bombarded
by the Israeli warplanes on 18 November 2012, due to which 8 members of the
family, including 4 children and 4 women, were killed. The bodies of the 8
members, including a mother and her 4 children, were pulled from the rubbles of
the house. As a result of the attack,
many surrounding houses were damaged and 2 members of al-Mzannar family were
killed. The Civil Defense could pull the bodies of Mohammed and Yara on the abovementioned
house. As a result, the number of al-Dalu
members, who were killed in the attack, increased to 10, including 5 children.
At
approximately 17:00, the Israeli Forces moved into Zabbouba village, northwest
of Jenin. They patrolled in the streets for a while, due to which some boys
gathered and threw stones and empty bottles on the Israeli vehicles. The
Israeli soldiers fired at the boys sound bombs and tear gas canisters, due to
which, some persons suffered from tear gas inhalation. The Israeli Forces
withdrew later. No arrested were reported.
At
approximately 18:30, the Israeli Forces moved into Far’oun village, south of
Tulkarm. They patrolled the streets for a while and withdrew later. Neither
house raids nor arrests were reported.
Friday, 23
November 2012
At
approximately 01:00, the Israeli Forces moved into Balata refugee camp, east of
Nablus. They raided and searched a number of houses and arrested 2 Palestinian
civilians:
1. Baha’
Mahmoud Marshoud, 25;
2. Mo’athe
Wa’el al-Ka’bi, 22.
At the same
time, the Israeli Forces moved into Beit Ummar village, north of Hebron. They
raided and searched a house belonging to the family of Ibrahim Fathi Mahmoud
Awad, 22, and arrested him.
At the same
time, the Israeli Forces moved into Sa’eer village, northeast of Hebron. They
raided and searched a house belonging to the family Belal Mostafa al-Jabareen,
25, and arrested him.
At the same
time, the Israeli Forces moved into Qalqilya. They raided and searched a house
belonging to Imad Mahmoud Rajeh Nofal, 42, PLC Member from the Change and Reform
Bloc affiliated to Hamas, and arrested him. In her testimony to PCHR’s
fieldworker, Nofal’s wife, Rawda Khaled Mostafa Nofal, said:
“At approximately
01:00 on Friday, 23 November 2012, while we were sleeping, we heard strong
knocks on the door. We live on the third floor of a 3-storey building. We opened
the door and found the Israeli soldiers yelling loudly. They forced us to
evacuate the building. Before we did so, they said that they wanted Imad Nofal.
Nofal was told that he had 2 minutes to say goodbye to his family. He said
goodbye and then was arrested and transported to an unknown destination.”
At the same
time, the Israeli Forces moved into Silet al-Harithiya village, northwest of
Jenin. They patrolled the streets and then stationed in al-Tahayna. They raided
and searched a house belonging to the family of Inad Mohammed Abu al-Kheir
Tahayna, 24, and arrested him.
At
approximately 01:30, the Israeli Forces moved into al-Samou’ village, south of
Hebron. They raided and searched many houses and arrested 3 Palestinians,
including a PLC Member from the Change and Reform Bloc:
1. Basem
Ahmed al-Za’areer, 55, a PLC Member;
2. Jamal
Mosa Abu al-Jadayel, 49; and
3. Nidal
Areef al-Za’reer, 47, the former head of al-Samou’ municipality.
At
approximately 02:00, the Israeli Forces moved into Harmala village, south of
Bethlehem. They raided and searched a house belonging to the family of Mostafa
Isa Mosa al-Arouj, 50, and arrested him.
At
approximately 02:15, the Israeli Forces moved into al-Bireh and stationed at
al-Shorafa neighborhood. At approximately 03:30, they raided a 2-storey
building belonging to Dr. Mahmoud Ahmed Abdul Rahman al-Ramahi, 49, the PLC
Secretary. They Israeli soldiers asked for the ID’s of the residents to check
them. Before they withdrew, the Israeli Forces arrested Dr. al-Ramahi and
transported him to Ofer detention center, southwest of Ramallah. It is worth
saying that al-Ramahi is a PLC Member form the Change and Reform Bloc that is
affiliated to Hamas.
At
approximately 03:00, the Israeli Forces moved into Azzoun village, east of
Qalqilya. They raided 2 houses belonging to: Saif Hesham Edwan, 25, and Aref
Samir Shbeita, 29. The Israeli Forces arrested the 2 above-mentioned persons
and transported them to an unknown destination. Shbeita’s family stated that
the Israeli Forces broke the main door with s special tool and damaged the
contents of the house. Besides, they
arrested their son who suffers from a peptic ulcer and a problem in the left
eye as he was previously arrested and tortured by the Israeli Forces.
At the same

raided and searched a house belonging to Riyadh Mahmoud Sa’id Raddad, 53, a PLC
Member from the Change and Reform Bloc affiliated to Hamas, and arrested him.

time, the Israeli Forces moved into Nour Shams refugee camp, east of Tulkarm.
They raided and searched a house belonging to Fathi Mohammed Ali Qar’awi, 54, a
PLC Member from the Change and Reform Bloc affiliated to Hamas, and arrested him.

time, the Israeli Forces moved into Ne’lin village, west of Ramallah. They
raided and searched a house belonging to the family of Abdul Qaher Srour, 40,
and arrested him. It should be noted
that Srour was Director of the office of the PLC Speaker, Dr. Aziz Dweik. Both are affiliated to Hamas.
At
approximately 04:00, the Israeli Forces moved into al-Dheisha refugee camp,
southeast of Bethlehem. They raided and searched some houses and arrested 3
Palestinians, including a child:

time, the Israeli Forces moved into Hendaza neighborhood in the east of
Bethlehem. They raided and searched a number of houses and arrested 3
Palestinians, including 2 children:

In addition,
the Israeli Forces arrested Hamza Saleh Shouka, 16, from Bethlehem.

