Summary
Israeli violations of international law and
international humanitarian law in the oPt continued during the reporting period
(12– 18 September 2013).
Shooting:
During the reporting period, Israeli forces raided a
house in Jenin refugee camp and killed a Palestinian civilian. In addition,
they wounded 4 others, including 3 children, in the same operation. Israeli forces wounded 8 others during
incursions in different areas in the West Bank. Moreover, 3 women, including 2
sisters and their aunt, one of whom is disabled, sustained bruises when Israeli
forces attacked them during an Israeli incursion into Kherbet Safa to the south of Beit Ummar,
north of Hebron.
On 17 September 2013, Israeli occupation forces killed
a Islam Hussam al-Tubasi (20) and wounded 4 others, including 3 children, in
Jenin refugee camp in the northern West Bank. Al-Tubasi was wounded by 2
bullets to the abdomen when Israeli forces raided his bedroom. They took him
out of the house bleeding and fired at his legs again in front of the
building. This happened when Israeli
forces moved into Jenin refugee camp and raided the victim’s house. During this
attack, a number of young men gathered and threw stones at Israeli military
vehicles. In response, Israeli soldiers
fired rubber-coated metal bullets and sound bombs. As a result, 4 civilians,
including 3 children, were wounded.
On 13 September 2013, Nesfat Ishteiwi (25) was hit by
a tear gas canister to the head when clashes erupted between Palestinian
civilians and Israeli forces that moved into Qalqilia.
On the same day, Israeli forces attacked Nabila Abu
Daiya (29), a disabled person, her sister Jamila (30) and their aunt Maliha
(50) when Israeli forces moved into Kherbet Safa to the south of Beit Ummar, north
of Hebron.
On 12 September 2013, 7 civilians sustained bullet and
shrapnel wounds when Israeli forces moved into Nablus to secure and protect
settlers, who moved into Joseph Tomb to perform Talmudic rituals. Israeli
forces arrested one of the wounded persons after chasing him. Israeli forces
claimed that wounded person had opened fire at them.
During the reporting period, Israeli forces continued
the systematic use of excessive force against peaceful protests organised by
Palestinian, Israeli and international activists against the construction of
the annexation wall and settlement activities in the West Bank. As a result, 3 civilians, including a
photojournalist, were wounded. Furthermore, dozens suffered tear gas inhalation
and other sustained bruises.
On 16 September 2013, Israeli gunboats stationed off
al-Waha resort, northwest of Beit Lahia in the northern Gaza Strip, opened fire
at Palestinian fishing boats that were sailing about 4 nautical miles off the
shore. The fishermen were frightened and fled back to the shore fearing of being
arrested or injured. Neither casualties nor material damage were reported.
Incursions:
During the reporting period, Israeli forces conducted
at least 42 military incursions into Palestinian communities in the West Bank. During
these incursions, Israeli forces arrested at least 41 Palestinians, including 9
children. Moreover, 8 others, including 3 women; one of whom is disabled, were
wounded (see Shooting section).
In the Gaza Strip, on 12 September 2013, Israeli
forces stationed along the border fence moved about 200 meters into the east of
Khuza’a village, east of Khan Yunis in the southern Gaza Strip. They levelled
lands along the border fence and withdrew later.
On 15 September 2013, Israeli forces moved about 200
meters into the east of al-Shuhada’ cemetery, east of Jabalia, in the northern
Gaza Strip. They levelled lands along the border fence and opened fire
sporadically. As a result, dozens of farmers were denied access to their lands.
Israeli forces withdrew at approximately 12:00, on the same day. Neither
casualties nor material damage were reported.
On 17 September 2013, Israeli forces moved about 200
meters into the east of Khuza’a village, east of Khan Yunis. They levelled
lands along the border fence, moved northwards and withdrew later.
On the same day, Israeli forces conducted a similar
incursion in the east of al-Faraheen neighbourhood in Abassan, east of Khan
Yunis. They levelled lands, opened fire sporadically and withdrew few hours
later.
Restrictions on movement:
Israel continued to impose a tightened closure of the
oPt, imposing severe restrictions on the movement of Palestinian civilians in
the Gaza Strip and the West Bank, including occupied East Jerusalem.
The illegal closure of the Gaza Strip, which has
steadily tightened since June 2007, has had a disastrous impact on the
humanitarian and economic situation in the Gaza Strip. The Israeli authorities impose measures to
undermine the freedom of trade, including the basic needs for the Gaza Strip
population and the agricultural and industrial products to be exported. For 7
consecutive years, Israel has tightened the land and naval closure to isolate
the Gaza Strip from the West Bank, including occupied Jerusalem, and other
countries around the world. This resulted in a grave violation of the economic,
social and cultural rights and a deterioration of living conditions for 1.7
million people. The Israeli authorities
has established Karm Abu Salem (Kerem Shaloum) as the sole crossing for imports
and exports in order to exercise its control over the Gaza Strip’s economy that
has been aggravating for years due to the shortage of imports. They also aim at imposing a complete ban on
the Gaza Strip’s exports.
Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians throughout the West Bank,
including occupied East Jerusalem. Thousands of Palestinian civilians from the
West Bank and the Gaza Strip continue to be denied access to Jerusalem.
As part of using military checkpoints and border
crossings as traps to arrest Palestinian civilians under the pretext they are
wanted, Israeli forces arrested at least 6 civilians, including 3 children.
Israel has
continued its settlement activities in the oPt, a direct violation of
international humanitarian law, and Israeli settlers have continued to attack
Palestinian civilians and property.
On 12 September 2013, Israeli forces accompanied by 2
bulldozers moved into the eastern Barta’a village that is isolated by the
annexation wall, west of Jenin. They declared the area as military closed area.
The bulldozers demolished 4 civilian facilities and withdrew later.
Around the same time, Israeli bulldozers levelled many
dunums of agricultural lands that are part of Ezbet Jal’oud, Ras Atiya and
Magharet al-Dab’ah villages, south of Qalqilia. They levelled nearly 5 dunums
belonging to civilians, who bought these lands 2 years ago, from Kofur Tholth,
Tamoun and Qalqilia.
At
approximately 19:10, on Thursday also, Israeli forces distributed notices to
halt contraction works in 2 houses in Bruqin village, west of Salfit, under the
pretext that they were not licensed, because they were located in Area C.
On Sunday morning, 15 September 2013, a group of
settlers from “Yitzhar” settlement that is established on lands of
Madamad village, south of Nablus, set fire to an under construction house
belonging to Ra’ed Jadallah Nassar. The 120-sqaure-meter house is located in
the northern mountain area.
