Summary
Israeli violations of international law and
international humanitarian law in the oPt continued during the reporting period
(05 – 11 December 2013).
Shooting:
During the reporting period, Israeli forces killed a
Palestinian child in al-Jalazoun refugee camp, north of Ramallah, and wounded 5
Palestinian civilians, including a child, in the West Bank. In the Gaza Strip,
Israeli forces continued opening fire at border areas, but no casualties were
reported.
In the West Bank, in excessive use of lethal force, on
07 December 2013, Israeli forces killed a Palestinian child in al-Jalazoun
refugee camp, north of Ramallah. Israeli
soldiers fired at a number of Palestinian children who gathered and threw
stones at them near “Beit Eil” settlement.
On 06 December 2013, Israeli forces wounded a
17-year-old civilian by a bullet that entered his right shoulder and exited the
right side when Israeli forces moved into Bab al-Zawiya area, in the centre of
Hebron.
Moreover, Israeli forces continued the systematic use
of excessive force against peaceful protests organised by Palestinian, Israeli
and international activists against the construction of the annexation wall and
settlement activities in the West. As a result, 3 civilians and an international
journalist were wounded. Two of whom were wounded during a protest in Kofur
Qaddoum village, northeast of Qalqilia, and the third one was wounded during a
protest in al-Nabi Saleh village, northwest of Ramallah, while the international
journalist was wounded during a protest in Bil’in village, west of Ramallah.
In the Gaza Strip, Israeli forces stationed along the
border fence, east of Khan Yunis, opened fire at agricultural lands 4 times on
06, 08, 09 and 10 December 2013. No casualties were reported.
Incursions:
During the reporting period, Israeli forces conducted
at least 56 military incursions into Palestinian communities in the West Bank. During
these incursions, Israeli forces arrested at least 27 Palestinians.
Restrictions on movement:
Israel continued to impose a tightened closure of the
oPt, imposing severe restrictions on the movement of Palestinian civilians in
the Gaza Strip and the West Bank, including occupied East Jerusalem.
The illegal closure of the Gaza Strip, which has
steadily tightened since June 2007 has had a disastrous impact on the
humanitarian and economic situation in the Gaza Strip. The Israeli authorities impose measures to
undermine the freedom of trade, including the basic needs for the Gaza Strip
population and the agricultural and industrial products to be exported. For 7
consecutive years, Israel has tightened the land and naval closure to isolate
the Gaza Strip from the West Bank, including occupied Jerusalem, and other
countries around the world. This resulted in a grave violation of the economic,
social and cultural rights and a deterioration of living conditions for 1.7
million people. The Israeli authorities
has established Karm Abu Salem (Kerem Shaloum) as the sole crossing for imports
and exports in order to exercise its control over the Gaza Strip’s economy that
has been aggravating for years due to the shortage of imports. They also aim at imposing a complete ban on
the Gaza Strip’s exports.
Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians throughout the West Bank,
including occupied East Jerusalem. Thousands of Palestinian civilians from the
West Bank and the Gaza Strip continue to be denied access to Jerusalem.
As part of using military checkpoints and border
crossings as traps to arrest Palestinian civilians under the pretext they are
wanted, Israeli forces arrested at least 8 civilians, including 3 children, in
the West Bank.
Israel has
continued its settlement activities in the oPt, a direct violation of
international humanitarian law, and Israeli settlers have continued to attack
Palestinian civilians and property.
On 10 December 2013, Israeli forces demolished a house
made of wood and plastic and 3 livestock barns in Samadi area, southeast of
al-Jiftlek village, north of Jericho.
On the same day, Israeli forces accompanied by an
officer from the Civil Administration and backed with 2 bulldozers demolished
houses and livestock barns in Yerza, Ein al-Helwa and al-Faresiya area, in the
Jordan Valley.

