Summary
Israeli violations of international law and
international humanitarian law in the oPt continued during the reporting period
(07 – 13 November 2013).
Shooting:
During the reporting period, Israeli forces killed 2
Palestinian civilians and wounded 7 others, including 2 children, in the West
Bank and the Gaza Strip.
In the West Bank, in an excessive use of force, on 07
November 2013, Israeli forces killed 2 Palestinian civilians at Za’tara
checkpoint, south of Nablus, and the Container checkpoint, northeast of
Bethlehem, in the West Bank.
On 11 November 2013, a Palestinian child was wounded
by Israeli forces during a demonstration organized in Nabi Saleh village,
northwest of Ramallah, in commemoration of the 9th anniversary of
President Yasser. On the same day, a
child was also wounded in Hebron.
During the reporting period, Israeli forces continued
the systematic use of excessive force against peaceful protests organised by
Palestinian, Israeli and international activists against the construction of
the annexation wall and settlement activities in the West Bank. As a result, dozens
of civilians suffered tear gas inhalation, and others sustained bruises.
In the Gaza Strip, on 10 November 2013, a Palestinian
fisherman was wounded by Israeli forces in the northern Gaza Strip.
On 13 November 2013, 2 Palestinian civilians were
wounded by Israeli forces in border areas in the southern and central Gaza
Strip.
In the context of targeting fishermen in the sea,
Israeli gunboats stationed in the sea opened fire at Palestinian fishing boats 4
times, during which the abovementioned fisherman was wounded and fishing boat
was confiscated. Israeli forces also
detained 2 fishermen for one day.
Incursions:
During the reporting period, Israeli forces conducted
at least 68 military incursions into Palestinian communities in the West Bank. During
these incursions, Israeli forces arrested at least 46 Palestinians, including 8
children and number of political leaders of Hamas.
In the Gaza Strip, Israeli forces conducted an
incursion into the central Gaza Strip on 13 November 2013, during which they
levelled areas of Palestinian land.
Restrictions on movement:
Israel continued to impose a tightened closure of the
oPt, imposing severe restrictions on the movement of Palestinian civilians in
the Gaza Strip and the West Bank, including occupied East Jerusalem.
The illegal closure of the Gaza Strip, which has steadily
tightened since June 2007 has had a disastrous impact on the humanitarian and
economic situation in the Gaza Strip.
The Israeli authorities impose measures to undermine the freedom of
trade, including the basic needs for the Gaza Strip population and the
agricultural and industrial products to be exported. For 7 consecutive years,
Israel has tightened the land and naval closure to isolate the Gaza Strip from
the West Bank, including occupied Jerusalem, and other countries around the
world. This resulted in a grave violation of the economic, social and cultural
rights and a deterioration of living conditions for 1.7 million people. The Israeli authorities has established Karm
Abu Salem (Kerem Shaloum) as the sole crossing for imports and exports in order
to exercise its control over the Gaza Strip’s economy that has been aggravating
for years due to the shortage of imports.
They also aim at imposing a complete ban on the Gaza Strip’s
exports.
Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians throughout the West Bank,
including occupied East Jerusalem. Thousands of Palestinian civilians from the
West Bank and the Gaza Strip continue to be denied access to Jerusalem.
As part of using military checkpoints and border
crossings as traps to arrest Palestinian civilians under the pretext they are
wanted, Israeli forces arrested at least 10 civilians, including 5 children and
woman, in the West Bank.
Israel has
continued its settlement activities in the oPt, a direct violation of
international humanitarian law, and Israeli settlers have continued to attack
Palestinian civilians and property.
On 07 November 2013, a number of Israeli settlers from
“Havat Gal” settlement, east of Hebron, set fire to 2 cars belonging to
Palestinian civilians in al-Jalajel village, east of Hebron. They also wrote
“In solidarity with Beit Ain settlement” on walls of houses in the
village. Losses in the 2 cars are estimated
at 7,000 NIS (approximately US$ 2,000).
On 08 November 2013, dozens of Israeli settlers living
in settlement located near Taqqou’ village, southeast of Bethlehem, closed the
western entrance of the village, claiming that stones and Molotov cocktails
were thrown at a settler’s car. The
settlers raised the Israeli flag and organized a march in the area.

forced Samer Mahmoud Za’tara to demolish his house in application of a decision
by the Israeli municipality of Jerusalem, claiming that the house was built
without a license.

Thursday, 07 November 2013
At approximately 00:00, Israeli forces moved into
Bal’a village, northeast of Tulkarm.
They patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 01:00, Israeli forces moved into al-‘Arroub
refugee camp, north of Hebron. They
patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 02:00, Israeli forces moved into
al-Fawar refugee camp, south of Hebron.
They raided and searched two houses belonging to the families of Waleed
Tawfiq al-Wawi, 22, and Waleed Fayez al-Wawi, 21, and arrested both of them.
At approximately 02:30, Israeli forces moved into
Tulkarm. The patrolled the streets and
at approximately 03:30, they raided a house belonging to the family of
al-Mo’teassen Billah Abdullah Jaroushi, 26, in al-Sawana neighbourhood, and
questioned him on the spot. They
withdrew later and no arrests were reported.
Also at approximately 02:30, Israeli forces moved into
Yatta village, south of Hebron. They
patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 03:00, Israeli forces moved into
Madama village, south of Nablus. They
raided and searched a number of houses and arrested Ihsan Ali Nassar, 30, and
arrested him.
Also at approximately 03:00, Israeli forces moved into
Beita village, southeast of Nablus. They
raided and searched a number of houses and arrested Saleh Tayseer Kharyoush,