On Monday, 16 September 2013, settlers from
“Eliezer” and “Daniel” settlements that are established on
lands of al-Khader village, south of al-Kahder village, south of Bethlehem,
moved into Zaqandah area, south of the village. They damaged the main gate of a
potable water well in a land belonging to Taha Ahmed Salah (55). They swam in
the well and polluted the water. Moreover, they performed Talmudic rituals
there. Ahmed Salah, coordinator of the popular committee against settlement
activities, said to a PCHR fieldworker that settlers walked through lands and
performed their rituals under the trees.
On 16 September 2013, Israeli forces backed with 10
military vehicles and 3 bulldozers stormed Makhoul area to the north of Tubas
town in the northern Jordan Valley. They
immediately started demolishing a Palestinian residential community where 10
Palestinian families of farmers and shepherds, comprised of 48 individuals,
including 17 children, live. In this
operation, Israeli forces demolished 12 tents and tin-made houses, a number of
subordinate kitchens and mobile bathrooms and 28 barnyards.
On Tuesday, 17 September 2013, Israeli forces forced
dozens of Palestinian families in al-Burj and al-Maytah area in the northern
Jordan Valley to evacuate the area under the pretext of military training.
Local sources stated that Israeli forces closed the abovementioned area and
Tayaseer military checkpoint, after which they started evacuating the area from
dozens of families that live in tents. It should be noted that Israeli forces
had notified those families on 10 September 2013 to evacuate the area under the
pretext of military training.
Israeli Violations Documented during the Reporting Period
(12 – 18 September 2013)
1. Incursions into Palestinian Areas, and Attacks
on Palestinian Civilians and Property in the West Bank and the Gaza Strip
Thursday, 12 September 2013
At approximately 01:00, Israeli forces moved into al-Aroub
refugee camp, north of Hebron. They patrolled the streets and positioned
themselves in the centre of the camp. They raided a house belonging to the
family of Majed Tayseer al-Titi (19). They arrested the aforementioned person.
In the meanwhile, some boys gathered and threw stones and empty bottles at
Israeli soldiers, who fired sound bombs and tear gas canisters. As a result, a
number of civilians suffered tear gas inhalation.
Around the same time, Israeli forces moved into
al-Fawar refugee camp, south of Hebron. They patrolled the streets and
positioned themselves in the eastern side of the camp. They also raided a house
belonging to the family of Abdul Hamid al-Bayed (49). They arrested his 2 sons:
Mahmoud (19) and Islam (20) and took them to an unknown destination.
At approximately 02:00, Israeli forces moved into
al-Koum village, west of Doura, southwest of Hebron. They patrolled the streets
for some time and withdrew later. Neither house raids nor arrests were
reported.
Around the same time, Israeli forces moved into Nablus
to secure settlers who entered Joseph Tomb area to perform Talmudic rituals.
They patrolled the streets in the vicinity of Askar refugee camp, east of
Nablus. At approximately 02:15, heavy fire was heard and a wounded civilian
approached the entrance of Askar School for Girls. The young man was wounded by
a bullet to the left leg. Civilians gathered and called the ambulance. Israeli
soldiers, who claimed the young man had fired at them, chased him and opened
fire at the civilians. As a result, 6 others were wounded. The first wounded
and 4 of the other wounded persons fled to a house belonging to the family of
Emad Abu Tayoun and closed the door tightly. The other wounded persons ran away
in the streets. As Israeli soldiers could not enter the house, they broke a
window in the ground floor and fired 2 sound bombs inside. They entered, during
which the 4 wounded persons escaped from another window while the first one
could not do it. He hid in a room, but Israeli soldiers arrested him. The young
man’s name is Hosam Qatnani (20), from Askar refugee camp. He had been
seriously bleeding.
Moreover,
Israeli forces searched the house and arrested Emad Abu Tayoun (55) and his 2
sons: Abdul Fattah (25) and Abdullah (21). In the early morning, Emad and Abdul
Fattah were released at Hawara checkpoint, while Abdullah and Qatnani were kept
in detention.
The persons
who were wounded and taken to Rafidiya hospital in Nablus, were:
1. Morad Fayez Msallam (26), from Askar refugee camp,
wounded by a bullet to the back and shrapnel in the right hand;
2. Ahmed Yasser Shkokani (19), wounded by a bullet to the
right hand;
3. Yehya Abdul Rahman Salem (18), sustained shrapnel
wound in the back;
4. Mohammed Sa’id Ziada (23), sustained shrapnel wound in
the left leg;
5. Tha’er Fat’hi Qandil (26), wounded by a bullet to the
two thighs;
6. Qassam Fat’hi Qandil (19), sustained shrapnel wound to
the right hand.
In the early morning, Israeli forces moved into Kofur Ra’i
village, southwest of Jenin. They patrolled the streets and positioned
themselves in the northern neighbourhood. They raided a house belonging to the
family of Majdi Walid al-Sheikh Ibrahim (27) and arrested him.
At approximately 03:45, Israeli forces moved into Seer
village, south of Jenin. They patrolled the streets and positioned themselves
in the vicinity of “Top Field” agricultural company. The raided the
company and confiscated all PC sets and 5 tractors. Israeli forces arrested Odai
Mohammed Daraghma (24) and Mohammed Mohanned al-Kailani (23) and withdrew
later.
At approximately 04:30, Israeli forces moved into
‘Allar village, northeast of Tulkarm. They patrolled the streets for some time
and withdrew later. Neither house raids nor arrests were reported.
Around the same time, Israeli forces moved into the
eastern Baqa village, north of Tulkarm. They patrolled the streets for some
time and withdrew later. Neither house raids nor arrests were reported.
Around the same time also, Israeli forces moved into
‘Etil village, north of Tulkarm. They patrolled the streets for some time and
withdrew later. No arrests were reported.
At approximately 07:00, Israeli forces moved about 200
meters into Abu Rida neighbourhood, east of Khuza’a village, east of Khan Yunis
in the southern Gaza Strip. They levelled lands along the border fence and
withdrew later.
At approximately 10:00, Israeli forces moved into
al-Jalama village, north of Jenin. A local source stated to a PCHR fieldworker
that Israeli forces tested the water of the artesian wells in the village. They
withdrew later. Neither house raids nor arrests were reported. It should be
noted Israeli forces moved into residential areas to test the water of artesian
wells.
At approximately 13:00, Israeli forces moved into
Zeita village, north of Tulkarm. They patrolled the streets and raided a house
belonging to the family of Mohammed Rafe’ Mer’i. They arrested the
aforementioned person and then raided another house belonging to the family of
Ehab Mohammed Abu Hamda (23). They arrested Abu Hamda as well and withdrew
later.