At approximately 01:00, Israeli forces moved into
al-Aroub refugee camp, north of Hebron. They patrolled the streets and
stationed in the centre of the camp. They deployed between the houses and
withdrew later. Neither house raids no arrests were reported.
At approximately 01:30, Israeli forces moved into Sourif
village, northwest of Hebron. They patrolled the streets for some time and
withdrew later. No arrests were reported.
Around the same time, Israeli forces moved into Beit
Luqia village, southwest of Ramallah. They patrolled the streets and raided and
searched a house belonging to the family of Hayman Mahmoud Dar-Assi (30). The
arrested the aforementioned person and took him to an unknown destination.
Around the same time also, Israeli forces moved into
Ni’lin village, west of Ramallah. They patrolled the streets for some time and
withdrew later. Neither house raids nor arrests were reported.
At approximately 02:45, Israeli forces moved into
Jenin. They patrolled the streets and raided and searched a house belonging to
the family of Hussein Fat’hi al-Mer’i (19), and arrested him. They raided
another house belonging to the family of Mahmoud Hakam Awad (19), and arrested
him as well.
At approximately 03:00, Israeli forces moved into
Silet al-Harithiya village, north of Jenin. They raided and searched a house
belonging to the family of Aladdin Mohammed Attoum (18), and arrested him.
At approximately 03:30, Israeli forces moved into
Qabatiya village, southeast of Jenin. They raided and searched a house
belonging to the family of Mahmoud Sharif Saba’na (22), and arrested him.
Friday, 06 December 2013
At approximately 01:00, Israeli forces moved into Beit
Awwa village, west of Doura, southwest of Hebron. They patrolled the streets
for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 02:00, Israeli forces moved into
Jenin. They patrolled the streets and raided a house belonging to the family of
Mohammed Omar Mostafa Shehab (46). They arrested Shehab and his brother Faraj
(35) and withdrew later.
At approximately 03:00, Israeli forces moved into
al-Hejra village, east of Doura, southwest of Hebron. They patrolled the
streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At approximately 08:00, Israeli forces stationed along
the border fence, east of Khan Yunis, in the southern Gaza Strip, opened fire
at agricultural lands in the east of Abassan village. They also fired a number
of smoke grenades for few hours. However, no casualties were reported.
At approximately 15:00, Israeli forces moved into Bab
al-Zawiya area, in the centre of Hebron. They deployed between the stores,
where a number of boys gathered and threw stones and empty bottles at Israeli
soldiers, who fired sound bombs and tear gas canisters in response. As a
result, a number of civilians suffered tear gas inhalation. In the meantime,
Israeli soldiers deployed around checkpoint (56) between al-Shuhada’ Street and
Bab al-Zawiya area, while other soldiers topped some stores around the
abovementioned checkpoint. They opened fire randomly. As a result, a 17-year-old civilian was
wounded by a bullet that entered his right shoulder and exited his right side.
The wounded was taken by an ambulance of the Palestine Red Crescent Society
(PRCS) to al-Mezan Specialized Hospital in the city, where he underwent a
surgery. Medical sources stated the boy had rupture in the right side of his
lung and midriff and haemorrhage in right kidney.
The boy’s father said to PCHR’s fieldworker:
“We
live in Tal al-Rumaida area. The only way to get to the city is through
checkpoint (56). My son was heading to the city when clashes erupted between
Palestinian boys and Israeli soldiers. His wound in the right and back side of
his shoulder proves that Israeli soldiers had opened fire at him from a high
place and from a range less than 50 meters.”
At approximately 15:30, Israeli forces moved into
al-Arqa village, west of Jenin. They patrolled the streets and raided and
searched a number of houses from which they arrested 3 civilians:
1. Hussein Hassan Abu Zaitoun, (23);
2. Sa’d al-Din Mohammed Jaradat (22); and
3. Ahmed Fat’hi Mohammed Amarnah (20).
At approximately 23:00, Israeli forces moved into
al-Daheriya village, south of Hebron. They patrolled the streets for some time

At approximately 01:00, Israeli forces moved into Beit
Ummar village, north of Hebron. They patrolled the streets for some time and
withdrew later. Neither house raids nor arrests were reported.
At
approximately 03:00, Israeli forces moved into the southwest of Hebron. They
patrolled the streets and raided and searched a house belonging to the family
of Noah Khaled Abu Aisha (25). The arrested the aforementioned person and took
him to an unknown destination.
At
approximately 03:30, Israeli forces moved into al-Nabi Yunis neighbourhood,
east of Halhoul, south of Hebron. They patrolled the streets for some time and
withdrew later. Neither house raids nor arrests were reported.
At
approximately 14:00, Israeli forces moved into Marda village, north of Salfit.
They patrolled the streets for some time and detained a number of civilians
until 15:00. Israeli forces withdrew later. Neither house raids nor arrests
were reported.
In excessive
use of lethal force, Israeli forces killed a Palestinian child in al-Jalazoun
refugee camp, north of Ramallah.
According to
investigations conducted by the Palestinian Center for Human Rights (PCHR), at
approximately 16:30 on Saturday, 07 December 2013, dozens of Palestinian
children gathered at the southern entrance of al-Jalazoun refugee camp, north
of Ramallah, near the UNRWA school, nearly 300 meters from the fence of “Beit
Eil” settlement. They set fire to rubber tires and threw stones at
Israeli soldiers. Israeli soldiers who got out of the settlement and
those stationed on an observation tower at the fence opened fire at the
children. As a result, Wajeeh Wajdi Mustafa al-Ramahi, 15, was seriously
wounded by a live bullet to the left side of his back. The child was
evacuated in a private car to Palestine Medical Compound in Ramallah, where he
underwent a surgery, but he succumbed to his wound. Medical sources
declared his death at approximately 17:10.
At
approximately 22:30, Israeli forces moved into Kherbatha al-Musbah village,
southwest of Ramallah. They patrolled the streets for some time and withdrew
later. No arrests were reported.
At
approximately 23:00, Israeli forces moved into Amrish village, south of Doura,
southwest of Hebron. They patrolled the streets for some time and withdrew
later. Neither house raids nor arrests were reported.

