In this fact sheet,[1]
which covers the period from 1 March to 30 April 2012, PCHR documented 25 violations
perpetrated by the Israeli Occupation Forces (IOF) against Palestinian fishermen,
including 10 incidents in which IOF fired at fishermen. Besides, IOF arrested
12 fishermen and confiscated 3 fishing boats and equipment.


· Violation
of the Right to Life and Security of Person


Israeli attacks against Palestinian fishermen in the Gaza Strip
constitute a flagrant violation of the rules of the international humanitarian
and human rights laws, especially the right to life and security of the person
in accordance with Article 3 of the Universal Declaration of Human Rights and Article
6 of the International Covenant on Civil and Political Rights to which the
State of Israel is a party.  IOF
perpetrated violations against Palestinian fishermen in the sea when these
fishermen did not impose any threats to the Israeli naval troops.  The fishermen were practicing their right to
work and were searching for their livelihood within the territorial waters of
the Gaza Strip when IOF indiscriminately fired at them.


First: Firing at Fishing Boats in the Gaza Strip Waters


PCHR documented 10 cases in which IOF fired at Palestinian
fishermen in the sea off the Gaza shore during the reporting period.  In March and April, 2 and 8 firing incidents respectively
took place in the sea.  These incidents occurred
in the three-nautical-miles limit that is allowed for fishermen to sail and
fish in.  PCHR noticed that all these
firing incidents against fishermen and their boats took place in the context of
fighting them in their livelihood and imposing more restrictions to terrify and
prevent them from practicing their work freely.


 Second: Arresting
Fishermen and Confiscating Fishing Tools


During the reporting period, PCHR documented incidents in which IOF
arrested 12 Palestinian fishermen and confiscated 3 fishing boats and
equipment.

 


Arresting Fishermen


During the reporting period, IOF arrested 12 fishermen, including
two 17-year old fishers, while carrying out their work.


 At
approximately 12:00 on 13 April 2012, IOF’s gunboats deployed in the sea
arrested Mohammed Sa’eed al-Sa’idi, 22, from al-Shati’ refugee camp in Gaza
City, while practicing his work 2.5 nautical miles far from the Gaza
shore.  They transported him by an
Israeli gunboat to Ashdod Seaport, where he was questioned.  Al-Sa’idi was released on the same day.


 At
approximately 09:00 on 15 April 2012, the Israeli naval troops arrested 3
fishermen while they were practicing their work in the three nautical miles off
al-Sudaniya shore, north of Gaza City. 
However, they were released at 17:00 on the same day.  The arrested fishermen are: Salah Murad Abed Meqdad,
63, Ahmed Salah Murad Meqdad, 24, and Ali Nafez al-Akhsham, 31.


 At
approximately 10:30 on 24 April 2012, IOF deployed in the sea arrested Nader Yousef
Hassan Abu Sam’an, 22, and his brother Hassan, 17, from al-Shalihat area.  They were arrested off al-Waha Resort in the
northwest of Beit Lahia and were transported to Ashdod Seaport.  At approximately 19:00 on the same day, they
were released after being questioned by IOF.

 At
approximately 09:30 on 29 April 2012, IOF arrested 6 fishermen while they were
fishing 2 nautical miles far from al-Shati’ refugee camp shore in Gaza
City.  At approximately 21:00 on the same
day, five fishermen were released after having been questioned: Ahmed Isma’il
Ahmed al-Shrafi, 18; his brothers Amjad, 33, Asharaf, 30, and Belal, 22; in
addition to Yasser Mohammed Jamal al-Shrafi, 17. The sixth fisherman, al-Sadat
Abdul Mo’ti Abdul Mo’een Hasanain, 33, who is Egyptian, was kept in detention
for one more day until he was extradited at 20:00, on 30 April 2012 to the
Egyptian authorities.


Confiscation of Fishing Boats


PCHR has followed up the Israeli violations against the Palestinian
fishermen in the Gaza Strip sea, particularly the confiscation of fishing
boats.  During the reporting period, IOF
confiscated 3 fishing boats while their owners were sailing in the sea.


 At
approximately 09:00 on 15 April 2012, IOF confiscated a fishing boat belonging
to Salah Murad Abed Meqdad, 63, from Gaza City, while he was sailing 3 nautical
miles far from al-Sudaniya shore in the north of Gaza City.


 At
approximately 10:30 on 24 April 2012, IOF confiscated the boat of Mohammed
Yusef Abu Sam’an, 30, from Gaza City, while he was sailing off al-Waha Resort
in the northwest of Beit Lahia, in the northern Gaza Strip.

 At
approximately 09:30 on 29 April 2012, IOF confiscated a fishing boat belonging
to Amjad Isma’il al-Shrafi, 33, from al-Shati’ refugee camp in Gaza City, while
he was sailing 2 nautical miles far from Gaza shore.