At approximately 19:00, Israeli forces moved into Ali
Abdullah Saleh Sweidan (15) from his family’s farmland that is adjacent to
street (55), north of the village. Israeli forces stepped out of their vehicles
and moved towards the abovementioned land. They handcuffed Sweidan and took him
to an unknown destination.
At approximately 23:30, Israeli forces moved into the
area between Jenin and Kofur Dan village, northwest of Jenin. They combed the
area and withdrew later. No further incidents were reported.
Friday, 13 September 2013
At approximately 10:10, Israeli forces moved into
Kofur Qaddoum village, east of Qalqilia. They patrolled the streets and raided
a house belonging to the family of Mahmoud ‘Aqel. They climbed on the top of
the house and turned it into a military site. Clashes erupted between
Palestinian civilians and Israeli forces. As a result, Nesfat Mahmoud Ishtaiwi
(25) was hit by a gas canister to the head.
At approximately 15:00, Israeli forces moved into
Kherbet Safa, south of Beit Ummar village, north of Hebron. They patrolled the
streets and positioned themselves in the centre of the Kherbeh. A group of boys
gathered and threw stones at Israeli soldiers, who chased the boys and fired
sound tear gas canisters. As a result, dozens of civilians suffered tear gas
inhalation. At approximately 16:00, backup forces moved into the same area. Two
soldiers attacked Nabila Mahmoud Abu Daiya (29), a disabled woman, in the
belly, chest and legs. As a result, she sustained bruises. Israeli forces also
attacked her sister Jamila (30) and her aunt Maliha Rashid Abu Daiya (50) when
they tried to talk to the Israeli soldiers. Nabila’s mother said to a PCHR
fieldworker that Nabila’s condition is serious, as she wakes up screaming at
night since then.
Nabila’s brother Majid Abu Daiya (35) said to PCHR’s
fieldworker:
“At approximately 16:30 on Friday, 13
September 2013, my sister Nabila (29), who suffers from a mental disorder, was
coming back from my grandfather’s house that is about 200 meters away from
ours. Israeli forces patrolled the streets coming from “Karmi Tsour”
settlement. A vehicle stopped and a soldier stepped out of it to pull Nabila
from her hair to the ground. He started beating her on the head, back, chest
and legs. She was screaming, but in vain. A few minutes later, my aunt Maliha
tried to talk to the soldier and get him away from Nabila, but another soldier
pushed my aunt and my other sister Jamila to the ground. In the meantime,
residents of the area including me approached, as Nabila was screaming. We got
her away from the area, but Israeli soldiers started firing sound bombs.”
At approximately 21:00, Israeli forces moved into the
main road leading to al-Fawwar refugee camp, south of Hebron. They positioned
themselves at the main entrance of the camp and started stopping Palestinian
vehicles. However, a group of boys gathered and threw stones and empty bottles
at Israeli soldiers, who fired sound bombs and tear gas canisters in response.
As a result, a number of boys suffered tear gas inhalation. At approximately
22:00, Israeli forces moved back to bypass road (60) and prevented civilians
from going into or out of the camp.
At approximately 22:00, Israeli forces moved into
Zaita village, north of Tulkarm. They patrolled the streets firing flare bombs
overhead and withdrew later. Neither house raids nor arrests were reported.
Saturday, 14 September 2013
At approximately 21:00, Israeli forces moved into Bab
al-Zawiya area, in the centre of Hebron. They patrolled the streets, where a
number of boys gathered and threw stones and empty bottles at them. Israeli
forces fired sound bombs, tear gas canisters and rubber-coated metal bullets.
As a result, dozens of boys suffered tear gas inhalation. Israeli forces
withdrew later and no arrests were reported.
At
approximately 21:30, Israeli forces moved into Ya’bad village, southwest of
Jenin. They patrolled the streets and positioned themselves in the western
neighbourhood. They also raided and searched 3 houses from which they arrested
3 children:
1. Mohammed Abdul Nasser ‘Abadi (15);
2. Hani Talal Zaid (15); and
3. Adham Ibrahim Abu Rmeila (15).
At
approximately 23:00, Israeli forces moved into Beit Ummar village, north of
Hebron. They patrolled the streets and positioned themselves at the entrance of
al-Ein area, north of the village. Israeli forces deployed between the houses
and stopped Bader Ibrahim Abu Maria (17) and Amjad Saber Abu Maria (17). They
checked their ID cards and took them to an unknown destination.
Sunday, 15 September
2013
At
approximately 01:00, Israeli forces moved into Beit Ummar village, north of
Hebron. They patrolled the streets and positioned themselves in the centre of
the village. They raided a house belonging to the family of Mohammed Yusef
Ikhlail (17). They arrested the aforementioned person and withdrew later. In the meantime, a number of boys gathered and
threw stones and empty bottles at Israeli vehicles that stopped in al-Ein area
and started firing sound bombs and tear gas canisters. As a result, dozens of civilians suffered tear
gas inhalation. At approximately 02:30, Israeli forces withdrew. No material
damage was reported.
At
approximately 01:30, Israeli forces moved into al-Aroub refugee camp, north of
Hebron. They deployed between the houses and detained Yusef Tayseer al-Titi
(18) while he was going home. Besides, they detained Walid al-Titi (33), a
volunteer at B’Tselem centre. Israeli forces withdrew later. Neither house raids nor arrests were reported.
Around the
same time, Israeli forces moved into Zaita village, north of Tulkarm. They patrolled the streets, where a number of
school students going home gathered and threw stones at Israeli vehicles. In
response, Israeli forces fired sound bombs and chased the boys. Israeli forces
withdrew later. Neither house raids nor arrests were reported.
At
approximately 18:00, Israeli forces moved into al-Aroub refugee camp, north of
Hebron. They patrolled the streets and arrested Nour al-Din Abu Sham’a (10)
while he was in front of his family’s house. He was arrested under the pretext
that he threw stones at Israeli vehicles driving on bypass road (60). He was
taken to a checkpoint at the entrance of the camp and then taken to an unknown
destination.
Monday 16 September 2013
At
approximately 01:00, Israeli forces moved into al-Moureq village, southwest of
Doura, southwest of Hebron. They patrolled the streets and raided and searched
a house belonging to the family of Tayseer Mohammed ‘Awawda. They kept all the
family members outdoor. Moreover, they arrested the ‘Awawda’s 2 sons: Alaa’
(20) and Mo’ath (21).
At
approximately 01:30, Israeli forces moved into Birzait village, north of
Ramallah. They patrolled the streets for some time and withdrew later. No
arrests were reported.