They raided and searched a house belonging to the family of Tha’er Isa
Baradiya, 28, and arrested him.
At the same
time, the Israeli Forces moved into Wadi Fouqin, west of Bethlehem. They raided
and searched a house belonging to the family of Wesam Fadel Hamdan, 36, and
arrested him.
At the same
time, the Israeli Forces moved into Beit Fajjar village, south of Bethlehem.
They raided and searched a house belonging to the family of Anwar Kamel
Taqatqa, 24, and arrested him.
In the early
morning, medical sources at Shifa Hospital in Gaza City declared Jouda Suleiman
Shamallakh, 27, died of wounds he had sustained during the latest Israeli
offensive on Gaza. Shamallakh, a member of the armed groups, sustained serious
wounds due to an Israeli airstrike on Gaza City on 18 November 2012.
At
approximately 07:30, dozens of Palestinian civilians headed to the border fence
in the east of al-Qarara village, east of Khan Yunis. They raised flags there
and threw stones at the Israeli soldiers at the border fence. Some boys
attempted to cross the fence. The same incident took place in the east of
Abassan and Khuza’a, east of Khan Yunis, as they crossed the border fence and
returned. The Israeli soldiers fired at them live and rubber-coated metal
bullets. As a result, Anwar Abdul Hadi
Msallam Qdeih, 20, was wounded in the head and died directly. Moreover, 18 others were wounded, including 3
children. Their wounds ranged between minor and moderate. It should be noted
that the Palestinian civilians headed to the border area in light of cease-fire
agreement that stated “not to restrict the movement of civilians or target
the border area.” The cease-fire
was put into effect at 21:00 on Wednesday, 21 November 2012 according to the
agreement reached between Israel and Palestinian resistance groups under the
auspices of Egypt.

southwest of Ramallah. They patrolled

approximately 10:20, medical sources pronounced Ahmed Isma’il Abu Msameh, 30,
from al-Maghazi refugee camp, dead. Abu Msameh, a member in the armed groups,
died of wounds he sustained by an Israeli airstrike on Deir al-Balah in the
central Gaza Strip on 16 November 2012.
At
approximately 14:30, the Israeli Forces moved into Beit Ummar village, north of
Hebron. They raided and searched a house
belonging to the family of Mahmoud Abdul Hamid Mahmoud al-Alami, 20, and
arrested him.

At approximately 01:00, Israeli forces moved into Nablus and raided
and searched several houses. Before
their later withdrawal, Israeli forces arrested Yaser Dawoud Mansour, (46), a PLC
Member from the Change and Reform Bloc, from his house in Rafidya neighborhood
in the west of the city.
At
approximately 08:00, Israeli forces moved into Methloun village, southeast of
Jenin. They patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At
approximately 08:30, Israeli forces moved into al-Zababda, southeast of
Jenin. They patrolled the streets and
headed to the Arab American University.
During its patrol, a number of students gathered and threw stones at the
military vehicles. The soldiers inside
the vehicles fired sound bombs and tear gas in response at them. Israeli forces withdrew later and neither
house raids nor arrests were reported.
At
approximately 09:30, Israeli forces moved into Deir Jarir village, northeast of
Ramallah. They patrolled the streets
for some time and withdrew later. No
arrests were reported.
At
approximately 15:20, Israeli forces positioned at the border fence east of
al-Na’aayma Street, and al-Masryeen Street and Zimo Street in the east and
south of Beit Hanoun in the north of the Gaza Strip, sporadically opened fire
accompanied with firing tear gas at the Palestinian farmers, who were in their
farmlands adjacent to the borderline.
The farmers were forced to flee from the area and no injuries were
reported. It should be noted that a
number of Palestinian farmers, who had been denied access to their farmlands in
the aforementioned area since Israeli forces decided to enforce a buffer zone
along the borderline adjacent to the Gaza Strip, headed to their farmlands
after announcing a ceasefire between Israel and the Palestinian armed groups.
At the same
time, Israeli forces positioned at the border fence, east of Abu Safeya Gate,
east of Jabalya in the northern Gaza Strip, opened fire at Palestinian farmers,
who were in their farmlands adjacent to the borderline. It should be noted that
a number of Palestinian farmers, who had been denied access to their farmlands
in the aforementioned area since Israeli forces decided to enforce a buffer
zone along the borderline adjacent to the Gaza Strip. The shooting continued

approximately 04:00, Medical sources in al-Shifa Hospital in Gaza declared that
Ahmed Ali al-Mashharawi, 17, died of wounds he had sustained in earlier. According
to investigations conducted by PCHR at that time, at approximately 16:55 on
Wednesday, 14 November 2012, Israeli warplanes fired a missile at a house
belonging to Ali Nemer Abdel Rahman al-Mashharawi, 54, near Bilal Ben Rabah Mosque
in al-Zaytoun neighborhood in the east of Gaza. The house was completely destroyed and 2
children were killed: Amr Jihad Ali al-Mashharawi, 11 months, and Hiba Adel
Fadel al-Mashharawi (al-Turk), 19. 2
children were injured in the incident, including Ahmed.
On the same day,
medical sources declared that Sabah Mohammed Harb al-Skafi, 41 from
al-Shuja’iya neighborhood in Gaza City, died wounds she had sustained when
Israeli warplanes bombarded a house belonging to the al-Haddad family in
al-Sha’af neighborhood, as she was passing by. As a result, she sustained serious
wounds and was then transported to an Egyptian hospital, but she passed away
there.
At the same
time, Israeli forces moved into Azoun village, east of Qalqilya. They raided and searched several houses and handed
notices to 2 brothers to appear before the Israeli Intelligence service. They
are: Hamed Salim Bedwan, 29, a member of Palestinian National Security, and his
brother Samer, 35. Israeli forces withdrew
later and no arrests were reported.
At approximately
09:30, the Israeli Forces moved into Zeita village, north of Tulkarm. They
patrolled in the streets for a while and withdrew later. Neither house raids nor arrests were reported.
At
approximately 15:30, Israeli forces stationed by the border fence, east of Beit
Hanoun village, in the northern side of the Gaza Strip, opened fire at
Palestinian farmers who were at their lands located near the border fence. The
shooting went on for approximately 10 minutes and the farmers had to flee. No injuries were reported.
At the same
time, Israeli force stationed by the border fence, east of Jablya in the northern
side of the Gaza Strip opened fire at the Palestinian farmers who were at their
lands, located near the border fence. The shooting went on for a few minutes,
and the farmers had to flee. No injuries