At approximately 04:00, Israeli forces moved into Beit
Ummar village, north of Hebron. They
raided and searched a house belonging to Ahmed Khalil Abu Hashem, 46. They broke the door and searched the
house. Israeli soldiers attacked Abu
Hashem and his wife when they protest this violent house raid. Israeli soldiers
then forced the family out. Before
leaving, Israeli soldiers arrested Abu Hashem’s son, 22-year-old Yousef, and
notified his other son, 24-year-old Tha’er, to refer to the Israeli
intelligence service in “Gush Etzion” settlement, south of Bethlehem. In the meantime, other Israeli soldiers
raided and searched a house belonging to Hisham Khalil Abu Maria, 48, and
delivered summonses to his two sons to refer to the Israeli intelligence
service in “Gush Etzion” settlement. At
approximately 05:00, Israeli forces raided a house belonging to Jamal Khalil
Abu Maria and delivered to him a summons for his son, 22-year-old Eassam, to
refer to the Israeli intelligence service in “Gush Etzion” settlement. While Israeli forces were leaving the village,
a number of Palestinian boys gathered and threw stones at Israeli military
vehicles. Immediately, Israeli soldiers fired
tear gas canisters and sound bombs at them.
As a result, a number of civilians suffered tear gas inhalation.
At approximately 05:00, Israeli gunboats stationed
opposite to the northern Gaza Strip beach opened fire at Palestinian fishing
boats that were sailing 4 nautical miles offshore. Palestinian fishermen were forced to sail
back to the beach and no casualties were reported.
At approximately 10:00, Israeli forces moved into
‘Arraba village, southwest of Jenin.
They patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 15:00, Israeli forces moved into
Zabbouba village, northwest of Jenin. They
patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 17:00, Israeli forces moved into
Shwaika suburb, north of Tulkarm. They
patrolled the streets for some time and withdrew later. Neither house raids nor arrests were
reported.
In the evening, Israeli forces killed 2 Palestinian
civilians at Za’tara checkpoint, south of Nablus.
According to investigations conducted by
PCHR, at
approximately 18:00 on Thursday, 07 November 2013, Basheer Sami Salem Habnain,
29, from Marka village south of Jenin, was traveling in a taxi from Ramallah to
Nablus. When he became 20 meters far from Za’tara intersection, south of
Nablus, he stepped down from the taxi and crossed the main road towards the
other side. He was carrying a box of fireworks, from which flares were
unleashed. Soon, an Israeli soldier descended from a military observation
tower and fired directly at Habnain, killing him with 7 bullets to the legs and
thighs and an 8th one which entered the back and exited the
chest. Israeli forces kept the victim’s body until 03:00 on Friday, 08
November 2013, when they handed the body to the Palestinian liaison
department. The victim was a lecturer at the fashion department in
Palestine Technical University (Kadoorie) in Tulkarm.
Israeli forces
claimed that “Habnain was carrying a flare gun, from which he fired at
soldiers, so the soldiers responded by firing at him, and he was instantly
killed.” A video clip published on Youtube shows an Israeli soldiers
descending from an Israeli military observation tower to the southeast of
Za’tara checkpoint, and then firing at the area to the southwest of the
checkpoint. Another 2 soldiers are seen in the video clip coming from the
checkpoint. Even according to the Israeli narrative, Israeli forces could
have used less lethal means against the victims, such as arresting him.
In a
similar crime, at approximately 21:30, Isma’il Fu’ad Refa’ei al-Atrash, 25, and
his brother Anas, 23, arrived at the Container checkpoint, northeast of
Bethlehem, traveling from Jericho to their home in Hebron. They were
traveling in a civilian car driven by Isma’il. When they arrived at the
checkpoint, Isma’il slowed down to cross road bumps. Anas opened the
door, and once he stepped down, Israeli soldiers shot him dead with 2 bullets
to the chest. Israeli soldiers took Anas’ body and put it in a plastic
sac near the checkpoint. Residents of the area and a number of members of
the victim’s family arrived at the checkpoint and skirmishes erupted between
them and Israeli soldiers. Later, the family received Anas’ body.
Israeli forces claimed that “the young man attempted to stab a soldier, so
the latter fired at him directly, killing him.” According to
Palestinian medical sources, the victim was hit by a bullet to the chest.

At approximately 01:00, Israeli forces moved into the
southern area of Hebron. They raided and
searched a house belonging to Zuhair Abu Maizar, 48, and arrested his two sons:
Majed, 22; and Diaa’, 21.
At approximately 01:30, Israeli forces moved into Beit
Ummar village, north of Hebron. They
raided and searched a house belonging to the family of Suhaib Jameel Abu Maria,
22, and arrested him.
Also at approximately 01:30, Israeli forces moved into
al-Fawar refugee camp, south of Hebron.
They patrolled the streets for some time and withdrew later. Neither
house raids nor arrests were reported.
At approximately 02:00, Israeli forces moved into Beit
‘Awa village, southwest of Hebron. They
patrolled the streets for some time and withdrew later. Neither house raids nor

At approximately 03:00, Israeli forces moved into
al-Sammou’ village, south of Hebron.
They patrolled the streets for some time and withdrew later. Neither

At approximately 10:00, Israeli forces moved into
Jenin. They raided and searched a house
belonging to Ghassan Abdul Wahab al-Zughaibi, 40, a leader of Hamas. They arrested him and confiscated his mobile
phone and computer. Soon after, they
raided and searched a house belonging to the family of Sameer Mahdi Abu
al-Hassan, 24, and arrested him.
At approximately 15:00, Israeli forces moved into Bab
al-Zawia area in the center of Hebron. A number of Palestinian boys gathered
following the funeral procession of Anas al-Atrash, who was killed by Israeli
forces on Thursday, and threw stones and empty bottles at Israeli
soldiers. The soldiers chased the boys
and fired rubber-coated metal bullets, tear gas canisters and sound bombs at
them. A number of civilians suffered
tear gas inhalation.
At approximately 18:30, Israeli forces moved into
Magharat al-Dab’a village, south of Qalqilya.
They raided and searched a number of houses and arrested ‘Othman Abdul
Qader ‘Ouda, 48, and his two sons: Eihab, 28; and Mahyoub, 22.
Saturday, 09 November 2013
At approximately 01:50, Israeli forces moved into
Salfit. They raided a house belonging to
the family of Rami Fawzi Rammal, 20, and delivered him a notice to refer to the
Israeli intelligence service.
At
approximately 02:00, Israeli forces moved into Jabal Jouhar area in the south
of Hebron. They raided and searched a
house belonging to the family of Wajeeh ‘Atiya al-Zaru, 30, and arrested him.
At
approximately 02:30, Israeli forces moved into Taqqou’ village, southeast of
Bethlehem. They raided and searched a
house belonging to Fu’ad Tayseer Sabbah and arrested his two sons: Ibrahim, 20;
and Marwan, 20.
Also at
approximately 03:30, Israeli forces moved into Sourif village, northwest of
Hebron. They raided and searched a house
belonging to the family of Mustafa Nayef Ghunaimat, 27, and arrested him.
Also at
approximately 03:30, Israeli forces moved into al-‘Arroub refugee camp, north