At
approximately 01:45, Israeli forces moved into Deir Estia village, north of
Salfit. They patrolled the streets and raided and searched 3 houses. In
addition, they fired rubber-coated metal bullets at Sa’ed Ezzat Mansour (17)
while arresting his brother ‘Ahed. Sa’ed
was wounded by a bullet to the right leg. Israeli forces arrested 3 civilians
and withdrew later. The arrested were:
1. ‘Ahed Ezzat Mansour (24);
2. Mo’athe Abdul Halim Mansour (23); and
3. Khalil Ahmed Mansour (20).
At approximately 02:00, Israeli forces
moved into many neighbourhoods in Hebron. They patrolled the streets and moved
into Abu al-Da’jan neighbourhood, west of Hebron. Israeli forces raided and
searched a house belonging to the family of Abdullah Zaidan al-Junaidi (22) and
arrested him. In the meanwhile, Israeli forces raided and searched a house
belonging to the family of MP of the Palestinian Legislative Council Hatem
Qafisha (60) in Wad al-Hariya, south of the city. They arrested his son Sultan
(19) and took him to an unknown destination.
Around the same time, Israeli forces moved
into Beit Ummar village, north of Hebron. They patrolled the streets and
positioned themselves at the entrance of the village. They raided and searched
a house belonging to the family of Yusef Hassan Ikhlail. They kept his family
in a room and attacked and arrested his son Aktham (21). They prevented Aktham
from getting dressed and forced him to walk with them about 2 kilometres to the
military positioned at the entrance of the village. In the meantime, Israeli
forces raided and searched a house belonging to the family of Zain Hesham Abu
Maria (17). They arrested the aforementioned person. It should be noted the
number of the arrested persons from Beit Ummar village mounted to 94, including
67 minors, since the beginning of the year.
At approximately 02:30, Israeli forces moved into Beit
Awwa village, south of Doura, southwest of Hebron. They patrolled the streets
and raided a house belonging to the family of Abdullah Khalil Masalma (26).
They arrested the aforementioned person and took him to an unknown destination.
Around the same time, Israeli forces moved into Taqou’
village, southeast of Bethlehem. They raided and searched a house belonging to
the family of Mohammed ‘Adel al-‘Emour (23). They arrested the aforementioned
person and took him to an unknown destination.
At approximately 06:00, Israeli forces
moved about 200 meters into the east of al-Shuhada’ cemetery, east of Jabalia,
in the northern Gaza Strip. They levelled lands along the border fence and
opened fire sporadically. As a result, dozens of farmers were denied access to
their lands fearing of being wounded. Israeli forces withdrew at approximately
12:00 on the same day. Neither material damage nor casualties were reported.
At approximately 06:30, Israeli gunboats

moved into Kherbatha al-Musbah village, west of Ramallah. They patrolled the
streets for some time and withdrew later. No arrests were reported.
At approximately 12:55, Israeli forces
accompanied by officers from the Civil Administration from “Gush
Etzion” settlement moved into Beit Fajjar village, southeast of Bethlehem.
They positioned themselves in Khellet Hajja, east of the village, where there
are quarries, and closed it completely. The Civil Administration officers
started dismantling the machines there to be confiscated.
Tuesday, 17 September 2013
At approximately 01:30, Israeli forces moved into
Ertah suburb, southwest of Tulkarm. They patrolled the streets and raided and
searched a house belonging to the family of Yehya Nimer Abu Mo’amer (29). They
arrested the aforementioned person and took him to an unknown destination.
At approximately 02:00, Israeli forces moved into
Beitouniya village, west of Ramallah. They patrolled the streets and raided and
searched 2 houses from which they arrested 2 civilians and took them to Ofer
detention facility:
1. Tha’er Fakher Yusef (22), an employee in the municipal
control department; and
2. Abdul Aziz Ouda Jebril (25).
At approximately 02:30, Israeli forces moved into
‘Aboud village, northwest of Ramallah. They patrolled the streets and raided and
searched 3 houses from which they arrested 2 civilians: Obada Mohammed
Barghouthi (28) and Karim Ezzat Barghouthi (21). Moreover, Israeli forces
handed Ahmed Hassan Barghouthi (20) a summon to refer to the Israeli
intelligence service in Ofer detention facility, southwest of Ramallah.
At approximately 03:00, Israeli forces moved into
Qalqilia. They patrolled the streets and raided and searched a house belonging
to the family of Bashir Taha Nazzal. They arrested his son Mohammed (24) and
attacked his other son ‘Amid (23). Israeli forces withdrew at approximately
04:30.
Bashir Taha said to a PCHR fieldworker:
“At approximately 03:00, I woke up and heard
sounds in our bedrooms. I found Israeli soldiers had entered the house while we
were asleep. We were terrified as if it was a nightmare. We could not
understand how they came in. We discovered that they damaged the doors with a
special tool and raided my children’s bedrooms while they were asleep. They
arrested my son Mohammed and used his brother ‘Amid as a human shield. They
handcuffed ‘Amid and ordered him to take them to Mohammed’s room and wake him
up. An Israeli soldier pushed him, so his face was hit with a fan and caused
him to bleed. Moreover, they damaged the contents of Mohammed’s room and
arrested him. The officer ordered his brothers to bring his mother so she can
say goodbye to him. However, they kept me in another room. They took Mohammed
to an unknown destination.”
In an excessive use of lethal force, on Tuesday
morning, 17 September 2013, Israeli occupation forces killed a Palestinian
civilian and wounded 4 others, including 3 children, in Jenin refugee camp in
the northern West Bank.
According to investigations conducted by the
Palestinian Center for Human Rights (PCHR) and the testimonies of the victim’s
two brothers – Kamal, 34, and Mustafa, 23, at approximately 02:30 on Tuesday,
17 September 2013, Israeli forces in about 22 military vehicles moved into
Jenin refugee camp, west of Jenin town.
A number of young men gathered and threw stones at Israeli military
vehicles. In response, Israeli soldiers
fired rubber-coated metal bullets and sound bombs. The clashes continued for a few hours, but no
casualties were reported. At
approximately 06:00, Israeli forces moved back to the edges of the camp. Half an hour later, a special unit of Israeli
forces backed with 4 military vehicles moved into the camp. They stationed in the center of the
camp. Israeli soldiers who were in black
military uniform raided 3-storey apartment building belonging to Hussam
al-Tubasi. Israeli soldiers blew up the
doors of the house and stepped up to a room on the roof where the owner’s sons,
Islam, 20, and Mustafa, 23, live. Islam
and Mustafa got out of their room to find out what was going on as they heard
explosions. Immediately, Israeli soldiers
kicked Mustafa, pushed him to the ground and handcuffed him. He saw Israeli soldiers pushing Islam into
the room. Two Israeli soldiers then pulled Mustafa down to the second floor and
held him in a bathroom. In the meantime,
sounds of shooting were being heard on the roof. A few minutes, Israeli soldier stepped down
taking Islam who was bleeding. They
fired at his legs again in front of the building and took him.
