PCHR Submits an Appeal to the Israeli High Court Requesting Halt for the Demolition of a Number of Palestinian Homes
On Tuesday evening PCHR submitted an appeal to the Israeli High Court demanding an order be introduced to halt the demolition of a number of homes belonging to the Abu Dahrouj family in al-Zaytoun neighborhood in the south of Gaza City. At approximately 11:00, local time, on Tuesday, 15 June 2004, Israeli troops called through megaphones on Mohammed Abu Dahrouj and his brothers to leave their home. PCHR had responded by first submitting an appeal to the Israeli military legal advisor, but received no response. A subsequent appeal was lodged with the High Court of Israel
In its response to PCHR’s request for an injunction, the lawyer from the Israeli army claimed that the Israeli military would not demolish these houses. Consequently the High Court refused to issue a temporary injunction, claiming that there exists no grounds for it. It decided to hold a session to consider the appeal on Thursday, 17 June 2004. However PCHR has observed a number of occasions when the IOF announced one policy to the court and practiced another on the ground.
PCHR is gravely concerned for the continuous Israeli policy of house demolitions, which have left thousands of Palestinians homeless, especially in Rafah. This policy is legally supported by the Israeli High Court, in violation of international humanitarian law, particularly the Fourth Geneva Convention.