house belonging to the family of Ziad Hakam al-Jinzara, 19, and arrested him.
At
approximately 04:00, Israeli gunboats stationed opposite to Beit Lahia seashore
in the northern Gaza Strip opened fire at Palestinian fishing boats that were
sailing 5 nautical miles offshore. Israeli
naval forces also cut fishing nets belonging to a number of fishermen. Palestinian fishermen were terrified and were
forced to sail back to the beach. No
casualties were reported.
At
approximately 06:00, Israeli forces moved into Kufor Dan village, northwest of
Jenin. They raided and searched a house
belonging to the family of Rakiz Yousef Salah, 31, a member of the Palestinian
National Security Forces, and arrested him.
At
approximately 17:00, a number of Palestinian boys gathered, set fire to tires
and threw stones at Israeli soldiers positioned at Checkpoint (56) at the
entrance of al-Shuhada Street in the center of Hebron. Immediately, Israeli soldiers fired
rubber-coated metal bullets, tear gas canisters and sound bombs at them. As a result, a number of civilians suffered
tear gas inhalation.
At
approximately 19:00, Israeli forces moved into Hijja village, east of
Qalqilya. They patrolled the streets for
some time and withdrew later. Neither house raids nor arrests were reported.
At approximately
22:15, Israeli forces moved into Rafat village, west of Salfit. They patrolled the streets for some time and

Sunday, 10
November 2013
At
approximately 01:00, Israeli forces moved into Bethlehem. They raided a house belonging to the family
of Rakan Salem Salahat in Wad Ma’ali neighbourhood in the center of the town
and delivered him a notice to refer to the Israeli intelligence service in
“Gush Etzion” settlement bloc, south of the town.
Also at
approximately 01:00, Israeli forces moved into Ya’bad village, southwest of
Jenin, and patrolled the streets. A
number of Palestinian boys gathered and threw stones at Israeli military
vehicles. In response, Israeli soldiers
fired tear gas canisters and sound bombs at them. Israeli forces withdrew later and neither
house raids nor arrests were reported.

approximately 01:00, Israeli forces moved into Beer al-Basha village, south of
Jenin. They patrolled the streets for

Hebron. They patrolled the streets for

approximately 02:30, Israeli forces moved into al-Sarra village, southwest of
Hebron. They patrolled the streets for
some time and withdrew later. Neither house