Soon after, Israeli forces brought backups into the
camp. A number of young men and children
gathered and threw stones and home-made hand grenades at Israeli forces that
were surrounding al-Tubassi’s house.
Israeli soldiers opened fire indiscriminately. As a result, 4 civilians, including 3
children, were wounded:
1. Saladin Na’el Ghazzawi, 23, wounded by a bullet to the
right thigh;
2. Mohammed Khaled Taleb, 12, wounded a by a bullet to
the thigh;
3. Abdul Rahman Taha Abu Sirriya, 12, wounded by a bullet
to the right knee; and
4. Mohammed Wa’el Ghazzawi, 16, wounded by a bullet to
the right foot.
In the afternoon, an ambulance of Palestine Red
Crescent Society moved to Salem military post, northwest of Jenin, and received
Islam’s body as he had be pronounced dead in an Israeli hospital. The body was taken to Jenin Hospital, where
medical sources stated that the victim was hit by 2 live bullets to the abdomen
and 2 ones to the legs.
Local sources confirmed that Mohammed Bassam al-Fayed
(21) was arrested from his house during the military operation.
At approximately 06:20, Israeli forces moved about 200
meters into the east of Khuza’a village, east of Khan Yunis. They levelled
lands along the border fence and withdrew 4 hours later.
At approximately 11:45, Israeli forces moved about 150
meters into the east of al-Faraheen neighbourhood in Abasan village, east of
Khan Yunis. They levelled lands along the border fence and withdrew later.
At approximately 23:00, Israeli forces moved into Beit
‘Our al-Tahta village, southwest of Ramallah. They patrolled the streets for
some time and withdrew later. Neither house raids nor arrests were reported.

At approximately 01:00, Israeli forces moved into
Yatta village, south of Hebron. They patrolled the streets for some time and
withdrew later. Neither house raids nor arrests were reported.
At approximately 01:30, Israeli forces moved into
Nablus. They patrolled the streets and raided and searched a number of houses.
They arrested Mohammed Nayef Dawood (29) and Mohammed Ibrahim Ja’arah (20) and
took them to an unknown destination.
At approximately 02:00, Israeli forces moved into Safa
village, west of Ramallah. They patrolled the streets and raided a house
belonging to the family of Rashad Mohammed Nasser (49). Israeli forces handed
Nasser’s son Marcel (21) a summon to refer to the Israeli intelligence service
on Monday, 23 September 2013, in Ofer detention facility, southwest of
Ramallah.
At approximately 03:00, Israeli forces moved into
al-Fawwar refugee camp, south of Hebron. They patrolled the streets for some
time and withdrew later. Neither house raids nor arrests were reported.
2. Use of excessive force against peaceful demonstrations protesting
settlement activities and the construction of the annexation wall
During the reporting period, Israeli soldiers used
excessive force against peaceful demonstrations organised by Palestinian
civilians, international and Israeli human rights defenders in protest at the
construction of the annexation wall and settlement activities in the West Bank.
Demonstrations against the construction of the
annexation wall and settlement activity
Following the Friday prayer, 13 September 2013, dozens
of Palestinian civilians and international and Israeli human rights defenders
organised a peaceful demonstration in Bil’in village, west of Ramallah, in
protest at the construction of the annexation wall and settlement activities.
The demonstrators raised the Palestinian flag and made their way towards the
annexation wall. Israeli forces closed the wall gate with barbwire and when the
demonstrators attempted to access the lands behind the barbwire, they were
stopped by Israeli soldiers. The demonstrators threw stones at the Israeli
soldiers who responded with live ammunition, rubber-coated metal bullets, sound
bombs, and tear gas canisters, and chased them across olive fields as far as
the outskirts of the village. As a result, dozens suffered tear gas inhalation
and others sustained bruises.
Also, following the Friday Prayer, dozens of Palestinian civilians and international
and Israeli human rights defenders organised a peaceful demonstration in Ni’lin
village, west of Ramallah, in protest at the construction of the annexation
wall and settlement activities. The demonstrators made their way towards the
annexation wall. Israeli forces closed the wall gate with barbwire and, when
the demonstrators attempted to access the lands behind the barbwire, they were
stopped by Israeli soldiers. The demonstrators threw stones at the Israeli

Around the same time on Friday, dozens of Palestinian civilians,
Israeli and international human rights activists gathered at the Martyrs
Square in al-Nabi Saleh village, northwest of Ramallah, to hold a weekly
peaceful protest against the construction of the annexation wall and settlement
activities. The protesters walked towards Palestinian lands that Israeli
settlers from the nearby “Halmish” settlement are trying to
seize. From the morning, Israeli forces
had closed all entrances to the village to prevent Palestinians, international
activists, and journalists from joining the demonstration. Upon their arrival in the area, Israeli
soldiers fired live ammunition, rubber-coated bullets, sound bombs, and tear
gas canisters, chased the demonstrators into the village and sprayed them and
civilian houses with waste water. As a result, dozens of Palestinians suffered
tear gas inhalation and others sustained bruises.
At approximately 12:30, on Friday, 13 August 2013, dozens
of Palestinian civilians from Kofur Qaddoum, northeast of Qalqilia, and
international activists gathered and made their way through the eastern
entrance of the village in protest at closing that entrance with an iron gate
since al-Aqsa Intifada. Israeli forces fired tear gas canisters randomly. As a
result, dozens suffered tear gas inhalation.
3. Continued closure of the oPt
Israel has continued to
impose a tightened closure on the oPt, imposing severe restrictions on the
movement of Palestinian civilians in the Gaza Strip and the West Bank,
including occupied East Jerusalem.
Gaza Strip
Israeli forces continuously tightens the
closure of the Gaza Strip and closes all commercial crossings , making the Karm
Abu Salem crossing the sole commercial crossing of the Gaza Strip, although it
is not suitable for commercial purposes in terms of its operational capacity
and distance from markets.
Israeli forces have continued to apply the
policy, which is aimed to tighten the closure on all commercial crossings, by
imposing total control over the flow of imports and exports.