At
approximately 16:00, Israeli forces stationed on the border fence, east of Jablya
in the northern Gaza Strip opened fire at Palestinian civilians and farmers who
were near the fence in defiance of the Israeli decision to enforce a
“buffer zone” along the borders. As a result, two civilians sustained
wounds; one of them was described as critical. The first sustained a bullet
wound in the right thigh and shrapnel wounds in the right shoulder; he was
transported to Kamal Odwan hospital in Beit Lahia, his condition was described
as moderate. The other one sustained a
bullet to the left knee and was transported to al-‘Awda hospital in Tal
al-Za’tar, and then was transported to al-Shifa hospital in Gaza where he
underwent a surgery. He was later transported to an Egyptian hospital for
treatment.
At
approximately 16:15, Israeli forces positioned at the border fence, north of Om
al-Naser village “the Bedouin Village” in the northern Gaza Strip, arrested 3
Palestinian civilians, living in ‘Aezbet Beit Hanoun in the northern Gaza
Strip, as they approached the border fence and tried to cut parts of it. The arrested are: Soliman Ramadan ‘Awda
Shlalfa, 18; Ibrahim Sa’aid Soliman al-Hamdeen, 19; and Sohail Sa’adi Fares
al-Bes, 21. Families of the arrested persons
said that the International Committee of the Red Cross confirmed to them that
their sons are arrested by the occupation authorities, but without specifying
the place of detention.
At approximately
16:30, the Israeli forces moved into Zeita village, north of Tulkarm. They
patrolled in the streets and withdrew later. Neither house raids nor arrests
were reported.
At
approximately 17:30, the Israeli forces moved into Jenin. They patrolled in the

approximately 18:00, the Israeli forces moved into a mountainous area between
Allar and Kofur Ra’i villages, south of Jenin. Eyewitnesses said to PCHR’s
fieldworker that the Israeli soldiers stepped out of their vehicles and fired
in the air. It seemed like they were
training. They withdrew later with no further incidents.

Abdel Rahim ‘Alawi, 22, a student at al-Quds Open University; Raja Ahmed
Shehada, 22, and Wajdi Ahmed Raja Shehada, (21), brothers and students at
an-Najah National University; ‘Alaa’ Mohammed Roshdi al-Sha’aer, 21, a student
at an-Najah National University; Walid ‘Alaa’ al-Deen Mkheimar, 21; and Mahdi Mohammed
Ahmed Ghazal, 22, a student at Palestine Technical University – Khadouri- in
Tulkarm.
At
approximately 03:00, the Israeli forces moved into Yatta, south of Hebron. They
raided a house belonging to the family of Mahmoud Khalil al-‘Emour, 38, and
arrested him.
At
approximately 10:00, the Israeli forces positioned in watchtowers at Beit
Hanoun (Erez) crossing in the northern Gaza Strip opened fire at Palestinian
workers collecting scraps pf construction materials in the destroyed industrial
zone. The workers were forced to flee fearing for their lives. It is worth
noting that those workers collect scraps to sell them to traders in the Gaza
Strip in order to be re-used in construction, due to the closure imposed on the
Gaza Strip.
At approximately
15:40, Israeli forces positioned at the border fence, east of Abu Safia Gate,
east of Jabalia in the northern Gaza Strip, opened fire and fired tear gas at a
group of civilians and farmers who were near the fence in defiance of the
Israeli decision to enforce a “buffer zone” along the borders between
the Gaza Strip and Israel. As a result, an 18-year-old boy sustained a bullet
wound in his right knee and was transported to Kamal Odwan hospital in Beit
Lahia. At approximately 16:30, he was transported to al-Shifa hospital in Gaza
and his wounds were described as critical as a result of knee laceration and
cutting some arteries.
At
approximately 16:00, the Israeli forces positioned at the border fence in the
east of al-Shouka village, east of Rafah, opened fire at dozens of Palestinians
who were in the area. As a result, Abdul Fattah Ashraf Zaqout, 20, was wounded
by 3 bullets to the abdomen and right arm. He was transported to Abu Yusef
al-Najjar Hospital, where his wounds were described as moderate.
At
approximately 19:45, the Israeli forces positioned inside watchtowers at Beit
Hanoun (Erez) crossing in the northern Gaza Strip opened fire at open areas in
the destroyed industrial zone, northwest of Beit Hanoun. As a result, residents
of the area, especially women and children, were terrified. However, no casualties were reported.
At
approximately 20:00, the Israeli forces moved into Tulkarm and positioned in
the western neighborhood. They raided and searched a house belonging to the
family of Ahmed Ayman al-Khalili, 19, and arrested him.