At
approximately 03:10, Israeli forces moved into Taqqou’ village, southeast of
Bethlehem. They raided and searched 2
houses belonging to the families of Mohammed Khalifa Jararha, 16, and Mohammed
Ali Abu Sarhan, 16, and arrested both of them.
At
approximately 09:30, Israeli gunboats stationed opposite to Beit Lahia seashore
in the northern Gaza Strip opened fire at Palestinian fishing boats that were
sailing 3 nautical miles offshore. Two
gunboats surrounded a fishing boat.
Saddam Saleh Abu Warda, 23, and his brother Mahmoud, 18, were on
board. Israeli soldiers ordered both
fishermen to jump into the water and swim towards one of the gunboats, but they
refused. Immediately, Israeli soldiers
fired at the boat, wounding Mahmoud with shrapnel to the abdomen. Israeli soldiers called another 2
gunboats. They then forced the two
fishermen to move onto one of the gunboats.
Israeli soldiers provided Mahmoud with first medical aid, and the boat
moved northwards to Israel. They also
pulled the fishing boat. The two
fishermen were interrogated inside Israel and were released in the evening at
Beit Hanoun (Erez) crossing in the northern Gaza Strip.
At
approximately 10:20, Israeli forces moved into al-Yamoun village, northwest of
Jenin. They patrolled the streets for
some time and withdrew later. Neither
house raids nor arrests were reported.
At
approximately 12:30, Israeli forces moved into Seilat al-Harthiya village,
north of Jenin, and patrolled the streets. A number of young men gathered and threw
stones at Israeli military vehicles.
Immediately, Israeli soldiers fired tear gas canisters and sound bombs
at them. As a result, a number of
Palestinian civilians suffered tear gas inhalation. Israeli forces withdrew later and no more
incidents were reported.
At
approximately 15:00, Israeli forces moved into ‘Eissi neighbourhood in the west
of Hebron and patrolled the streets.
They stopped Palestinian civilian vehicles and questioned a number of
civilians. They delivered summonses to
Ayoub al-‘Owaiwi and Firas Shaheen to refer to the Israeli intelligence service
in “Gush Etzion” settlement, south of Bethlehem. Israeli forces then moved to al-Sha’rawi
intersection, where they stopped and searched Palestinian civilian
vehicles. They withdrew later and no
more incidents were reported.
At
approximately 18:30, Israeli forces moved into al-Zawia village, south of
Jenin. They raided a house belonging to
Fawaz Mahmoud Jarrar and questioned him about his son, 27-year-old Hakeem, who
was not home at the time. They withdrew
later and no arrests were reported.
Monday, 11 November 2013
· At approximately 01:30, Israeli forces moved into
Nablus. They raided and searched a
number of houses and arrested 3 Palestinians, including a child:
1. ‘Aassem Mustafa al-Shinnar, 16;
2. Baraa’ Ghassan Thouqan, 18; and
3. Yazan Sameer al-Nouri, 18.
At
approximately 02:00, Israeli forces moved into Beit Liqya village, southwest of
Ramallah. They raided and searched 2
houses belonging to the families of Majd Na’el ‘Aassi, 22, and Rabah Rebhi
‘Aassi, 22, and arrested both of them.
Also at
approximately 02:00, Israeli forces moved into Tulkarm. They raided and searched a house belonging to
the family of Omar Mustafa Budair, 31, a member of Hamas, and arrested him.
At
approximately 03:15, Israeli forces moved into Taqqou’ village, southeast of
Bethlehem. They raided and searched a
number of houses and arrested 4 Palestinians:
1. Omar Suleiman al-‘Omour, 18;
2. Ahmed Mohammed al-‘Omour, 18;
3. Ma’ath Ibrahim al-‘Omour, 18; and
4. Bahaa’ ‘Aaref al-‘Omour, 18.
At
approximately 03:55, Israeli forces moved into Bethlehem. They raided a house
belonging to the family of Ahmed Ibrahim Obaidallah, 27, and delivered to him a
summons to refer to the Israeli intelligence service in “Gush Etzion”
settlement.
At
approximately 04:45, Israeli forces moved into Ya’bad village, southwest of
Jenin. They raided and searched a house
belonging to the family of Fares ‘Aatef Abu Bakr, 24, and arrested him.
At
approximately 07:30, a number of schoolchildren gathered at the western
entrance of Taqqou’ village, southeast of Bethlehem, to organize a
demonstration for the anniversary of the late President Yasser Arafat’s
death. They threw stones at Israeli
soldiers in the area, who responded by firing tear gas canisters.
At
approximately 09:00, an Israeli infantry unit moved into Hebron. A number of Palestinian boys gathered and
threw stones and empty bottles at Israeli soldiers who responded by firing tear
gas canisters and sound bombs at them.
As result, a 15-year-old child was hit by a tear gas canister to the
head, which caused 3 fractures to the skull.
His condition was described by medical sources as stable.
At
approximately 10:00, Israeli forces moved into Bab al-Zawia area in the center
of Hebron. A number of Palestinian boys
gathered and threw stones at Israeli soldiers who fired rubber-coated metal
bullets, tear gas canisters and sound bombs at them. As a result, a number of civilians suffered
tear gas inhalation.
At
approximately 11:30, a number of Palestinian boys gathered and threw stones at
Israeli soldiers positioned at the entrance of al-‘Arroub refugee camp, north
of Hebron. Immediately, Israeli soldiers
fired tear gas canisters and sound bombs at them. At approximately 16:00, Israeli forces moved
into the camp and a number of boys threw stones at them. In response, Israeli soldiers fired
rubber-coated metal bullets, tear gas canisters and sound bombs at the boys. Israeli forces remained in the camp until
23:00.
At approximately
12:30, Israeli forces moved into Farkha village, southwest of Salgit. They patrolled the streets for some time and
withdrew later. Neither house raids nor
arrests were reported.
At
approximately 14:30, Israeli forces moved into Qalqilya. They arrested 2 Palestinian children who were
near the annexation wall, but released them at 17:00. The children are: Nour ‘Adnan ‘Aabed, 13; and
‘Ali Mohammed Abu Tabeekh, 12.

approximately 16:00, Israeli forces moved into Muthallath al-‘Aqaba village,
southwest of Hebron. A number of