The total closure of al-Mentar
(“Karni”) crossing since 02 March 2011 has seriously affected the
economy of the Gaza Strip. Following this closure, all economic and commercial
establishments in the Gaza Commercial Zone were shut off. It should be noted
that al-Mentar crossing is the biggest crossing in the Gaza Strip, in terms of
its capacity to absorb the flow of imports and exports. The decision to close
al-Mentar crossing was the culmination of a series of decisions resulting in
the complete closure of the Sofa crossing, east of the Gaza Strip in the
beginning of 2009, and the Nahal Oz crossing, east of Gaza City, which was
dedicated for the delivery of fuel and cooking gas to the Gaza Strip, in the
beginning of 2010.
Israeli forces have continued to impose a
total ban on the delivery of raw materials to the Gaza Strip, except for very
limited items and quantities. The limited quantities of raw materials allowed
into Gaza do not meet the minimal needs of the civilian population of the Gaza
Strip.
The cooking gas crisis has ranged between
the ebb and flow for 3 months due to the closure of Karm Abu Salem for security
reasons. According to PCHR’s follow-up,
Israeli authorities only allow around 98 tonnes of cooking gas into Gaza per
day. This limited quantity is less than
half of the daily needs, which is 200 tonnes per day, of the civilian
population in the Gaza Strip during the winter.
For almost 6
consecutive years, Israeli forces have continued to prevent the delivery of
construction materials to the Gaza Strip. During the reporting period, Israeli
forces approved the delivery of limited quantities of construction materials
for a number of international organisations in the Gaza Strip. Israeli forces also continued to impose
almost total ban on the Gaza Strip exports, including agricultural and
industrial products, except for light-weighted products such as flowers,
strawberries, and spices.
Israel has continued to
close the Beit Hanoun (“Erez”) crossing for the majority of Palestinian
citizens from the Gaza Strip. Israel only allows the movement of a limited
number of groups, with many hours of waiting in the majority of cases. Israel
has continued to adopt a policy aimed at reducing the number of Palestinian
patients allowed to move via the Beit Hanoun crossing to receive medical
treatment in hospitals in Israel or in the West Bank and East Jerusalem. Israel
denied permission to access hospitals via the crossing for new categories of
patients from the Gaza Strip.
For around a year and a
half, Israeli forces have allowed Palestinian detainees’ families to visit
their sons in the Israeli jails according to special and unfair conditions
after more than 5 years of deprivation in violation of international
humanitarian law.
The Egyptian
authorities allow the population of the Gaza Strip to travel via Rafah
International crossing, which connects the Gaza Strip with the outside
world. Only limited and specified
categories are allowed, including patients, students, persons that hold residencies
in Egypt or abroad, men over 40 years, females in all ages, children under 18,
persons who hold Arab and foreign nationalities, and members of Arab and
international humanitarian delegations.
It should be mentioned that the crossing opens seven days a week. Nowadays, the crossing is overcrowded due to
the prolonged procedures from the Egyptian side, particularly after closing it
for several days over the past weeks due to Egypt’s security conditions, which
has affected the travellers’ movement in both directions.

On Tuesday, 10 September 2013, Israeli
forces allowed the entry of 910 tonnes of construction aggregates for the
private sector; 254 tonnes of cement and 3,430 tonnes of construction
aggregates for UNRWA. They also allowed
the entry of 1,599 tonnes of fodders and 1,131 tonnes of wheat.
On Wednesday, 11 September 2013, Israeli
forces allowed the entry of 150 tonnes of cement, 40 tonnes of white cement,
700 tonnes of construction aggregates and 21 tonnes of construction steel for UNRWA;
and 910 tonnes of construction aggregates for the private sector. They also allowed the entry of 1,404 tonnes
of fodders and 1,326 tonnes of wheat.
On Thursday, 12 September 2013, Israeli forces
allowed the entry of 980 tonnes of construction aggregates for the private
sector; and 2,450 tonnes of construction aggregates for the UNDP. They also allowed the entry of 1,131 tonnes
of fodders and 1,209 tonnes of wheat.
On Sunday, 15 September 2013, Israeli
forces allowed the entry of 390 tonnes of cement, 1,680 tonnes of construction
aggregates and 34 tonnes of construction steel for UNRWA; 700 tonnes of
construction aggregates for the private sector; and 280 tonnes of cement, 1,260

Israel has imposed
a tightened closure on the West Bank. During the reporting period, Israeli
forces imposed additional restrictions on the movement of Palestinian
civilians:
Ramallah: Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians. At approximately 21:30 on Monday, 16
September 2013, Israeli forces re-established their presence at ‘Attara
checkpoint at the northern entrance of Bir Zeit village, north of Ramallah. They stopped and searched Palestinian
civilian vehicles.
At approximately 22:00 on the same day, Israeli forces
established a checkpoint at the main entrance of Beit Liqya village, southwest
of Ramallah. They stopped and searched
Palestinian civilian vehicles.
At approximately 08:30 on Tuesday, 17 September 2013,
Israeli forces established a checkpoint at the entrance of Beit ‘Aur al-Fouqa
village, southwest of Ramallah. They
stopped and searched Palestinian civilian vehicles.
Hebron: Israeli
forces have continued to impose severe restrictions on the movement of
Palestinian civilians. At approximately
08:00 on Thursday, 12 September 2013, Israeli forces established a checkpoint
at the southern entrance of Halhoul town, north of Hebron. They stopped and searched Palestinian
civilian vehicles. At approximately
16:00, Israeli forces established a checkpoint at the entrance of al-‘Arroub
refugee camp, north of Hebron. They
stopped and searched Palestinian civilian vehicles. At approximately 17:00, Israeli forces closed
the area of the Ibrahimi Mosque in the center of Hebron until Saturday, 13
September 2013, because of Jewish holidays.
At approximately 15:00 on Friday, 13 September 2013,
Israeli forces established a checkpoint at the entrance of Kharsa village,
south of Hebron. They stopped and
searched Palestinian civilian vehicles.
At approximately 19:00 on Monday, 16 September 2013,
Israeli forces closed the entrance of al-Fawar refugee camp, south of Hebron,
with an iron gate. They started stopping
and searching Palestinian civilian vehicles.
A number of Palestinian boys gathered and threw stones at Israeli
forces. Immediately, Israeli soldiers
fired tear gas canisters and sound bombs at them. Israeli forces left the area later.
At approximately 07:30 on Wednesday, 18 September
2013, Israeli forces established a checkpoint at the northern entrance of
Hebron. They stopped and searched
Palestinian civilian vehicles.