At
approximately 00:00, Israeli forces stationed along the border fence in the
east of Khan Yunis, south of the Gaza Strip, opened fire at agricultural lands
in Abassan village for few minutes. However, no casualties were reported.
At
approximately 00:30, Israeli forces moved into Tulkarm. They patrolled the
streets for some time and withdrew later. Neither house raids nor arrests were
reported.
At
approximately 00:55, Israeli forces moved into Kofur Qaddoum village, northeast
of Qalqilia. They patrolled the streets and fired sound bombs and tear gas
canisters during clashes that erupted between Israeli soldiers and Palestinian
civilians. As a result, Khaled Majed Jom’a (2 months) suffered tear gas
inhalation as a gas canister fell into his family’s house. The paramedic
offered the baby the first aid. Israeli forces withdrew at approximately 01:55.
At
approximately 01:00, Israeli forces moved into Hejja village, east of Qalqilia.
They patrolled the streets and raided a house belonging to the family of Oday
Khaled Basalat (19). They arrested the aforementioned person and took him to an
unknown destination.
At
approximately 02:00, Israeli forces moved into Beit Luqia village, southwest of
Ramallah. They patrolled the streets and raided and searched 2 houses from
which they arrested Alaa Samir Assi (27) and Mojahed Ali Assi (18).
Around the
same time, Israeli forces moved into al-Karmel area, west of yatta, southwest
of Hebron. They raided and searched a number of houses belonging to the family
of Abu ‘Eram. They withdrew later and no arrests were reported.
At
approximately 03:45, Israeli forces moved into Jenin and Jenin refugee camp. They
patrolled the streets and raided and searched a house belonging to the family
of Jom’a Sa’id Abu Jabal (46). They arrested the aforementioned person. They then raided another house belonging to
the family of Suleiman Isma’il Abu al-Rub (22), and arrested him. Soon after, they
raided a third house belonging to the family of Majd Zahi al-Sa’di (24), and
arrested him.
At
approximately 11:30, Israeli force moved into Kafrit village, southwest of
Jenin. They patrolled the streets for some time and withdrew later. Neither house
raids nor arrests were reported.
At
approximately 16:00, Israeli forces moved into al-Fawwar refugee camp, south of

canisters. As a result, Darweesh Baker Burhum (2) and other members of his
family suffered tear gas inhalation as a gas canister fell into their house. Israeli

At
approximately 16:55, Israeli forces moved into Ematin village, northeast of
Qalqilia. They patrolled the streets for some time and withdrew later. Neither

At
approximately 17:15, Israeli forces moved into Fara’ta village, northeast of
Qalqilia. They patrolled the streets and raided a store belonging to Najeh
Mohammed Shana’a (42). They detained and questioned the aforementioned person

approximately 22:10, Israeli forces moved into Salfit. They patrolled the
streets and raided a number of houses firing sound bombs and tear gas
canisters. They raided a house belonging
to Samir Abu Jazma, due to which, a gas canister fell near a vehicle belonging
to his neighbour Mohammed Eshreida. The vehicle’s glass was broken and the
seats were burnt as a result.
At

Monday, 09 December 2013
At
approximately 01:10, Israeli forces moved into Salfit. They patrolled the
streets, where a number of boys gathered and threw stones at Israeli soldiers,
who fired sound bombs in response. Israeli forces withdrew later. Neither house
raids nor arrests were reported.
At approximately 02:00, Israeli forces
moved into Ezbet al-Tabeeb, east of Qalqilia. They patrolled the streets and
raided a house belonging to the family of Bayan al-Tabeeb. They arrested his
son Tha’er (19) and obliged him to wear his shoes, go downstairs to the main
street and to put his feet on certain places under the pretext of tracing. They
questioned and maltreated him until he was released at approximately 20:00 on the
same day.
His mother Maha al-Tabeeb (37) said to PCHR’s
fieldworker:
“At approximately 02:10 on Monday, 09
December 2013, I woke up to check on my children and cover them well. Suddenly,
I heard some sound behind the door. I asked: Who is there?Someone answered: we
are the army. Open the door. I hurried up to my husband’s and son’s room and awoke
them. I opened the door for the Israeli soldiers. They asked: Who is in there?
I replied: No one but us. They went upstairs to the second floor where we stay.
They asked me about Tha’er, who was still in his bed. Tha’er woke up and they
obliged him to wear his sneakers. They took him down to the main street and
obliged him to put his feet in place of other footprints. The trace expert
confirmed to the officer it was not his foot, but the officer insisted it was
his. They took him by a jeep and returned him at approximately 20:00. He was
exhausted as he was hit by a dagger in his back causing him a 1-centimeter deep
wound. That is why he was released I think. We took him immediately to Darweesh
Nazzal Hospital. They cleaned and stitched the wound and offered him the
necessary medication. We went home at approximately 22:00.”