In the early morning, medical sources at the Egyptian hospitals
declared death of Mahmoud Sami Sha’ath, 21, from Rafah in the southern Gaza
Strip, as he sustained injuries before. According
to investigations conducted by PCHR, at approximately 23:30 on Sunday, 18
November 2012, the Israeli warplanes launched a missile at a gray Hyundai (Verna)
vehicle in front of al-Abadla and al-Astal petrol station in Rafah. Three Palestinians
from Khan Yunis were inside the vehicle. As a result of the attack, 2 of them
were killed and Sha’ath, a member from al-Quds Brigades, sustained severe
wounds. Sha’ath was then transported to an Egyptian hospital. However, doctors
failed to save his life and he was pronounced dead on the abovementioned date.
At approximately 01:30, the Israeli forces moved into Sanour
village, south of Jenin. They patrolled the streets for a while and withdrew
later. Neither house raids nor arrests were reported.
At approximately 04:45, the Israeli forces moved into Maythaloun
village, south of Jenin. They patrolled the streets for a while and raided a
number of houses. According to local sources, residents of the village were not
able to reach the mosque and perform al-Fajr prayer. The Israeli forces
withdrew later. No arrests were reported.
At the same time, the Israeli forces moved into al-Zababda village,
southeast of Jenin. They patrolled the streets and withdrew later. Neither
house raids nor arrests were reported.
At approximately 11:15, the Israeli forces positioned at the border
fence in the east of Beit Hanoun opened fire at a group of Palestinian
civilians and farmers near the border area. As a result, Hassan Ahmed Naseer,
26, from Beit Hanoun, was wounded by a bullet to the right knee. Naseer was
transported to Martyr Kamal Odwan Hospital in Beit Lahia, where his wounds
ranged between moderate and severe.
At approximately 12:00, dozens of boys headed to the border fence
in the east of al-Bureij and al-Maghazi refugee camps in the central camps.
They approached the border fence and immediately the Israeli forces opened fire
at them. As a result, 8 Palestinians, including 3 children, were wounded. The wounds of 2 of them were described as
serious, due to which they were transported to Shifa hospital in Gaza City.
At approximately 12:30, the Israeli forces moved into Deir
al-Ghsoun village, north of Tulkarm. They patrolled the streets for a while and
withdrew later. Neither house raids nor arrests were reported.
At approximately 12:45, the Israeli gunboats positioned off al-Waha
resort in the northwest of Beit Lahia opened fire at the Palestinian fishing
boats for 10 minutes. As a result, the fishermen were frightened and fled
fearing for their lives. However, neither casualties nor damage of fishing
boats were reported.
At approximately 12:50, the Israeli forces stationed at the border
fence in the east of Beit Hanoun opened fire at a group of civilians and
farmers near the area. As a result, Mahmoud Sami Na’im, 24, was wounded by
shrapnel from a bullet in the chest. Beit Hanoun hospital described his wounds
as moderate.
At approximately 16:30, the Israeli forces positioned at the border
fence in the east of al-Shouka village, east of Rafah, opened fire at dozens of
civilians in the area. As a result, Suleiman Saleh al-Najadi, 42, was wounded
by a bullet to the back. He was transported to Gaza European hospital in Khan
Yunis, where medical sources described his wounds as moderate.
2- Use of
Excessive Force against Peaceful Demonstrations Protesting Settlement
Activities and the Construction of the Annexation Wall
During
the reporting period, Israeli forces used force against peaceful demonstrations
organized by Palestinian civilians and international and Israeli human rights
defenders in protest at the construction of the wall and settlement activities
in the West Bank. As a result, 2
Palestinian civilians were wounded, and a number of demonstrators suffered from
tear gas inhalation and others sustained bruises. Israeli forces arrested journalist Shamekh
Jaghoub 30, a cameraman of Palestine Television. They also confiscated the memory card of his
camera and beat him before releasing him.
Following the Friday Prayer on 23 November 2012, dozens of
Palestinian civilians and international and Israeli human rights defenders
organized a peaceful demonstration in Bil’ein village, west of Ramallah, in
protest to the construction of the annexation wall. The demonstrators gathered in the streets of
the village, chanting slogans calling for national unity. The protesters aimed to stress the need to
adhere to national principles and the right of return, to resist the occupation
and to call for the release of all Palestinian prisoners. The protesters raised Palestinian flags
and made their way towards the wall. They called through megaphones for Israeli
settlers in “Mitityahu” settlement to leave Palestinian land. Israeli
soldiers stationed in the area fired rubber-coated metal bullets, sound bombs
and tear gas canisters at the demonstrators.
As a result, an 18 year-old sustained a bullet wound in the left leg,
and a 22 year-old sustained a bullet wound in the right leg, and a number of
demonstrators suffered from tear gas inhalation and others sustained
bruises. Israeli forces arrested
journalist Shamekh Jareh Saleh Jagoub 30, a cameraman of Palestine
Television. They confiscated the memory
card of his camera and investigated with him about the persons he photographed,
and beat him before releasing him at approximately 15:00 the same day.
Also following the Friday Prayer on 23 November 2012, dozens of
Palestinian civilians and international and Israeli human rights defenders
organized a peaceful demonstration in Ne’lin village, west of Ramallah, in
protest at the construction of the annexation wall and settlement activities. The demonstrators moved towards areas of the
annexation wall. Immediately, Israeli
soldiers stationed in the area fired rubber-coated metal bullets, sound bombs
and tear gas canisters at the demonstrators.
As a result, some demonstrators suffered from tear gas inhalation and
others sustained bruises.
Around the same time on Friday, 23 November 2012, dozens of
Palestinian civilians and Israeli and international human rights defenders
gathered in the Martyrs Square in Nabi Saleh village, northwest of Ramallah, to
hold a weekly peaceful protest against the construction of the annexation wall
and settlement activities. The
protesters walked towards the gate erected by Israeli forces near the entrance
of the village, which leads to Palestinian lands that Israeli settlers from the
nearby “Halmish” settlement are trying to seize. Israeli soldiers fired live and rubber-coated
bullets, sound bombs and tear gas canisters at the protesters. As a
result, dozens of demonstrators suffered from tear gas inhalation. Israeli forces also arrested two Israeli
activists and transported them to an unknown destination.
Also following the Friday Prayer, dozens of Palestinian civilians
and international human rights defenders organized a peaceful demonstration in
the center of al-Ma’sara village, south of Bethlehem, in protest at the ongoing
construction of the annexation wall. As the protestors moved towards the gate of
the village, the Israeli forces closed it to prevent the demonstration from
gaining access to the confiscated lands.
Israeli soldiers fired
rubber-coated metal bullets, sound bombs and tear gas canisters at the
protesters. They also violently beat Hassan Braijiya,
coordinator for the Popular Movement against the Wall and Settlement Activities,
and threatened him of arrest while videotaping the demonstration.
At approximately 12:30 on the same Friday, dozens of Palestinian
civilians and international human rights activists organized a peaceful
demonstration in the center of Kufor Qaddoum village, northeast of Qalqilya, in
protest to the continued closure of the eastern entrance of the village, which
has been ongoing since the beginning of the al-Aqsa Intifada in 2000. Immediately,
Israeli soldiers stationed in the area fired rubber-coated metal bullets, sound
bombs and tear gas canisters at the demonstrators. As a result, some demonstrators suffered
from tear gas inhalation and others sustained bruises. An Israeli soldier shot a sound bomb at a
civilian Subaru 1988 car, owned by Walid Kamel Barham, which caused the
rear window to shatter.