At
approximately 01:00, Israeli forces moved into Yatta village, south of
Hebron. They patrolled the streets for
some time and withdrew later. No arrests were reported.
At
approximately 01:30, Israeli forces moved into Nablus. They raided and searched a house belonging to
the family of Mohammed Harazallah, 23, in the old town and arrested him.
At
approximately 01:35, Israeli forces moved into ‘Azzoun village, east of
Qalqilya. They raided and searched a
number of houses and arrested 6 Palestinians:
1. Ali Saleh Swaidan, 24;
2. Abdul Hadi Mohammed Shbaita, 28;
3. Mousa Bassem Saleem, 24;
4. ‘Orwa Abdul Salam Radwan, 21;
5. Mohammed Mustafa Khirfan, 19; and
6. Mahmoud Yousef Hilal, 21.
At
approximately 01:45, Israeli forces moved into Taqqou’ village, southeast of
Bethlehem. They raided and searched a
number of houses and arrested 4 Palestinian children:
1. Anas Mahmoud Khalifa, 16;
2. Fadi Shafiq Abu Sarhan, 16;
3. Mohammed Ezzat Abu Sarhan, 15; and
4. Mohammed Ameen Abu Sarhan, 16.
At
approximately 02:00, Israeli forces moved into Beit Liqya village, southwest of
Ramallah. They raided and searched a
house belonging to the family of Qassam Hussein Badr, 20, and arrested him. They also confiscated his laptop, 2 hard
disks and mobile phone.
Also at
approximately 02:00, Israeli forces moved into al-Zahiriya village, south of
Hebron. They patrolled the streets for
some time and withdrew later. No arrests were reported.
Also at
approximately 02:00, Israeli forces moved into Wad al-Hariya neighbourhood in
the center of Hebron. They patrolled the
streets for some time and withdrew later. No arrests were reported.
At
approximately 02:20, Israeli forces moved into Dar Salah village, east of Bethlehem. They raided a house belonging to the family
of Tha’er Ghazi Salah, 19, and delivered to him a summons to refer to the
Israeli intelligence service in “Gush Etzion” settlement, south of the town.
At
approximately 14:30, Israeli gunboats opened fire at Palestinian fishing boats
opposite to Khan Yunis seashore in the southern Gaza Strip. The gunfire continued sporadically until
04:00 on the following day, but no casualties were reported.
Wednesday, 13 November 2013
At
approximately 01:00, Israeli forces moved into al-Shyoukh village, east of
Hebron. They patrolled the streets for
some time and withdrew later. No arrests were reported.
Also at
approximately 01:00, Israeli forces moved into al-‘Arroub refugee camp, north
of Hebron. They patrolled the streets
for some time and withdrew later. No arrests were reported.
At
approximately 03:00, Israeli forces moved into al-Fawar refugee camp, south of
Hebron. They patrolled the streets for some time and withdrew later. No arrests
were reported.
At approximately 07:00, Israeli forces, accompanied
with 4 bulldozers, moved nearly 200 meters into Gaza Valley village in the
central Gaza Strip. They levelled areas
of Palestinian land. They moved back to the
border 2 and a half hour later.
Also at approximately 07:00, Israeli forces moved into
the area located between Beit Awa and Ethna villages, south of Hebron. They patrolled the area for some time and
withdrew later. No arrests were
reported.
At approximately 10:50, Israeli forces positioned at
the border between the Gaza Strip and Israel fired at a person in civilian
clothes who got as close as to 80 meters from the border to the east of
al-Qarara village, northeast of Khan Yunis, wounding him with a bullet to the
right leg. Following coordination
through the ICRC, medical crew were able to attend him and evacuate him to
Nasser Hospital in Khan Yunis. He was
identified as Ashraf Fayez Abu Zaher, 23, from Wadi al-Salqa village.
Following the killing of an Israeli soldier in Affoula
inside Israel, at noon, Israeli forces moved into Beer al-Basha village, south
of Jenin, and declared it a closed military zone. They raided and searched a house belonging to
the family of Hussein Shareef Ghawawda, 16, who stabbed the soldiers and who
was arrested by Israeli forces. Only the
mother, her sick son, 18-year-old Tawfiq, and her child, 11-year-old Rania,
were at home. Israeli forces questioned
the mother and order her to call all her sons in order to surrender to
them. Israeli forces remained in the
village for several hours. In the same
context, Israeli forces arrested Ghawawda’s father, Shareef Hussein Ghawawda,
54, from his work place in Kfar Saba inside Israel.
At approximately 14:45, Israeli forces positioned at
the border between the Gaza Strip and Israel to the east of al-Musaddar village
fired at a number of Palestinian farmers who were working nearly 500 meters
away from the border. As a result, Abdullah
Mohammed Abu Mnaifi, 25, was seriously wounded by a bullet to the chest.
At
approximately 16:00, Israeli forces moved into al-Sammou’ village, south of
Hebron. They patrolled the streets for
some time and withdrew later. No arrests were reported.
At approximately 16:30, Israeli forces into Bab
al-Zawia area in the center of Hebron. A
number of Palestinian boys gathered and threw stones at them. Immediately, Israeli soldiers fired
rubber-coated metal bullets, tear gas canisters and sound bombs at them. As a result, a number of civilians suffered
tear gas inhalation.
2. Use of excessive force against peaceful demonstrations protesting
settlement activities and the construction of the annexation wall
During the reporting period, Israeli soldiers used
excessive force against peaceful demonstrations organised by Palestinian
civilians, international and Israeli human rights defenders in protest at the
construction of the annexation wall and settlement activities in the West Bank.