Tuesday, 10 December 2013
At
approximately 01:00, Israeli forces moved into Kherbet Abu Falah village,
northeast of Ramallah. They patrolled the streets for some time and withdrew
later. Neither house raids nor arrests were reported.
At
approximately 01:30, Israeli forces moved into Beit Ummar village, north of
Hebron. They patrolled the streets and stationed in the centre of the village.
They also deployed between the houses and topped a house belonging to the
family of Nawaf Ahmed Sabarna using ladders. They broke the roof’s door and
raided the houses. Israeli soldiers detained the family in a room. In the
meanwhile, other soldiers damaged the furniture under the pretext of searching
the house. Israeli soldiers remained in the house for 3 hours, but no arrests
were reported. In the meantime, Israeli soldiers raided and searched a house
belonging to the family of Ayman Ahmed Sabarna (38). They arrested the
aforementioned person under the pretext they found a hunting rifle in his
house. Israeli soldiers took him to an observation checkpoint at the entrance
of the village on foot without allowing him to put his clothes on. Moreover,
Israeli soldiers raided a house in al-Ein area belonging to Mohammed Kamel
Bahar (25). They arrested the aforementioned person and took him by a military
vehicle to the village’s entrance. While Israeli forces had been withdrawing, a
number of boys gathered and threw stones and empty bottles at them. Israeli
soldiers fired sound bombs and tear gas canisters in response. Israeli forces
withdrew at approximately 05:00 and the arrested were taken to an unknown
destination.

patrolled the streets and raided and searched a house belonging to the family
of Shadi Mohammed al-Sous (19). They arrested the aforementioned person. At

2. Use of excessive force against peaceful demonstrations protesting
settlement activities and the construction of the annexation wall
During the reporting period, Israeli soldiers used
excessive force against peaceful demonstrations organised by Palestinian
civilians, international and Israeli human rights defenders in protest at the
construction of the annexation wall and settlement activities in the West Bank.
As a result, 3 Palestinian civilians and an international journalist were
wounded.

Demonstrations against the construction of the
annexation wall and settlement activity
Following the Friday Prayer, 06 December 2013, dozens
of Palestinian civilians and international and Israeli human rights defenders
organised a peaceful demonstration in Bil’in, west of Ramallah, in protest at
the construction of the annexation wall and settlement activities, supporting
the al-Aqsa mosque and the Islamic and Christian religious sites and for the
demise of the South African leader Nelson Mandela. Demonstrators took the
streets raising the Palestinian flags and headed to the liberated territories
near the annexation wall. Israeli forces had closed all the entrances of the
village since morning to prevent the Palestinian and international activists
and journalists from participating in the demonstration. Demonstrators marched
adjacent to the cement wall and tried to cross the fence before Israeli forces
that are stationed behind the wall, in the western area, and a large number of
soldiers deployed along it fired live bullets, tear gas canisters,
rubber-coated steel bullets, sound bombs and skunk water at them and chased
them in olive fields. As a result, an international journalist (whose name and
nationality were not identified) was hit by a gas canister. Moreover, a number
of demonstrators suffered tear gas inhalation and other sustained bruises.
Israeli forces arrested Abdul Qader Abu Rahma (19) and took him to Ofer
detention facility, southwest of Ramallah.
On the same day, dozens of Palestinian civilians
organised a peaceful demonstration in the middle of Ni’lin village, west of
Ramallah, in protest at the construction of the annexation wall and settlement
activities. Demonstrators took the streets and headed to the annexation wall.
Israeli forces closed the gates of the wall with barbwires and prevented the
demonstrators from passing to the land behind it before they responded by
throwing stones. As a result, many civilians suffered tear gas inhalation and
bruises.
Around the same time, dozens of Palestinian
civilians and Israeli and international human rights defenders organised a

activists and journalists from participating in the demonstration. When they arrived
at the land, the demonstrators were met by live bullets, tear gas canisters,
rubber-coated steel bullets, sound bombs and skunk water and were chased into
the village. As a result, a number of civilians suffered tear gas
inhalation and others sustained bruises due to being beaten up
by Israeli soldiers.
At approximately 12:30 on the same day, Palestinian
civilians and international activists organised a peaceful demonstration in the
centre of Kufor Qaddoum village, northwest of Qalqilia, and headed towards the
eastern entrance of the village, in protest at the continued closure of the
entrance with an iron gate, since the beginning of the Aqsa Intifada. Clashes
erupted between the demonstrators and Israeli forces that fired sound bombs and
tear gas canisters to prevent them from reaching the aforementioned gate. As a
result, 2 civilians, were wounded. The 43-year-old civilian was hit by a gas
canister to the left hand and the other 43-year-old civilian was hit by a gas
canister to the belly.
Other Demonstrations
At approximately 13:00 on Saturday, 07 December 2013, dozens