Closure of the oPt
Israel has continued to impose a tightened closure on the oPt,
imposing severe restrictions on the movement of Palestinian civilians in the
Gaza Strip and the West Bank, including occupied East Jerusalem.
Gaza
Strip
Israel has continuously closed all
border crossings to the Gaza Strip for nearly 5 years. The illegal Israeli-imposed closure of the
Gaza Strip, which has steadily tightened since June 2007, has had a disastrous
impact on the humanitarian and economic situation in the Gaza Strip.
The IOF
have tightened the closure of the Gaza Strip, making Karm Abu Salem crossing the
sole commercial crossing of the Gaza Strip, although it is not suitable for
commercial purposes, in terms of its distance and operational capacity.
The IOF
have continued to apply their policy aimed at tightening the strangulation of
the commercial movement in the Gaza Strip, including imposing total control
over the flow of imports and exports.
The
total closure of al-Mentar “Karni” crossing on 02 March 2011 has created a
terrible situation that has seriously affected the Gaza Strip. Following this closure, all economic and
commercial establishments in Gaza Commercial Zone were shut off. It should be noted that al-Mentar crossing is
the biggest crossing in the Gaza Strip, in terms of its operational capacity to
absorb the flow of imports and exports. The
decision to close al-Mentar crossing was the culmination of a series of
decisions resulting in the complete closure of the Sofa crossing, east of the
Gaza Strip in the beginning of 2009, and the Nahal Oz crossing, east of Gaza
City, which was dedicated for the delivery of fuel and cooking gas to the Gaza
Strip, in the beginning of 2010.
The IOF
have continued to impose a total ban on the delivery of raw materials to the
Gaza Strip, except for very limited items and quantities. The limited quantities of raw materials
allowed into Gaza do not meet the minimal needs of the civilian population in
the Gaza Strip.
The
cooking gas crisis, which erupted last November, has continued to affect the
Gaza Strip. This crisis was created on
04 January 2010, when Israeli occupation authorities totally closed the Nahal
Oz crossing, which used to be dedicated to the delivery of fuel and cooking gas
supplies to Gaza. They shifted fuel and
cooking gas supplies to the Karm Abu Salem crossing, which is not equipped to
receive Gaza’s fuel needs. The Karm Abu
Salem crossing, with its maximum absorptive capacity, can receive only 200 tons
of cooking gas per day.
Approximately
80% of Gaza civilians continue to depend on humanitarian aid provided by UNRWA
and other relief agencies, the number of families who are living below the
poverty line has continued to increase, and approximately 40% of Gaza’s
manpower continues to suffer from permanent unemployment as a result of
shutting down the majority of Gaza’s economic establishments.
The IOF
have continued to impose a total ban on the export of products from Gaza,
especially industrial products, undermining any real chance of reopening economic
establishments. The situation has been
aggravated since the Karm Abu Salem crossing was designated as Gaza’s sole
commercial crossing; the repeated closure of this crossing negatively affects
the quantity of Gaza products which are allowed to be exported.
For approximately 6 consecutive years, the IOF have continued to
ban the delivery of construction materials to Gaza. During the reporting period, the IOF approved
the delivery of limited quantities of construction materials for a number of
international organizations.
Israel has continued to close the Beit Hanoun (Erez) crossing for
Palestinian civilians from the Gaza Strip.
The IOF only allow the movement of limited groups amidst severe
restrictions, including long hours of waiting in the majority of cases. The IOF have also continued to adopt a policy
aimed at reducing the number of Palestinian patients allowed to move via the
Beit Hanoun crossing to receive medical treatment in hospitals in Israel or in
the West Bank and Jerusalem. The IOF
denied new categories of Gazan patients permission to access hospitals via the
crossing.
Israel has imposed additional access restrictions on traders,
international diplomats, journalists and humanitarian workers seeking to enter
the Gaza Strip.