Demonstrations against the construction of the
annexation wall and settlement activity
Following the Friday Prayer, 18 November 2013, dozens
of Palestinian civilians and international and Israeli human rights defenders
organised a peaceful demonstration in Bil’in, west of Ramallah, in protest at
the construction of the annexation wall and settlement activities.
Demonstrators took the streets raising the Palestinian flags and headed to the
liberated territories near the annexation wall. Israeli forces had closed all
the entrances of the village since morning to prevent the Palestinian and
international activists and journalists from participating in the
demonstration. Demonstrators marched adjacent to the cement wall and tried to
cross the fence before Israeli forces that are stationed behind the wall, in
the western area, and a large number of soldiers deployed along it fired live
bullets, tear gas canisters, rubber-coated steel bullets, sound bombs and skunk
water at them and chased them in olive fields. As a result, a number of
demonstrators suffered tear gas inhalation and others sustained bruises due to
being beaten up by Israeli soldiers.
On the same day, dozens of Palestinian civilians
organised a peaceful demonstration in the middle of Ni’lin village, west of
Ramallah, in protest at the construction of the annexation wall and settlement
activities. Demonstrators took the streets and headed to the annexation wall.
Israeli forces closed the gates of the wall with barbwires and prevented the
demonstrators from passing to the land behind it before they responded by
throwing stones. As a result, many civilians suffered tear gas inhalation and
bruises due to being beaten up by Israeli soldiers.
Around the same time, dozens of Palestinian civilians
and Israeli and international human rights defenders organised a peaceful
demonstration, in protest at the construction of the annexation wall and
settlement activities, in Nabi Saleh village, northwest of Ramallah.
Demonstrators took the streets raising the Palestinian flags and chanting
slogans against the occupation and in support of the Palestinian unity
resistance, and then they headed to the lands that the settlers are trying to
rob by force near “Halmish” settlement. Israeli
forces had closed all the entrances of the village since morning to prevent the
Palestinian and international activists and journalists from participating in the
demonstration. When they arrived at the land, the demonstrators were met by
live bullets, tear gas canisters, rubber-coated steel bullets, sound bombs and
skunk water and were chased into the village. As a result, a number of civilians
suffered tear gas inhalation and others sustained bruises due to being beaten
up by Israeli soldiers.
At approximately 12:30 on the same day, Palestinian civilians
and international activists organised a peaceful demonstration in the centre of
Kufor Qaddoum village, northwest of Qalqilia, and headed towards the eastern
entrance of the village, in protest at the continued closure of the entrance
with an iron gate, since the beginning of the Aqsa Intifada. Clashes erupted
between the demonstrators and Israeli forces that fired sound bombs and tear
gas canisters to prevent them from reaching the aforementioned gate. As a
result, a number of civilians suffered tear gas inhalation.
Following the Friday prayer, dozens of Palestinian
civilians and international and Israeli human rights defenders organised a
peaceful demonstration in Ma’assara village, in protest at the construction of
the annexation wall and settlement activities. The demonstration started in
front of the Candles Cultural Centre in the centre of the village.
Demonstrators moved in the streets raising the Palestinian flag. When they
arrived at the area where the annexation wall is established, Israeli forces
started firing tear gas canisters in attempt to disperse them and prevented the
demonstrators from reaching the annexation wall. A number of civilians suffered tear gas
inhalation.
Other Demonstrations
At approximately 08:30 on Monday, 11 November 2013,
dozens of Palestinian civilians gathered at the entrance of Nabi Saleh village,
northwest of Ramallah, to commemorate the 9th anniversary of
President Yasser Arafat’s death. They
threw stones at an Israeli military observation tower in the area. Immediately, Israeli soldiers fired
rubber-coated metal bullets, tear gas canisters and sound bombs at them. As a result, Mohammed Bassem Tamimi, 11, was
wounded by a rubber-coated metal bullet to the right side, and other civilians
suffered tear gas inhalation.
3. Continued closure of the oPt
Israel has continued to impose a
tightened closure on the oPt, imposing severe restrictions on the movement of
Palestinian civilians in the Gaza Strip and the West Bank, including occupied
East Jerusalem.
Gaza
Strip
Israeli
forces continuously tightens the closure of the Gaza Strip and closes all
commercial crossings , making the Karm Abu Salem crossing the sole commercial
crossing of the Gaza Strip, although it is not suitable for commercial purposes
in terms of its operational capacity and distance from markets.
Israeli
forces have continued to apply the policy, which is aimed to tighten the closure
on all commercial crossings, by imposing total control over the flow of imports
and exports.
The
total closure of al-Mentar (“Karni”) crossing since 02 March 2011 has
seriously affected the economy of the Gaza Strip. Following this closure, all
economic and commercial establishments in the Gaza Commercial Zone were shut
off. It should be noted that al-Mentar crossing is the biggest crossing in the
Gaza Strip, in terms of its capacity to absorb the flow of imports and exports.
The decision to close al-Mentar crossing was the culmination of a series of
decisions resulting in the complete closure of the Sofa crossing, east of the
Gaza Strip in the beginning of 2009, and the Nahal Oz crossing, east of Gaza
City, which was dedicated for the delivery of fuel and cooking gas to the Gaza
Strip, in the beginning of 2010.
Israeli
forces have continued to impose a total ban on the delivery of raw materials to
the Gaza Strip, except for very limited items and quantities. The limited
quantities of raw materials allowed into Gaza do not meet the minimal needs of
the civilian population of the Gaza Strip.
The
cooking gas crisis has ranged between the ebb and flow for 3 months due to the
closure of Karm Abu Salem for security reasons.
According to PCHR’s follow-up, Israeli authorities only allow around 98
tonnes of cooking gas into Gaza per day.
This limited quantity is less than half of the daily needs, which is 200
tonnes per day, of the civilian population in the Gaza Strip during the winter.
For almost 6 consecutive years,
Israeli forces have continued to prevent the delivery of construction materials
to the Gaza Strip. During the reporting period, Israeli forces approved the
delivery of limited quantities of construction materials for a number of
international organisations in the Gaza Strip.
Israeli forces also continued to impose almost total ban on the Gaza
Strip exports, including agricultural and industrial products, except for
light-weighted products such as flowers, strawberries, and spices.
Israel has continued to close the
Beit Hanoun (“Erez”) crossing for the majority of Palestinian citizens from the
Gaza Strip. Israel only allows the movement of a limited number of groups, with
many hours of waiting in the majority of cases. Israel has continued to adopt a
policy aimed at reducing the number of Palestinian patients allowed to move via
the Beit Hanoun crossing to receive medical treatment in hospitals in Israel or
in the West Bank and East Jerusalem. Israel denied permission to access
hospitals via the crossing for new categories of patients from the Gaza Strip.
For around a year and a half,
Israeli forces have allowed Palestinian detainees’ families to visit their sons
in the Israeli jails according to special and unfair conditions after more than
5 years of deprivation in violation of international humanitarian law.
The Egyptian authorities allow the
population of the Gaza Strip to travel via Rafah International crossing, which
connects the Gaza Strip with the outside world.
Only limited and specified categories are allowed, including patients,
students, persons that hold residencies in Egypt or abroad, men over 40 years,
females in all ages, children under 18, persons who hold Arab and foreign
nationalities, and members of Arab and international humanitarian
delegations. It should be mentioned that
the crossing opens seven days a week.
Nowadays, the crossing is overcrowded due to the prolonged procedures
from the Egyptian side, particularly after closing it for several days over the
past weeks due to Egypt’s security conditions, which has affected the
travellers’ movement in both directions.