to receive the necessary medical treatment. Israeli forces detained for about
30 minutes Belal Abdul Salam Tamimi (47), photojournalist of the popular resistance
movement against settlement activities and the construction of the annexation
wall in Nabi Saleh village, an Israeli activist named Kobe and an Australian
activist whose name was not identified.
3. Continued closure of the oPt
Israel has continued to impose a
tightened closure on the oPt, imposing severe restrictions on the movement of
Palestinian civilians in the Gaza Strip and the West Bank, including occupied
East Jerusalem.
Gaza
Strip
Israeli
forces continuously tightens the closure of the Gaza Strip and closes all
commercial crossings , making the Karm Abu Salem crossing the sole commercial
crossing of the Gaza Strip, although it is not suitable for commercial purposes
in terms of its operational capacity and distance from markets.
Israeli
forces have continued to apply the policy, which is aimed to tighten the
closure on all commercial crossings, by imposing total control over the flow of
imports and exports.
The
total closure of al-Mentar (“Karni”) crossing since 02 March 2011 has
seriously affected the economy of the Gaza Strip. Following this closure, all
economic and commercial establishments in the Gaza Commercial Zone were shut
off. It should be noted that al-Mentar crossing is the biggest crossing in the
Gaza Strip, in terms of its capacity to absorb the flow of imports and exports.
The decision to close al-Mentar crossing was the culmination of a series of
decisions resulting in the complete closure of the Sofa crossing, east of the
Gaza Strip in the beginning of 2009, and the Nahal Oz crossing, east of Gaza
City, which was dedicated for the delivery of fuel and cooking gas to the Gaza
Strip, in the beginning of 2010.
Israeli
forces have continued to impose a total ban on the delivery of raw materials to
the Gaza Strip, except for very limited items and quantities. The limited
quantities of raw materials allowed into Gaza do not meet the minimal needs of
the civilian population of the Gaza Strip.
The
cooking gas crisis has ranged between the ebb and flow for 3 months due to the
closure of Karm Abu Salem for security reasons.
According to PCHR’s follow-up, Israeli authorities only allow around 98
tonnes of cooking gas into Gaza per day.
This limited quantity is less than half of the daily needs, which is 200
tonnes per day, of the civilian population in the Gaza Strip during the winter.
For almost 6 consecutive years,
Israeli forces have continued to prevent the delivery of construction materials
to the Gaza Strip. During the reporting period, Israeli forces approved the
delivery of limited quantities of construction materials for a number of
international organisations in the Gaza Strip.
Israeli forces also continued to impose almost total ban on the Gaza
Strip exports, including agricultural and industrial products, except for
light-weighted products such as flowers, strawberries, and spices.
Israel has continued to close the
Beit Hanoun (“Erez”) crossing for the majority of Palestinian citizens from the
Gaza Strip. Israel only allows the movement of a limited number of groups, with
many hours of waiting in the majority of cases. Israel has continued to adopt a
policy aimed at reducing the number of Palestinian patients allowed to move via
the Beit Hanoun crossing to receive medical treatment in hospitals in Israel or
in the West Bank and East Jerusalem. Israel denied permission to access
hospitals via the crossing for new categories of patients from the Gaza Strip.
For around a year and a half,
Israeli forces have allowed Palestinian detainees’ families to visit their sons
in the Israeli jails according to special and unfair conditions after more than
5 years of deprivation in violation of international humanitarian law.
The Egyptian authorities allow the
population of the Gaza Strip to travel via Rafah International crossing, which
connects the Gaza Strip with the outside world.
Only limited and specified categories are allowed, including patients,
students, persons that hold residencies in Egypt or abroad, men over 40 years,
females in all ages, children under 18, persons who hold Arab and foreign
nationalities, and members of Arab and international humanitarian
delegations. It should be mentioned that
the crossing opens seven days a week.
Nowadays, the crossing is overcrowded due to the prolonged procedures
from the Egyptian side, particularly after closing it for several days over the
past weeks due to Egypt’s security conditions, which has affected the
travellers’ movement in both directions.

