Israeli Occupying Forces Demolish House in Deir al-Balah Before End of Legal Time for Appeal
On Sunday evening, 9 May 2004, Israeli occupying forces demolished a Palestinian house near “Kfar Darom” settlement, southeast of Deir al-Balah, before the end of the time period they gave to the family to appeal against the demolition order.
According to investigations conducted by PCHR, on Friday evening, 7 May 2004, Israeli occupying forces delivered a written notice to Fadel, Isa’af and Nabil Younis Fadel al-Qedra informing them that their house would be demolished. According to the notice, the owners were given 48 hours to appeal against the demolition order.
On behalf of the owners, PCHR submitted an appeal against the order to the Israeli military legal advisor in the Gaza Strip on Saturday 8 May, 2004. The office of the Israeli military legal advisor informed a PCHR lawyer by phone that Israeli troops would not demolish the house before the end of the time period given to the family to appeal against the demolition order. However, Israeli troops demolished the house. As a result 29 people (3 families) have become homeless.
In its response to PCHR on 10 May 2004, the office of the Israeli military legal advisor claimed that the demolition of the house took place based on intelligence information that any delay in the demolition would “pose serious threats to the lives of Israeli troops.” The office did not explain the nature of such information for “security reasons.”
PCHR condemns the demolition of the house before the end of the time period offered for appeal, in violation of military orders promulgated by Israeli occupying forces themselves. PCHR rejects Israeli claims to justify attacks against Palestinian civilians and their properties.