Salfit: Israeli forces
have continued to impose severe restrictions on the movement of Palestinian
civilians. At approximately 08:50 on
Sunday, 15 September 2013, Israeli forces established a checkpoint at the
western entrance of Marda village, north of Salfit. They stopped and searched Palestinian
civilian vehicles. At approximately
18:45, Israeli forces established a checkpoint at the entrance of Deir Ballout
village, west of Salfit. They stopped
and searched Palestinian civilian vehicles.
At approximately 14:50 on Monday, 16 September 2013, Israeli forces
established a checkpoint at the entrance of Kufor al-Dik village, west of
Salfit. They stopped and searched
Palestinian civilian vehicles.
5. Settlement activities and attacks by settlers against Palestinian
civilians and property
At approximately 06:00 on Thursday, 12 September 2013,
Israeli forces accompanied by 2 bulldozers moved into the eastern Barta’a
village, that is isolated due to the annexation wall, west of Jenin. They
declared the area as military closed area. The bulldozers started demolishing 4
civilian facilities. In the meantime, a number of young men gathered and threw
stones at the Israeli vehicles. Israeli soldiers fired sound bombs and tear gas
canisters at the stone throwers. The Israeli forces finished the demolition of
the 4 facilities and withdrew later.
The demolished facilities were:
1. A 600-square-meter under construction compound
consisting of 10 commercial stores belonging to Hamza Ibrahim Qabha;
2. An auto repair shop and a barrack to manufacture
marble belonging to Mohammed Hassan Qabha; and
3. An auto repair shop belonging to Samer Rabah Qabha.
Around the same time, Israeli bulldozers levelled many
dunums of agricultural lands that are part of Ezbet Jal’oud, Ras Atiya and
Magharet al-Dab’ah villages, south of Qalqilia. They levelled nearly 5 dunums
belonging to civilians, who bought these lands 2 years ago, from Kofur Tholth,
Tamoun and Qalqilia. Zaher Mara’ba from Ras Atiya village council said that Israeli
bulldozers uprooted the trees and plants and confiscated them. The lands were
planted with olive, avocado, guava, nuts, Jujube and citrus.
Salim Mahmoud Bsharat (45) said to PCHR’s fieldworker:
“My name is Salim Mahmoud Bsharat (45) and I am
from Tamoun village. I live in Qalqilia. I bought a piece of land called
Khellet al-‘Ashra 2 years ago from its owner who live in Ras Atiya village. I
planted the land with 8-year-old trees. My land is called as a garden as it is
full olive, citrus, avocado, guava, jujube, cactus, peach, apricot and apple
trees. At approximately 06:00 on Thursday, 12 September 2013, an heir of land’s
former owner called me and told me that Israeli bulldozers had been levelling
my land. Less than an hour later, I reached my land and saw them uprooting and
stealing my own trees. I was raged for what I had seen. Moreover, an officer
told me that I had to demolish the room and bathroom that were in my land. I
refused to do so and told him to demolish them himself. I also said to him, ‘I
build and you demolish; I plant and you uproot. This is your business not
mine.’ He gave me a week as a time limit to demolish them under the pretext the
land belongs to the Israeli forces. Furthermore, they demolished a retaining wall
and damaged the fence and a water network used for irrigation.”
At approximately 19:10, on Thursday also,
Israeli forces distributed notices to halt contraction works in 2 houses in
Bruqin village, west of Salfit, under the pretext they were not licensed,
because they were located in the Israeli controlled area (C). The houses belong
to:
Mohammed
Salim Barakat (35), who has a 6-member family. His house consistes of 2 floors;
and
Mohammed
Abdul Fatah Samara (75), who has an 8-member family. His house consists of 1
floor.
On Sunday morning, 15 September 2013, a group of
settlers from “Yitzhar” settlement that is established on lands of
Madamad village, south of Nablus, set fire to an under construction house
belonging to Ra’ed Jadallah Nassar. The 120-sqaure-meter house is located in
the northern mountain area.
According to investigation conducted by PCHR, at
approximately 09:00, on the abovementioned day, while Ra’ed, who is a
headmaster of Madama school, was at work, he received a phone call from his
brother telling him that some settlers had set fire to his under construction
house in the northern mountain area. The house is about 900 meters away from
the bypass road and is 1,500 meters away from the aforementioned settlement. Construction equipment, wood, electricity
generator, a TV set, a PC set, loudspeaker, 2 water tanks and water and
electricity networks all caught fire.
On Monday, 16 September 2013, settlers from “Eliezer”
and “Daniel” settlements that are established on lands of al-Khader
village, south of al-Kahder village, south of Bethlehem, moved into Zaqandah
area, south of the village. They damaged the main gate of a potable water well
in a land belonging to Taha Ahmed Salah (55). They swam in the well and
polluted the water. Moreover, they performed Talmudic rituals there. Ahmed
Salah, coordinator of the popular committee against settlement activities, said
to PCHR’s fieldworker that settlers walked through lands and performed their
rituals under the trees.
At approximately 04:45 on Monday, 16 September 2013,
Israeli forces backed with 10 military vehicles and 3 bulldozers stormed
Makhoul area to the north of Tubas town in the northern Jordan Valley. They immediately started demolishing a
Palestinian residential community where 10 Palestinian families of farmers and
shepherds, comprised of 48 individuals, including 17 children, live. In this operation, Israeli forces demolished
12 tents and tin-made houses, a number of subordinate kitchens and mobile
bathrooms and 28 barnyards.
Demolitions in Makhoul area were as follows:
1. The
family of Mohammed Ali Bisharat: A mobile bathroom, a 30-square-meter kitchen,
a 160-square-meter tent, an 80-square-meter animal barrack and a 170-meter-long
animal farm were demolished, and 5 individuals, including 3 children, were
rendered homeless.
2. The
family of Younis Mohammed Abu Hilaw (Daraghma): A mobile
bathroom, a 20-square-meter kitchen, a 72-square-meter housing barrack, an
80-square-meter animal barrack and a 200-meter-long animal farm were
demolished, and 4 individuals were rendered homeless.
3. The
family of Ahmed Khalaf Bani Ouda: A mobile bathroom, a 25-square-meter kitchen,
a 60-square-meter housing barrck, a 40-square-meter animal barrack, an
80-square-meter animal barrack, a 150-meter-long animal farm and a
30-square-meter store were demolished, and 3 individuals were rendered
homeless.
4. The
family of Mohammed Younis Abu Hilwa (Daraghma): A mobile
bathroom, a 20-square-meter kitchen, an 84-square-meter house, an
80-square-meter animal barrack and a 200-meter-long animal farm, and 4
individuals were rendered homeless.