Israel has
imposed a tightened closure on the West Bank. During the reporting period,
Israeli forces imposed additional restrictions on the movement of Palestinian
civilians:
• Ramallah: Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians. At approximately 09:30 on Friday, 06 December
2013, Israeli forces established a checkpoint at the entrance of al-Nabi Saleh
village, northwest of Ramallah. They checked ID cards of passengers and
detained a number of civilians. The checkpoint was later removed and no arrests
were reported.
At
approximately 15:00 on Sunday, 08 December 2013, Israeli forces established a
checkpoint at the eastern entrance of al-Taiba village, northeast of Ramallah.
They checked ID cards of the passengers. The checkpoint was later removed and
no arrests were reported.
At
approximately 16:30 on Monday, 09 December 2013, Israeli forces established a
checkpoint at the entrance of Beit Our al-Tahta village, southwest of Ramallah.
They checked ID cards of the passengers. The checkpoint was later removed and
no arrests were reported. Around the same time, Israeli forces established a
checkpoint at the entrance of Aboud village, northwest of Ramallah. They
checked ID cards of the passengers. The checkpoint was later removed and no
arrests were reported. At approximately 17:00, Israeli forces established a
checkpoint at the intersection of Beit Our al-Fouqa village, southwest of the
city. The checkpoint was later removed and no arrests were reported. At
approximately 19:00, Israeli forces established a checkpoint at the eastern
entrance of Ni’lin village, west of Ramallah. They checkpoint was later removed
and no arrests were reported.
• Hebron: Israeli forces have continued to impose severe
restrictions on the movement of Palestinian civilians. At approximately 07:30 on Thursday, 05
December 2013, Israeli forces established a checkpoint at the northern entrance
of Hebron. Around the same time, a similar checkpoint was established at the
entrance of Bani N’eim, east of Hebron.
The two checkpoints were later removed, and no arrests were reported.
At
approximately 07:30 on Saturday, 07 December 2013, Israeli forces established a
checkpoint at the entrance of Kharsa village, southwest of Hebron. The checkpoint was later removed, and no
arrests were reported.
At
approximately 07:30 on Sunday, 08 December 2013, Israeli forces established a
checkpoint at the entrance of al-Koum village, west of Dura, southwest of
Hebron. Around at approximately 16:00,
they established another checkpoint at the entrance of Ethna village, west of
Hebron. The two checkpoints were later
removed, and no arrests were reported.
At
approximately 11:00 on Monday, 09 December 2013, Israeli forces closed Yatta –
al-Musafer road, southeast of the city, with big cement cubes under the pretext
the area is a military closed zone. It should be noted these villages (Majaz,
Taban, Safai al-Fouqa, Safai al-Tahta, Fakheet, Halawa, al-Markaz, Janaba
al-Fouqa, Janaba al-Tahta and Kharouba), including (Touba, Mafqara, Saroura and
Maghayer al-Abeed) are considered agricultural areas and are used also to graze
the sheep.
At
approximately 07:00 on Tuesday, 10 December 2013, Israeli forces established a
checkpoint at the entrance of Karaza village, south of Doura, southwest of the
city. at approximately 08:00, they established another checkpoint at Tarousa
road connecting Doura with its western villages, southwest of the city. The 2
checkpoints were later removed and no arrests were reported.
· Jericho: Israeli forces
have continued to impose severe restrictions on the movement of Palestinian
civilians. At approximately 15:30 on
Sunday, 08 December 2013, Israeli forces established a checkpoint at the
southern entrance of Jericho. They denied civilians access to the city and
checked ID cards of the passengers. The checkpoint was later removed and no
arrests were reported.
At
approximately 19:30 on Monday, 09 December 2013, Israeli forces established a
checkpoint at the entrance of Marj Na’ja village, north of Jericho. The
checkpoint was later removed and no arrests were reported.
At
approximately 11:30 on Tuesday, 10 December 2013, Israeli forces established a
checkpoint on al-Mu’arajat road between Jericho and Ramallah. The checkpoint
was later removed and no arrests were reported. At approximately 15:30, they
established a checkpoint at the southern entrance of Jericho. The checkpoint
was later removed and no arrests were reported.
· Qalqilya:
Israeli forces have continued to impose severe restrictions on the
movement of Palestinian civilians. At
approximately 08:30 on Saturday, 07 December 2013, Israeli forces established a
checkpoint at the entrance of Jeet village, northeast of Qalqilia. At
approximately 16:45, they established another checkpoint at the entrance of Azzoun
village, east of the city and re-established the checkpoint at approximately
21:30. At approximately 21:20, Israeli forces established a checkpoint at the
entrance of Ezbet al-Tabeeb village, east of the city, while at approximately
21:30, they established 4 checkpoints throughout the city. The checkpoints were
later removed and no arrests were reported.
At
approximately 09:25 on Monday, 09 December 2013, Israeli forces established a
checkpoint at the intersection of Jeet village, northeast of Qalqilia. At
approximately 17:30, the checkpoint was removed and no arrests were reported.
At approximately 19:30, Israeli forces established a checkpoint at the entrance
of Azzoun village, east of the city. the checkpoint was later removed and no
arrests were reported.
· Salfit:
Israeli forces have continued to impose severe restrictions on the
movement of Palestinian civilians. At
approximately 09:55 on Monday, 09 December 2013, Israeli forces established a
checkpoint at the entrance of Qarawet Bani Hassan village, west of Salfit. At
approximately 17:30, the checkpoint was removed and no arrests were reported.
