World Day against Death Penalty, 10 October 2016     The Palestinian Center for Human Rights (PCHR)   "On the World Day against Death Penalty, we stress that our struggle will continue on all levels to abolish this penalty… We believe, as everybody else do, the purpose of this punishment is reform and deterrence. However, death penalty does not achieve both sides of this purpose. This was proven with facts and researches made by the countries that apply this penalty the most… Justice is meant to bring safety and serenity not revenge". Lawyer Raji Sourani*     Introduction Death penalty is considered one of the most controversial issues in the Palestinian...

3 Death Sentences implemented in Gaza without Presidential Ratification: PCHR Stresses it is Extra-judicial Execution and Strongly Condemns it

Ref: 30-2016 On Tuesday, 31 May 2016, security services in the Gaza Strip implemented 3 death sentences that were previously issued by the judicial authority in the Gaza Strip without the ratification of the Palestinian President. The Palestinian Center for Human Rights (PCHR) strongly condemns this step and stresses that all the implemented death sentences constitute a flagrant violation of the rule of law, Palestinian Basic Law (PBL) and Penal Procedural Law in a way turning the application of these sentences into extra-judicial execution that requires holding those who ordered and implemented the sentence to account. A statement issued by the Ministry...

Applying Death Sentences without Presidential Ratification is Extra-Judicial Execution

Ref: 29/2016 On Wednesday, 25 May 2016, the Change and Reform Bloc took a decision to "consider the final death sentences, which were issued according to the fair trial standards and exhausted all challenge mechanisms, as ratified and enforceable". This step was taken to pave the way for applying a number of death sentences without the Palestinian President's ratification stipulated in many Palestinian laws, including the 2003 Palestinian Basic Law (PBL) and 2001 Penal Procedure Law. The Palestinian Centre for Human Rights (PCHR) emphasizes that applying any death sentence without the Palestinian President's ratification constitutes extra-judicial execution and the Change and Reform...

The first death sentence was issued against A. M. J. (23), from al-Zaitoun. However, the three other death sentences were issued in absentia against H. M. J. (30), M. M. J. (28) and M. H. S. (58). The Palestinian Center for Human Rights (PCHR) is gravely concerned over increasingly applying such irreversible penalties in light of the absence of real guarantees of fair trial, especially in view of the division in the Palestinian judicial system and...