On Tuesday, 13 November 2012, Israeli forces allowed the
exportation of 7 truckloads of empty plastic cans returned previously and a
truckload of 280 cartons of 000 and 730 kilograms of basil.
Other Imports:
On Tuesday, 13 November 2012, Israeli forces allowed the entry of
40 tons of cement, 42 tons of construction steel and 4,550 tons of construction
aggregate for UNRWA; and 1,620 tons of construction aggregate for the
Palestinian Water Authority. They also
allowed the entry of 897 tons of fodders and 117 tons of wheat.
On Wednesday, 14 November 2012, the Israeli forces allowed the
entry of 189 tons of cement, 5,320 tons of construction aggregate for UNRWA;
and 40 tons of cement, 1960 tons of construction aggregate for USAID. They also allowed the entry of 819 tons of
fodders.
On Sunday, 18 November 2012, the Israeli forces allowed the entry
of 975 tons of fodders.
On Thursday, 22 November 2012, Israeli forces allowed the entry of
350 tons of construction aggregate for UNRWA.
They also allowed the entry of 1404 tons of fodders and 234 tons of
wheat.
On Sunday, 25 November 2012, Israeli forces allowed the entry of
897 tons of fodders and 429 tons of wheat.
On Monday, 26 November 2012, Israeli forces allowed the entry of
5320 tons of construction aggregate for UNRWA; and 1610 tons of construction
aggregate for the German Development Bank (GDB). They also allowed the entry of

On Tuesday, 27 November 2012, Israeli forces allowed the entry of
464 tons of cements, 69 tons of construction steel and 4550 tons of
construction aggregate for UNRWA; and 2170 tons of construction aggregate for