5. The
family of Burhan Hussein Bisharat: A mobile bathroom, a 16-square-meter kitchen,
3 30-square-meter housing barracks, a 250-square-meter animal barrack, an
300-meter-long animal farm and a 36-square-meter bird farm were demolished, and
10 individuals, including 8 children, were rendered homeless.
6. The
family of Mahmoud Ali Bisharat: A mobile bathroom, a 20-square-meter kitchen,
a 60-square-meter house, a 60-square-meter animal barrack, and a 100-meter-long
animal farm were demolished, and 4 individuals were rendered homeless.
7. The
family of Ahmed Abdullah Bani Ouda: A mobile bathroom, a 25-square-meter kitchen,
a 60-square-meter house, an 80-square-meter animal barrack, a 25-square-meter
animal barrack, and a 60-meter-long animal farm were demolished, and 5 individuals
were rendered homeless.
8. The
family of Ashraf Hussein Bisharat: A 36-square-meter house, a 110-square-meter
animal barrack and a 60-meter-long animal farm were demolished, and 3
individuals, including a child, were rendered homeless.
9. The
family of Yousef Hussein Bisharat: A mobile bathroom, a 20-square-meter kitchen,
a 60-square-meter house, a 150-meter-long animal barrack, a 120-meter-long
animal farm, a 200-square-meter animal farm and a 10-square-meter bird tent
were demolished, and 7 individuals, including 5 children, were rendered
homeless.
10. The
family of Hussein Ahmed Bisharat: A mobile bathroom, a 30-square-meter kitchen,
a 72-square-meter housing tent and 250-square-meter animal barrack were
demolished, and 2 individuals were rendered homeless.
11. Khalaf
Ahmed Bani Ouda: a
Peugeot (305) vehicle was confiscated.
· In the same context, on Tuesday, 17 September 2013,
Israeli forces forced dozens of Palestinian families in al-Burj and al-Maytah
area in the northern Jordan Valley to evacuate the area under the pretext of
military training. Local sources stated that Israeli forces closed the
abovementioned area and Tayaseer military checkpoint, after which they started
evacuate the area from dozens of families that live in tents. It should be
noted that Israeli forces had notified those families on 10 September 2013 to
evacuate the area under the pretext of military training.
Recommendations to the International Community
PCHR emphasizes the international community’s position
that the Gaza Strip and the West Bank, including East Jerusalem, which is still
under the Israeli occupation, in spite of the Israeli military redeployment
outside the Gaza Strip in 2005. PCHR further confirms that Israeli force have
continued to impose collective punishment measures on the Gaza Strip, which
have escalated since the 2006 Palestinian parliamentary elections, in which
Hamas won the majority of seats of the Palestinian Legislative Council. PCHR
stresses that there is an international recognition of Israel’s obligation to
respect international human rights instruments and the international
humanitarian law, especially the Hague Regulations concerning the
Laws and Customs of War on Land and the
Geneva Conventions. Israel is bound to apply the international human rights law
and the law of war sometime reciprocally and other times in parallel in a way
that achieves the best protection for civilians and remedy for victims.
In light of continued arbitrary measures, land
confiscation and settlement activities in the West Bank, and the continued
aggression against civilians in the Gaza Strip, especially the latest offensive
that lasted for 8 days in November, PCHR calls upon the international community,
especially the United Nations, the High Contracting Parties to the Geneva
Convention and the European Union – in the context of their natural obligation
to respect and enforce the international law – to cooperate and act according
to the following recommendations:
1. PCHR calls upon the international community and the
United Nations to use all available means to allow the Palestinian people to
enjoy their right to self-determination, through the establishment of the
Palestinian State, which was recognized by the UN General Assembly with a vast
majority, using all international legal mechanisms, including sanctions to end
the occupation of the State of Palestine;
2. PCHR calls upon the United Nations to provide
international protection to Palestinians in the oPt, and to ensure the
non-recurrence of aggression against the oPt, especially the Gaza Strip;
3. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to compel Israel, as a High Contracting Party to the
Conventions, to apply the Conventions in the oPt;
4. PCHR calls upon the Parties to international human
rights instruments, especially the Covenant on Civil and Political Rights and
the Covenant on Economic, Social and Cultural Rights, to pressurize Israel to
comply with their provisions in the oPt, and to compel it to incorporate the
human rights situation in the oPt in its reports submitted to the concerned
committees;
5. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to fulfil their obligation to ensure the application of the
Conventions, including extending the scope of their jurisdiction in order to
prosecute suspected war criminals, regardless of the nationality of the perpetrator
and the place of a crime, to pave the way for prosecuting suspected Israeli war
criminals and end the longstanding impunity they have enjoyed;
6. PCHR calls on States that apply the principle of
universal jurisdiction not to surrender to Israeli pressure to limit universal
jurisdiction to perpetuate the impunity enjoyed by suspected Israeli war
criminals;
7. PCHR calls upon the international community to act in
order to stop all Israeli settlement expansion activities in the oPt through
imposing sanctions on Israeli settlements and criminalizing trading with them;
8. PCHR calls upon the UN General Assembly to transfer
the Goldstone Report to the UN Security Council in order to refer it to the
International Criminal Court in accordance with Article 13(b) of the Rome
Statute;
9. PCHR calls upon the United Nations to confirm that
holding war criminals in the Palestinian-Israeli conflict is a precondition to
achieve stability and peace in the regions, and that peace cannot be built on
the expense of human rights and victims;
10. PCHR calls upon the UN General Assembly and Human
Rights Council to explicitly declare that the Israeli closure policy in Gaza
and the annexation wall in the West Bank are illegal, and accordingly refer the
two issues to the UN Security Council to impose sanctions on Israel to compel
it to remove them;
11. PCHR calls upon the international community, in light
of its failure to the stop the aggression on the Palestinian people, to at
least fulfil its obligation to reconstruct the Gaza Strip after the series of
hostilities launched by Israel which directed targeted the civilian
infrastructure;
12. PCHR calls upon the United Nations and the European
Union to express a clear position towards the annexation wall following the
international recognition of the State of Palestine on the 1967 borders, as the
annexation wall seizes large parts of the State of Palestine;
13. PCHR calls upon the European Union to activate Article
2 of the EU-Israel Association Agreement, which provides that both sides must
respect human rights as a precondition for economic cooperation between the EU
states and Israel, and the EU must not ignore Israeli violation and crimes
against Palestinian civilians;
14. PCHR calls upon the Palestinian leadership to sign and
accede to the Rome Statute of the International Criminal Court and the Geneva
Conventions, and calls upon the international community, especially the United
Nations, to encourage the State of Palestine to accede to international human
rights law and humanitarian law instruments.