Israel has
imposed a tightened closure on the West Bank. During the reporting period,
Israeli forces imposed additional restrictions on the movement of Palestinian
civilians:
• Hebron: Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians. At approximately 07:30 on Thursday, 07
November 2013, Israeli forces closed the entrance of Bani Na’im village, east
of Hebron. At approximately 08:00,
Israeli forces established another checkpoint at the entrance of Ezna village,
west of Hebron. At approximately 15:00,
another checkpoint was established at the entrance of Beit ‘Aynoun village,
northeast of Hebron. All checkpoints
were later removed, and no arrests were reported.
At
approximately 08:00 on Friday, 08 November 2013, Israeli forces established a
checkpoint at the entrance of Ethna village, west of Hebron. At approximately 14:00, another checkpoint
was established at the entrance of ‘Arroub refugee camp, north of the
city. At approximately 16:00, they
established a similar checkpoint at the eastern entrance of Halhoul, as this
entrance is connected with Bypass Road (60), north of the city. At approximately 19:00, another checkpoint
was established at the entrance of Bani Na’im village, southeast of
Hebron. All checkpoints were removed later,
and no arrests were reported.
At
approximately 07:00 on Sunday, 10 November 2013, Israeli forces established a
checkpoint at the entrance of ‘Arroub refugee camp, north of Hebron. The checkpoint was removed later, and no
arrests were reported.
At
approximately 08:00 on Tuesday, 12 November 2013, Israeli forces established a
checkpoint at the entrance of Sa’ir village, east of Hebron. At approximately 15:00, they established
another checkpoint at the southern entrance of Halhoul (al-Jeser Area), north
of the city. The two checkpoints were
removed later, and no arrests were reported.
At
approximately 08:00 on Wednesday, 13 November 2013, Israeli forces established
a checkpoint on the Tarousah Road between Dura and its western villages,
southwest of Hebron. At approximately
17:00, another checkpoint was established at the entrance of Hadab al-‘Alqah, south
of Dura, southwest of the city. At
approximately 17:00, another checkpoint was established at the entrance of
Kharsa village, south of Dura, southwest of Hebron. All checkpoints were removed later, and no
arrests were reported.
· Tulkarm:
Israeli forces have continued to impose severe restrictions on the
movement of Palestinian civilians. At
approximately 09:00 on Friday, 08 November 2013, Israeli forces stationed at ‘Ennab
checkpoint, which is established on the main road between Tulkarm and Nablus,
east of Tulkarm, tightened their restrictions against Palestinian civilians and
obstructed their movement. The
tightening later ended, and no arrests were reported. At approximately 19:00, Israeli forces stationed
at the aforementioned checkpoint re-obstructed the Palestinians civilians’
movement.
· Qalqilya: Israeli forces have continued to
impose severe restrictions on the movement of Palestinian civilians. At approximately 09:45 on Saturday, 09
November 2013, Israeli forces established a checkpoint at the entrance of ‘Azzoun
village, east of Qalqilya. At
approximately 11:00, another checkpoint was established at the intersection of
Jainsafout village, east of the city.
The two checkpoints were removed later, and no arrests were reported.
· Salfit:
Israeli forces have continued to impose severe restrictions on the
movement of Palestinian civilians. At
approximately 08:00 on Thursday, 08 November 2013, Israeli forces established a
checkpoint at the entrance of Eskaka village, east of Salfit. At approximately 11:00, a similar checkpoint
was established at the entrance of Deir Ballout village, west of the city. The two checkpoints were removed later, and
no arrests were reported.
Arrests and Maltreatment at military
checkpoints
On
Thursday morning, 08 November 2013, Israeli soldiers stationed at al-Zahiriyah
checkpoint, south of Hebron, detained Khadijah Nimr Salah (51) from al-Khader
village, south of Bethlehem when she was on her way to visit her sons in
“Raymond” desert prison. They
handed her a summons to refer to the Israeli intelligence service in “Gush
Etzion” settlement bloc, south of the city. She stated to a PCHR fieldworker that Israeli
soldiers stopped her at the checkpoint, searched her, and then asked her to
go back home after telling her that she was not allowed to visit her sons.
At approximately 17:00 on Thursday, 07 November
2013, Israeli forces arrested 4 civilians, including one child and 2 brothers,
from Mardah village, north of Salfit, while they were collecting olives from
their land near “Ariel” settlement, north of the aforementioned
city. The detainees were identified as:
Rostom Jamal Mohammaed Abu al-Hayja (28); his brother, Mohammed Abu al-Hayja
(19); Yousif ‘Emad Dweik (17); and Jalal Yousif Khafsh (44).
At approximately
04:00 on Friday, 98 November 2013, Israeli forces stationed at ‘Ennab
checkpoint, which is established on the main road between Tulkarm and Nablus,
east of Tulkarm, tightened their arbitrary restrictions against the Palestinian
civilians and obstructed their movement.
They then arrested Ra’ed Mohammed Hussein Qozah (42) from Tulkarm while
passing through the checkpoint and took him to an unknown destination.
At approximately 16:00 on Monday, 11 November
2013, Israeli forces stationed at Za’atarah checkpoint, south of Nablus,
arrested Wea’am Samih ‘Asidah (21) from Til village, southwest of Nablus. Eyewitnesses said that the soldiers stationed
at the checkpoint stopped the car in which ‘Asidah was, and forced her under gunpoint
threat to get out of the car. They then
asked the driver to leave the checkpoint and placed her near the checkpoint
before taking her to an unknown destination.
At approximately 12:30 on Tuesday, 12 November
2013, Israeli soldiers deployed in the old city neighborhoods in the centre of
Hebron arrested 4 children, who were on their way back from school, under the
pretext of throwing stones at Israeli soldiers.
They were then taken to “Ja’abrah” police station near
al-Ibrahimi Mosque. The detainess were
identified as: Mohanned Amin Al-Bakri (15); Mohammed Ghleb al-Rajbi (14); his
brother, ‘Alaa’, (15); and Foaa’d ‘Asem al-Batsh (17).
4. Settlement Activities and Attacks by Settlers against Palestinian Civilians
and Property
Attacks by Settlers against Palestinian Civilians and Their
Property
At approximately 02:00 on Thursday, 07 November 2013,
a number of Israeli settlers from “Havat Gal” settlement, east of Hebron, set
fire to 2 cars belonging to Palestinian civilians in al-Jalajel village, east
of Hebron: A BMW car belonging to Abdul Mon’em Noah Salaima, 60; and a Fiat 127
car belonging to Mohammed Noah Salaima, 45.
They also wrote “In solidarity with Beit Ain settlement” on walls of
houses in the village. Palestinian
civilians and fire engines were able to extinguish fire, and the Palestinian
police arrived at the area later. In the
evening, Israeli forces and police arrived at the area to check what
happened. They requested Abdul Mon’em
Slaima to accompany them to a police station in “Kiryat Arba” settlement to
give his testimony. Losses in the 2 cars