Israel has imposed a tightened closure on the West Bank. During the reporting period, the IOF imposed
additional restrictions on the movement of Palestinian civilians:
Ramallah
and al-Bireh: Israeli forces have continued to impose severe restrictions on the
movement of Palestinian civilians. At
approximately 18:30 on Thursday, 22 November 2012, Israeli forces
re-established their present at ‘Attara checkpoint at the northern entrance of
Beir Zait village, north of Ramallah. At
approximately 23:00, Israeli forces established a checkpoint by the entrance of
Beit Loqia village, southwest of Ramallah.
Both checkpoints were later removed; no arrests were reported. At approximately 09:00 on Friday, 23 November
2012, Israeli forces established a checkpoint on the entrance of al-Nabi Saleh
village, northwest of Ramallah, and established another one at approximately
22:00 by the entrance of Beit Loqia village.
Both checkpoints were later removed; no arrests were reported. At approximately 10:00 on Sunday, 25 November
2012, Israeli forces established a checkpoint by the entrance of Deir Nezam
village, southwest of the city. At
approximately 14:00, Israeli forces established another checkpoint by the intersection
of Beit ‘Our al-Foqa village, south west of the city. Both checkpoints were later removed; no
arrests were reported. At approximately 09:30 on Monday, 26 November 2012,
Israeli forces established a checkpoint by the entrance of Beit Loqia village,
southwest of Ramallah. It was removed
later and no arrests were reported.
Qalqilya:
Israeli forces have continued to impose severe restrictions on the movement of
Palestinian civilians. At approximately
18:00 on Saturday, 24 November 2012, Israeli forces established two checkpoints
by the northern and eastern entrances of ‘Azoun village, east of Qalqilya. At approximately 20:25 the same night,
established a checkpoint by the intersection of Amatyn village, northeast of
the city. At approximately 20:40, they
established another checkpoint by the intersection of Jeit village, northeast
of the city. All checkpoints were later
removed; no arrests were reported.
Jenin: Israeli forces have continued to impose
severe restrictions on the movement of Palestinian civilians. At approximately 09:00 on Saturday, 24
November 2012, Israeli forces established a checkpoint by the intersection of ‘Ajja
village, south of Jenin. At
approximately 16:00, the Israeli forces established another checkpoint on the
road linking Ya’bod village with Zebda village, southwest of the city. At approximately 21:30, the Israeli forces
established a checkpoint by the entrance of Romana village, southwest of
Jenin. In a similar time, theses forces
established another checkpoint by the intersection of Beit Qad village, northeast
of the city. The checkpoints were
removed later; no arrests were reported.
Later Sunday evening, 25 November 2012, Israeli forces closed the
western entrance of Ya’bod village, which links it with the villages to the
north of Tulkarm, southwest of Jenin, with an iron gate. They also closed a number of sub-entrances
south of the city with piles of sand. In
testimonies of many eyewitnesses to a PCHR fieldworker, they said that the
Israeli closed all the sub-entrances with piles of sand, after they installed
the iron gate on the western entrance of the village. At approximately 23:30 on Tuesday, 27
November 2012, Israeli forces established a checkpoint at the eastern entrance
of Ya’bod village, southwest of Jenin. The checkpoint was removed later and no
arrests were reported.
Tulkarm: Israeli forces have continued to impose
severe restrictions on the movement of Palestinian civilians. At approximately 16:30 on Friday, 23
November 2012, Israeli forces established a checkpoint on Tulkarm-Nablus road,
near the intersection of Beit Leid village, east of Tulkarm. The forces re-established the checkpoint in
the same area at approximately 00:30 on Saturday. At approximately 10:30 on
Sunday, 25 November 2012, Israeli forces stationed at ‘Inab military checkpoint
intensified its arbitrary restrictions against the Palestinian civilians. At approximately 01:00 on Monday, 26 November
2012, Israeli forces established a checkpoint at the road linking Tulkarm and
its northern villages, north of Tulkarm.
At approximately 08:00 on Tuesday, 21 November 2012, Israeli forces
stationed at ‘Inab military checkpoint intensified its arbitrary restrictions
against the Palestinian civilians. At
approximately 14:00 on Wednesday, 28 November 2012, Israeli forces stationed at
‘Inab military checkpoint intensified its arbitrary restrictions against the
Palestinian civilians. PCHR fieldworker
documented that dozens of cars were confiscated at the western end of the
checkpoint.
Hebron: Israeli forces have continued to impose
severe restrictions on the movement of Palestinian civilians. At approximately 07:00 on Thursday, 22
November 2012, Israeli forces established a checkpoint on the entrance of Beit ‘Awa
village (al-Buk’a) west of Doura, southwest of Hebron. At the same time, the Israeli forces
established another checkpoint on Tarousa road, which separates Doura city from
its western villages; the checkpoint was removed at 09:00 the same day. At approximately 16:30, Israeli forces
established a checkpoint on the road linking al-Burj village with al-Thaherya
village, southwest of Doura. The
checkpoints were later removed; no arrests were reported. At approximately 07:00 on Tuesday, 27 November
2012, Israeli forces established a checkpoint on the road of Abu Risha valley,
west of Ethna village, west of Hebron. At
approximately 20:00, Israeli forces established a similar checkpoint by the
entrance of Karza village, southwest of Doura, west of Hebron. At the same time, Israeli forces established
a checkpoint by the entrance of Sa’eir village, northeast of the city. All
checkpoints were later removed. No arrests were reported.
Jericho:
Israeli forces have
continued to impose severe restrictions on the movement of Palestinian
civilians. At approximately 10:00 on
Thursday, 22 November 2012, Israeli forces established a checkpoint near the
southern entrance of Jericho. The
checkpoint was removed later; however, it was re-established at approximately
16:00. No arrests were reported. At approximately 09:30 on Friday, 23 November
2012, Israeli forces established a checkpoint by the entrance of al-Zbidat
village, north of Jericho, and , and another at approximately 19:00 by the
southern entrance of the city. Both
checkpoints were later removed; no arrests were reported. At approximately 15:40, Israeli forces
established another checkpoint by the entrance of al-‘Ojja village, northeast
of Jericho, and detained a number of Palestinian civilians. Later, the checkpoint was removed and no
arrests were reported.
Bethlehem: Israeli
forces have continued to impose severe restrictions on the movement of
Palestinian civilians. At approximately
10:00 on Saturday, 24 November 2012, Israeli forces accompanied by military
bulldozers moved into Khelet al-Fahem area in al-Khader village, south of
Bethlehem. They razed the farmland in
the area, which belong to civilians from Beit Jala. In his testimony to a PCHR fieldworker, Ahmed
Mahmoud Salah, coordinator of the Popular Committee against the Settlement
Activity in al-Khader village, said that the Israeli forces closed the only
agricultural road nearing bypass road (60), which links Jerusalem and “Atsion”
settlement, south of Bethlehem, by placing huge rocks at its ends. They also closed the road which links
al-Khader village with Nahalin village, west of the city, with huge rocks and
sand piles.
Salfit: Israeli forces have continued to impose
severe restrictions on the movement of Palestinian civilians. At
approximately 18:30 on Saturday, 24 November 2012, Israeli forces established a
checkpoint at the bypass road near Kufor al-Deik village, west of Salfit. At approximately 19:45 on Saturday, Israeli
forces established a checkpoint by the entrance of Deir Balout village, west of
the city. At approximately 19:40 on Monday, 26 November
2012, Israeli forces established a checkpoint by the western entrance of Kufor
al-Deik checkpoint, west of Salfit, and it was removed at approximately 21:00;
no arrests were reported.
Detention at Military Checkpoints
At approximately 07:45 on Thursday, 22 November 2012, Israeli
forces detained Ahmed Abdul-Rahman Daoud, 22, from Hares village, north
of Salfit. He was arrested after the
Israeli forces chased his car, which he used to transport workers to the
industrial area (Burkan), west of Hares village. He was arrested near Burqein village, on the
main road. He was released on Wednesday.
At approximately 13:30 on Saturday, 24 November 2012, Israeli
forces arrested Heba, 16, and Iman Munir Yousif Sadouq, 17, off
one of the military checkpoint they established by the entrance of
Bethlehem. After hours of their arrest,
the Israeli forces released Iman, and kept her sister Heba under arrest.
At approximately 15:00 on Saturday, 24 November 2012, Israeli
forces established a checkpoint under the bridge of Kherabtha al-Musbah village
and arrested Rafieq Idris Ahmed Mafarja, 24, a student at Beir Zait
University, from Beit Loqia village, west of Ramallah and transported him to an
unknown destination.
At approximately 14:00 on Monday, 26 November 2012, Israeli forces
established a checkpoint under the bridge of Kherabtha al-Musbah village and
arrested Adeib Jamal Mafarja, 24, a student at Beir Zait University, from Beit
Loqia village, west of Ramallah and transported him to an unknown destination.
At early morning hours on Wednesday, 28 November 2012, Israeli
forces, stationed at al-Jalma military checkpoint, near Jenin, arrested Ibrahim
Hussam al-Tubasi, 19. It should be mentioned that al-Tubasi was en route to
visit his brother who is imprisoned in Israeli jails.

