PCHR Condemns Riots in Gaza that Erupted to Pressure the PNA to Execute a Detainee Accused of Committing a Murder

 PCHR is gravely concerned about the riots organized by dozens of armed young men in the streets of Gaza City on Wednesday, 26 January 2005, to pressure the Palestinian National Authority (PNA) to execute a detainee accused of committing a murder in a quarrel a few days ago in Gaza City. 

 According to investigation conducted by PCHR, on Wednesday morning, 26 January 2005, a number of armed members of the Dughmosh family, including a number of members of Palestinian security services, closed the main roads and crossroads in Gaza City to traffic. They took position near the building of Palestinian Legislative Council and the Palestinian security compound known as Saraya in the center of Gaza City.  They fired in the air and demanded the execution of a member of the Jundiya family, who has been detained by the PNA for involving in the murder of ‘Eid Rubin Dughmosh, 38. They also attacked a number of shops belonging to the Jundiya family in the center of Gaza City. These riots continued for several hours, creating an atmosphere of chaos and terror in various areas in Gaza City. 

 ‘Eid Rubin Dughmosh was seriously injured in the right eye in a quarrel that took place near Palestine crossroads in al-Remal neighborhood in Gaza City.  He was evacuated to Shifa Hospital in Gaza City, as his health condition deteriorated, he was transferred to an Israeli Hospital. On Tuesday evening, 25 January 2005, he died from his injury.  According to information available to PCHR, the man who committed this attack surrendered to a Palestinian security service, and he has been detained in Saraya

 In light of the above, PCHR notes the following:

 1.      PCHR condemns the horrible murder, which left ‘Eid Rubin Dughmosh dead, but remains gravely concerned at the riots, attacks on property, disrupting the public order, taking the law in ones’ own hands by a number of armed persons in the streets of Gaza City. 

2.      PCHR is concerned about the involvement of a number of members of Palestinian security services in such riots, even through there are supposed to be law enforcement officials, not tools to undermine the rule of law. 

3.      The PNA is responsible for investigating the aforementioned murder and bringing its perpetrators to the civilian judiciary, which can judge according to the law.  There must not be any kind of pressure on the judiciary to make judgments that do not directly correspond to the rule of law. 

4.      PCHR calls upon the PNA to investigate such riots and bring those responsible for them, especially those who are members of security services, to justice. 

5.      The aforementioned crime and the incidents that followed were not the first, rather they have become a phenomenon in the Palestinian society in the latest years.  The PNA is required to take serious steps to end such incidents, the misuse of weapons and security chaos in the PNA territories in the West Bank and the Gaza Strip.