are estimated at 7,000 NIS (approximately US$ 2,000).
At approximately 10:30 on Friday, 08 November 2013,
dozens of Israeli settlers living in settlement located near Taqqou’ village,
southeast of Bethlehem, closed the western entrance of the village, claiming
that stones and Molotov cocktails were thrown at a settler’s car. The settlers raised the Israeli flag and
organized a march in the area.
At approximately 15:00 on Sunday, 10 November 2013,
dozens of Israeli settlers living in settlement located near Taqqou’ village,
southeast of Bethlehem, closed the western entrance of the village. The settlers raised the Israeli flag and
provoked Palestinian civilians. Later,
Israeli forces blocked the road leading to Khirbat al-Deir area in the
northwest of the village with sand barriers.
5. Effort to Create a Jewish Demographic Majority in
occupied East Jerusalem
During the reporting period, Israeli authorities
forced Samer Mahmoud Za’tara to demolish his house in application of a decision
by the Israeli municipality of Jerusalem, claiming that the house was built
without a license. Za’tara was forced 18
years ago to expand his house in ‘Aqabet al-Saraya area in the Old Town of
Jerusalem. Two weeks ago, the Israeli
municipality issued a final decision ordering him to demolish his house no
later the beginning of February 2014, otherwise the municipality and the police
would demolish it and he must be the cost of demolition, which is estimated at
80,000-90,000 NIS. The house was
comprised of 3 rooms and bathroom, and it housed Za’tara, his wife and their 6
children. According to Za’tara, the
Israeli municipality imposed a fine of 12,000 NIS on him due to unlicensed
building.
Recommendations to the International Community
PCHR emphasizes the international community’s position
that the Gaza Strip and the West Bank, including East Jerusalem, which is still
under the Israeli occupation, in spite of the Israeli military redeployment
outside the Gaza Strip in 2005. PCHR further confirms that Israeli force have
continued to impose collective punishment measures on the Gaza Strip, which
have escalated since the 2006 Palestinian parliamentary elections, in which
Hamas won the majority of seats of the Palestinian Legislative Council. PCHR
stresses that there is an international recognition of Israel’s obligation to
respect international human rights instruments and the international
humanitarian law, especially the Hague Regulations concerning the
Laws and Customs of War on Land and the
Geneva Conventions. Israel is bound to apply the international human rights law
and the law of war sometime reciprocally and other times in parallel in a way
that achieves the best protection for civilians and remedy for victims.
In light of continued arbitrary measures, land
confiscation and settlement activities in the West Bank, and the continued
aggression against civilians in the Gaza Strip, especially the latest offensive
that lasted for 8 days in November, PCHR calls upon the international community,
especially the United Nations, the High Contracting Parties to the Geneva
Convention and the European Union – in the context of their natural obligation
to respect and enforce the international law – to cooperate and act according
to the following recommendations:
1. PCHR calls upon the international community and the
United Nations to use all available means to allow the Palestinian people to
enjoy their right to self-determination, through the establishment of the
Palestinian State, which was recognized by the UN General Assembly with a vast
majority, using all international legal mechanisms, including sanctions to end
the occupation of the State of Palestine;
2. PCHR calls upon the United Nations to provide
international protection to Palestinians in the oPt, and to ensure the
non-recurrence of aggression against the oPt, especially the Gaza Strip;
3. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to compel Israel, as a High Contracting Party to the
Conventions, to apply the Conventions in the oPt;
4. PCHR calls upon the Parties to international human
rights instruments, especially the Covenant on Civil and Political Rights and
the Covenant on Economic, Social and Cultural Rights, to pressurize Israel to
comply with their provisions in the oPt, and to compel it to incorporate the
human rights situation in the oPt in its reports submitted to the concerned
committees;
5. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to fulfil their obligation to ensure the application of the
Conventions, including extending the scope of their jurisdiction in order to
prosecute suspected war criminals, regardless of the nationality of the
perpetrator and the place of a crime, to pave the way for prosecuting suspected
Israeli war criminals and end the longstanding impunity they have enjoyed;
6. PCHR calls on States that apply the principle of
universal jurisdiction not to surrender to Israeli pressure to limit universal
jurisdiction to perpetuate the impunity enjoyed by suspected Israeli war criminals;
7. PCHR calls upon the international community to act in
order to stop all Israeli settlement expansion activities in the oPt through
imposing sanctions on Israeli settlements and criminalizing trading with them;
8. PCHR calls upon the UN General Assembly to transfer
the Goldstone Report to the UN Security Council in order to refer it to the
International Criminal Court in accordance with Article 13(b) of the Rome
Statute;
9. PCHR calls upon the United Nations to confirm that
holding war criminals in the Palestinian-Israeli conflict is a precondition to
achieve stability and peace in the regions, and that peace cannot be built on
the expense of human rights and victims;
10. PCHR calls upon the UN General Assembly and Human
Rights Council to explicitly declare that the Israeli closure policy in Gaza
and the annexation wall in the West Bank are illegal, and accordingly refer the
two issues to the UN Security Council to impose sanctions on Israel to compel
it to remove them;
11. PCHR calls upon the international community, in light
of its failure to the stop the aggression on the Palestinian people, to at
least fulfil its obligation to reconstruct the Gaza Strip after the series of
hostilities launched by Israel which directed targeted the civilian
infrastructure;
12. PCHR calls upon the United Nations and the European
Union to express a clear position towards the annexation wall following the
international recognition of the State of Palestine on the 1967 borders, as the
annexation wall seizes large parts of the State of Palestine;
13. PCHR calls upon the European Union to activate Article
2 of the EU-Israel Association Agreement, which provides that both sides must
respect human rights as a precondition for economic cooperation between the EU
states and Israel, and the EU must not ignore Israeli violation and crimes
against Palestinian civilians;
14. PCHR calls upon the Palestinian leadership to sign and
accede to the Rome Statute of the International Criminal Court and the Geneva
Conventions, and calls upon the international community, especially the United
Nations, to encourage the State of Palestine to accede to international human
rights law and humanitarian law instruments.