Settlement Activities and Attacks by Settlers against Palestinian Civilians and
Property
Israel
has continued its settlement activities in the oPt, in violation of
international humanitarian law, and Israeli settlers have continued to attack Palestinian
civilians and property.
At
approximately 09:00 on Saturday, 24 November 2012, a group of settlers from
“Adora” settlement, west of Hebron, threw rocks at Palestinian
civilian cars while passing through bypass road (35), which links Hebron with
its western villages. No injuries were
reported. According to an eyewitness,
the settlers were scattered throughout the area nearing the bypass road, and
started screaming and cursing at the civilians while throwing rocks at them.
At
approximately 21:00 on Saturday, 24 November 2012, dozens of settlers from
“Carmiel” settlement, established on the lands of Palestinian
civilians east of Yatta, south of Hebron, cut and uprooted more than 300 olive
trees belonging to al-‘Awawda family. In
his statement to a PCHR fieldworker, Rateb al-Jabour, member of the Popular
Committee Against the Settlement Activities in Yatta, said that a number of
al-‘Awawda family members were shocked to find the damaged olive trees, where
some were uprooted and others cut. They
also found racist statements written on the ground, “This is in revenge
for Tel Aviv and Beersheba.” Israeli Police was notified, and so they came
to the scene and took the land owners’ complaint.
At
approximately 07:00 on Wednesday, 28 November 2012, Israeli forces, accompanied
by a number of military vehicles and bulldozers, moved into Abu ‘Asyda area,
west of Beit Oula village, west of Hebron.
The soldiers stationed in the area and stopped civilians from reaching
it. The bulldozers started leveling farmlands
and stone chains, belonging to Suliman Rabi’, 40. They also uprooted
approximately 1000 olive seedlings, less than a year old, belonging to
al-Atrash family. Following that, the military bulldozers razed a 20-dunum area
of reclaimed agricultural farm, belonging to Mohammad Abdul-Fatah Jaber
al-Sarahin, 50, from Beit Oula village.
In his testimony to a PCHR fieldworker, Kamal Farash, member of the
Popular Committee Against the Wall and Settlement Activities, said that a large
number of Israeli forces stormed the area at dawn and started bulldozing the
farmlands under pretext that it falls under Section (C), thus fall under
Israeli security authority; therefore, the civilians are banned from changing
anything in the lands unless they have a permission from the concerned
authorities at the Israeli Civil Administration. He also mentioned that the
Civil Administration officers who accompanied the forces claimed that the
civilians had received notices from the Civil Administration two months ago,
which ordered them to return the lands to their previous state, and prohibited
altering them in any way before consulting with the concerned authorities. The
officer added that they had placed the notices in the farmlands.
At
approximately 08:00, Israeli forces accompanied by a number of military
vehicles and a bulldozer, moved into Khurbat Um Neir in Susya area, south of
Hebron. The bulldozer started destroying a tent occupied by ‘Issa Mohammad
Ahmed al-JAbour, 41, and his family, under pretext that it is built in a
military training area. It should be noted that the Israeli Defense Minister
had issued a decision a few months ago to transform the area to the east of
Yatta into a military training area for the army; therefore, civilians are
banned from reaching it. The decision includes the confiscation of 18% of the
lands of Yatta extending to the Dead Sea area.
At
the same time, Israeli forces, accompanied by military vehicles and a car of
the Israeli Civil Administration, stormed Shu’ab al-Batam area, east of Yatta,
south of Hebron. A Civil Administration officer placed a notice, ordering the
civilians to destroy a water well belonging to Zuheir al-Jabarin, 39. In his
testimony to a PCHR fieldworker, al-Jabarin said that the officer of the
Israeli Civil Administration placed the notice by the well, photographed it,
then the force left the area.

Recommendations to the International
Community
1. PCHR calls upon
the High Contracting Parties to the Fourth Geneva Convention to fulfill their
legal and moral obligations under Article 1 of the Convention to ensure
Israel’s respect for the Convention in the Occupied Palestinian Territory. PCHR believes that the conspiracy of silence
practiced by the international community has encouraged Israel to act as if it
is above the law and encourages Israel continue to violate international human
rights and humanitarian law.
2. PCHR calls upon
the High Contracting Parties to the Fourth Geneva Convention to convene a
conference to take effective steps to ensure Israel’s respect of the Convention
in the OPT and to provide immediate protection for Palestinian civilians.
3. PCHR calls upon
the High Contracting Parties to the Fourth Geneva Convention to comply with
their legal obligations detailed in Article 146 of the Convention to search for
and prosecute those responsible for grave breaches, namely war crimes.
4. PCHR calls for
the immediate implementation of the Advisory Opinion issued by the
International Court of Justice, which considers the construction of the
Annexation Wall inside the West Bank illegal.
5. PCHR recommends
that international civil society organizations, including human rights
organizations, bar associations and NGOs, participate in the process of
exposing those accused of grave breaches of international law and urge their
governments to bring the perpetrators to justice.
6. PCHR calls upon
the European Union to activate Article 2 of the Euro-Israel Association
Agreement, which provides that Israel must respect human rights as a
precondition for economic cooperation between the EU states and Israel. PCHR further calls upon the EU states to
prohibit import of goods produced in illegal Israeli settlements in the OPT.
7. PCHR calls on
the international community to recognize the Gaza disengagement plan, which was
implemented in September 2005, for what it is – not an end to occupation but a
compounding of the occupation and the humanitarian crisis in the Gaza Strip.
8. In recognition
of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the
ICRC to increase its staff and activities in the OPT, including the
facilitation of family visitations to Palestinian prisoners in Israeli jails.
9. PCHR
appreciates the efforts of international civil society, including human rights
organizations, bar associations, unions and NGOs, and urges them to continue
their role in pressuring their governments to secure Israel’s respect for human
rights in the OPT and to demand Israel end its attacks on Palestinian
civilians.
10. PCHR calls upon the international community to pressure Israel to
lift the severe restrictions imposed by the Israeli government and its
occupation forces on access for international organizations to the OPT.
11. PCHR reiterates that any political settlement not based on
international human rights law and humanitarian law cannot lead to a peaceful
and just solution of the Palestinian question.
Rather, such an arrangement can only lead to further suffering and
instability in the region. Any peace
process or agreement must be based on respect for international law, including
international human rights and humanitarian law.