At approximately 16:10, Israeli forces established a checkpoint between Deir
Estiya and Koful Hares villages, north
of Salfit. The checkpoint was removed at approximately 17:00 and no arrests
were reported.
At approximately 08:30 on Saturday, 07 December 2013, Israeli forces
established a checkpoint between Deir Ballout and Rafat villages, west of
Salfit. The checkpoint was removed at
approximately 22:00 and no arrests were reported. At approximately 15:40,
Israeli forces established a checkpoint between Koful Hares and Hares villages,
north of Salfit. The checkpoint was removed at approximately 16:30 and no
arrests were reported. At approximately 15:50, Israeli forces established a
checkpoint at the northern entrance of Bruqin village, west of the city.
· Tulkarm: Israeli forces have continued to
impose severe restrictions on the movement of Palestinian civilians. At approximately18:30 on Monday, 09 December 2013, Israeli forces stationed at Ennab
checkpoint between Tulkarm and Nablus, east of Tulkarm, imposed severe
restrictions on the Palestinians. They checked the ID cards of passengers but
no arrests were reported. Around the same time, they established a checkpoint
on Tulkarm – Nablus road near the intersection leading to Beit Leed village,
east of Tulkarm. The checkpoint was later removed and no arrests were reported.
At approximately 07:30 on Tuesday, 10 December 2013, Israeli forces
stationed at Ennab checkpoint between Tulkarm and Nablus, east of Tulkarm,
imposed severe restrictions on the Palestinians. They checked the ID cards of
passengers but no arrests were reported.
Arrests and Maltreatment at military
checkpoints
At
approximately 01:10 on Thursday, 05 December 2013, Israeli forces established a
checkpoint at the entrance of Beit Fojar village, southeast of Bethlehem. They arrested 3 civilians, including one
child, and they were identified as: Munir Nasim Mershid Taqatqah (20); ‘Ali
Anwar Mershid Taqatqa (28); and Ahmed Sami Taqatqa (17). The checkpoint was later removed, and the
three arrested persons were taken to an unknown destination.
At approximately 10:00 on Friday, 06 December
2013, Israeli forces deployed in the old city neighborhoods in Hebron arrested
two children, who were identified as: Mohammed al-Heeh (14) and Mahmoud Ibrahim
al-Dweik (13), under the pretext of noncompliance with the orders of the Israeli
soldiers. Around a couple of hours later
of detention, they were released.
At approximately 16:00 on Monday, 09 December
2013, Israeli forces established a checkpoint at the entrance of al-Ramadeen
Bedouin village, southeast of Hebron. They arrested 3 civilians and took them
to an unknown destination. The arrested were identified as: Mohammed Ibrahim
al-Ka’bi, Mohammed Hassan Abdul Jawad and Ibrahim Ouda al-Hroub.
4. Settlement Activities and Attacks by Settlers against Palestinian Civilians
and Property
At approximately 10:00 on Sunday, 08 December
2013, Israeli forces backed with 2 military vehicles and a vehicle belonging to
the Israeli Civil Administration’s Construction and Organization moved into
al-Dirat village, east of Yatta, south of Hebron. They patrolled the village streets and then
stationed in the western area of the village.
They deployed in the agricultural lands and ordered ‘Issa Mohammed
‘Atiyah Mos’ef to leave his land claiming that it is a closed military area
where none is allowed to access. The
Civil Administration officer then orally informed Mahmoud Mohammed al-‘Adrah to
stop building his under-construction house. It should be mentioned that Israeli
authorities handed civilians in al-Dirat village a plan to divide the village
into two parts in order to confiscate agricultural lands and build a new
settlement road.
At
approximately 06:40 on Tuesday, 10 December 2013, Israeli forces demolished a
house made of wood and plastic and 3 livestock barns in Samadi area, southeast
of al-Jiftlek village, north of Jericho. According to information collected by a
PCHR fieldworker from the local council, at approximately 06:40, on the
abovementioned day, Israeli forces backed with 10 military vehicles and 2
bulldozers and accompanied by an officer from the Civil Administration moved
into Samadi area, southeast of al-Jiftlek village, north of Jericho. They
declared the area as a military zone and denied civilians and journalists
access to the area. At approximately 06:50, the bulldozers started demolishing
a 60-square-meter house made of wood and plastic that shelters a 10-member
family. Besides, they demolished 3 livestock barns with an area of 150 square
meters belonging to So’oud Salem Ka’abna (45). It should be noted that Israeli
forces distributed notifications a month ago for the residents of the area to
evacuate it under the pretext it is area (c), which is under the Israeli
control according to the Oslo accords 1993. At approximately 07:30, Israeli
forces withdrew.
At approximately 09:00 on the same
day, Israeli forces accompanied by an officer from the planning and building
department at the Israeli Civil Administration and backed with 2 bulldozers
demolished houses and livestock barns in Yerza, Ein al-Helwa and al-Faresiya
areas in the northern Jordan Valley.
The demolition works were as
follows:
1. A 60-square-meter residential tent provided
previously by the Ministry of Local Government, 2 tents to shelter livestock
(120 square meters each) provided by ACTED organization, a 40-square-meter
kitchen and a plastic water tank all belonging to Faysal Mohammed Mahmoud
Daraghma were demolished in Yerza area;
2. 2 residential tents (60 square meters each)
provided previously by the Ministry of Local Government, a 60-square-meter tent
to shelter livestock provided by ACTED organization, a 40-square-meter kitchen,
a 50-square-meter store, a 360-square-meter cow barn, 15 metal fences, and 5 troughs
belonging to Sati Eliyan Zamel Daraghma were demolished in Ein al-Helwa area;
3. 2 tents to shelter livestock (100 square meters
each) and 3 residential tents (60 square meters each) belonging to Nemer Hassan
Hussein Daraghma were demolished in al-Faresiya area.
4. 3 residential tents (60 square meters each)
belonging to Aisha Suleiman Ahmed Daraghma were demolished in al-Faresiya area
as well.
Recommendations to the International Community
PCHR emphasizes the international community’s position
that the Gaza Strip and the West Bank, including East Jerusalem, which is still
under the Israeli occupation, in spite of the Israeli military redeployment
outside the Gaza Strip in 2005. PCHR further confirms that Israeli force have
continued to impose collective punishment measures on the Gaza Strip, which
have escalated since the 2006 Palestinian parliamentary elections, in which
Hamas won the majority of seats of the Palestinian Legislative Council. PCHR
stresses that there is an international recognition of Israel’s obligation to
respect international human rights instruments and the international
humanitarian law, especially the Hague Regulations concerning the
Laws and Customs of War on Land and the
Geneva Conventions. Israel is bound to apply the international human rights law
and the law of war sometime reciprocally and other times in parallel in a way
that achieves the best protection for civilians and remedy for victims.
In light of continued arbitrary measures, land
confiscation and settlement activities in the West Bank, and the continued
aggression against civilians in the Gaza Strip, especially the latest offensive
that lasted for 8 days in November, PCHR calls upon the international
community, especially the United Nations, the High Contracting Parties to the
Geneva Convention and the European Union – in the context of their natural
obligation to respect and enforce the international law – to cooperate and act
according to the following recommendations:
1. PCHR calls upon the international community and the
United Nations to use all available means to allow the Palestinian people to
enjoy their right to self-determination, through the establishment of the Palestinian
State, which was recognized by the UN General Assembly with a vast majority,
using all international legal mechanisms, including sanctions to end the
occupation of the State of Palestine;
2. PCHR calls upon the United Nations to provide
international protection to Palestinians in the oPt, and to ensure the
non-recurrence of aggression against the oPt, especially the Gaza Strip;
3. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to compel Israel, as a High Contracting Party to the
Conventions, to apply the Conventions in the oPt;
4. PCHR calls upon the Parties to international human
rights instruments, especially the Covenant on Civil and Political Rights and
the Covenant on Economic, Social and Cultural Rights, to pressurize Israel to
comply with their provisions in the oPt, and to compel it to incorporate the
human rights situation in the oPt in its reports submitted to the concerned
committees;
5. PCHR calls upon the High Contracting Parties to the
Geneva Conventions to fulfil their obligation to ensure the application of the
Conventions, including extending the scope of their jurisdiction in order to
prosecute suspected war criminals, regardless of the nationality of the perpetrator
and the place of a crime, to pave the way for prosecuting suspected Israeli war
criminals and end the longstanding impunity they have enjoyed;
6. PCHR calls on States that apply the principle of
universal jurisdiction not to surrender to Israeli pressure to limit universal
jurisdiction to perpetuate the impunity enjoyed by suspected Israeli war
criminals;
7. PCHR calls upon the international community to act in
order to stop all Israeli settlement expansion activities in the oPt through
imposing sanctions on Israeli settlements and criminalizing trading with them;
8. PCHR calls upon the UN General Assembly to transfer
the Goldstone Report to the UN Security Council in order to refer it to the
International Criminal Court in accordance with Article 13(b) of the Rome
Statute;
9. PCHR calls upon the United Nations to confirm that
holding war criminals in the Palestinian-Israeli conflict is a precondition to
achieve stability and peace in the regions, and that peace cannot be built on
the expense of human rights and victims;
10. PCHR calls upon the UN General Assembly and Human
Rights Council to explicitly declare that the Israeli closure policy in Gaza
and the annexation wall in the West Bank are illegal, and accordingly refer the
two issues to the UN Security Council to impose sanctions on Israel to compel
it to remove them;
11. PCHR calls upon the international community, in light
of its failure to the stop the aggression on the Palestinian people, to at
least fulfil its obligation to reconstruct the Gaza Strip after the series of
hostilities launched by Israel which directed targeted the civilian
infrastructure;
12. PCHR calls upon the United Nations and the European
Union to express a clear position towards the annexation wall following the
international recognition of the State of Palestine on the 1967 borders, as the
annexation wall seizes large parts of the State of Palestine;
13. PCHR calls upon the European Union to activate Article
2 of the EU-Israel Association Agreement, which provides that both sides must
respect human rights as a precondition for economic cooperation between the EU
states and Israel, and the EU must not ignore Israeli violation and crimes
against Palestinian civilians;
14. PCHR calls upon the Palestinian leadership to sign and
accede to the Rome Statute of the International Criminal Court and the Geneva
Conventions, and calls upon the international community, especially the United
Nations, to encourage the State of Palestine to accede to international human
rights law and humanitarian law instruments.
